Regular Town Meeting, July 12, 2018 1 Town of Niles TOWN BOARD MEETING July 12, 2018 Niles Town Hall PRESENT: Joan Jayne, Supervisor Steven Cuddeback, Councilman Bernard Juli, Councilman Clarence Edmonds, Councilman Joseph MacDuffee Tiffany Landis, Town Clerk Attorney Brody Smith OTHERS PRESENT: Pat Steger and Roger Slater A. Meeting called to order at 7:00 pm by Supervisor Jayne B. Pledge of Allegiance C. Open floor to the public There were no comments from the public. D. Approval of Minutes Regular Town Board meeting on 6/14/18 On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the minutes of June 14, 2018 be approved. Councilman MacDuffee arrived. ---PAGE BREAK--- Regular Town Meeting, July 12, 2018 2 E. Motion to approve Abstracts by Fund: RESOLUTION #2018-61 APPROVE ABSTRACT 4 (APRIL BILLS). a. A General Fund $40,428.24 b. DA Highway Fund $15,111.80 c. SR Garbage Fund $11,834.50 e. H1 Water Fund $27,633.75 f. H2 Sewer Fund $39,900.00 On a motion by Councilman Cuddeback, seconded by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-61 F. Department Reports a. Supervisor's Report: Councilman Juli read in the paper that sales tax revenue was down b. Code Enforcement Officer's Report: Code Enforcement Officer Doyle was not in attendance but he provided a report on June's activities. Eight building permits were issued in June; a pavilion, a lean-to, a roof for a deck, single family dwelling, demolition of a single family home, in-ground pool and a pole barn addition. Councilman MacDuffee stated he has received good reports on Officer Doyle. He is doing a great job. c. Highway Superintendant's Report: -Superintendent Steger summarized his daily journal which was provided to the Board members. Highway Department provided support for clean-up days. Assisted Locke and Sempronius with CHIPs seals. Vermeer mower was put back together and Rowe Road was mowed. Worked on Mack Road and Plunkie Point. Paved Corrigan Road with Suit-Kote. Sempronius, Moravia, Venice, Locke and Summerhill all assisted. Mowing continues on all roads. -Superintendant Steger said he went out with requests for bids to repair the salt barn and he only received one response - from Complete Construction Concepts, LLC. Discussion ensued about breaking the repairs into different years. The consensus was to do the complete repair and not break it into separate jobs. The building is over 35 years old. There is money available in the Capital building fund. Attorney Smith stated that there was a good faith effort to gain additional bids. Superintendant Steger sent the request to several companies. Bids were asked for twice. Attorney Smith Advised the Board to pass a Resolution awarding the repair contract to Complete Construction Concepts. ---PAGE BREAK--- Regular Town Meeting, July 12, 2018 3 RESOLUTION #2018-62 AWARD COMPLETE CONSTRUTION CONCEPTS, LLC TO REPLACE THE INSIDE WALLS OF THE SALT STORAGE BARN FOLLOWING A REAR WALL FAILURE. FUNDS TO MAKE REPAIRS WILL COME FROM THE CAPITAL BUILDING FUND (A234) AND WILL BE TRANSFERRED INTO THE BUILDING REPAIR ACCOUNT (A5132.4). THE COST OF REPAIR IS $29,985.00. On a motion by Councilman Cuddeback, seconded by Councilman MacDuffee the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-62 The Clerk was directed to publish a 30-day permissive referendum in the Town's paper. Once the 30 days have passed the repair can begin. The Highway Conference is at Turning Stone this year from 17-20 September. It is a joint conference with NYS County Highway Superintendants Association. d. Attorney Report: -Attorney Smith reported that he worked with Assessor Schramm on a couple of exemption issues. -Attorney Smith worked with the Board of Appeals and the Code Enforcement Officer. A deck permit was asked for but it was already built. We have nothing in our laws about the policy for decks. The question is does the set-back policy apply to decks/porches. There are no neighbors complaining. Owner has to go back and pay the permit fee. The Board of Appeals has to decide if decks do apply, if they don't or if a variance is required. There is no doubt a permit should have been requested before the deck was built. The fee is doubled if you don't get a permit. If the Code Enforcement Officer can't inspect properly some of the deck may have to be torn down. The Town Board can always amend the law. e. Town Clerk: The Clerk received shares totaled $1,414.00 and they have been deposited. f. Dog Control Report: There was four complaints, one dog seized and sheltered, one dog adopted, one dog euthanized, one notice to comply written and one lost and found match. g. Historian's Report: The Historian is working on Community Day crafts and other items. The history room was also cleaned and prepped for the upcoming Community Day. ---PAGE BREAK--- Regular Town Meeting, July 12, 2018 4 h. Assessor's Report: Assessor Schramm was not in attendance but she provided a report. The final assessment roll was generated. The Assessor met with property owners regarding inventory on data mailers. There was an informational meeting held on June 20th at the Town Hall. 474 responses have been received and reviewed, approximately 150 more have been returned and are awaiting review. The Assessor will attend training July 16- 20th. School bills will be mailed on August 31st. Work continued on sales analysis and land table schedule for 2019 reassessment. Beginning in September of 2018 field review of 2019 values will begin. Approval to contract with Jeff Lowe to assist the Town Assessor with the 2019 Reevaluation project at an amount not to exceed $4,500 and paid from funds budgeted in line A1355.41. RESOLUTION #2018-63 APPROVAL OF SUPERVISOR'S REPORT AND DEPARTMENTAL REPORTS On a motion by Councilman Cuddeback, seconded by Councilman MacDuffee, the following resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, to approve the Supervisor's and departmental reports. G. Other Business a. Clean-up days will be here at the Town Barn from 8 am - 1 pm on the 21st. Councilman Cuddeback will be working. Superintendent Steger suggested that we put information on where people can get Freon free tags in the newsletter next year. b. Community Day is going to be held on July 22, 2018 from 1-4 pm. There will be crafts for the children and venders there. The tent is ordered and music will be provided by Petty Thieves. Food and drink will be available. c. Supervisor Jayne briefed the Board on a request for NYS DOS letter of support for the Town of Skaneateles application to serve as a member of the of the Waterfront Revitalization Program. RESOLUTION #2018-64 TO SUPPORT THE TOWN OF SKANEATELS APPLICATION FOR STATE GRANTS On a motion by Councilman Cuddeback, seconded by Councilman MacDuffee, the following resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-64 ---PAGE BREAK--- Regular Town Meeting, July 12, 2018 5 d. Supervisor Jayne received a thank you letter from the Westside Lake Association for speaking at their last meeting. The main topic was the state's upcoming plans for improving Carpenter's Falls. A link on our website will provide the most update information on the project; e. West Fall Cemetery - We have had a request for plot. Ownership of the cemetery is in question. Attorney Smith and Councilman Juli are investigating. f. Solar Moratorium - Councilman Juli attended the Planning Board meeting. The Planning Board requested that a committee be formed. Councilman Juli will be the Town Board's representative. H. Motion made by Councilman Cuddeback to adjourn, seconded by Councilman MacDuffee, motion unanimously carried to adjourn at 8:04 pm.
