Town of Sennett Board Meeting September 18, 2018 Minutes of the Town of Sennett Town Board held on Tuesday September 18, 2018 at 7:00 PM at the Sennett Town Office Building, Members Present: Peter Adams, Supervisor Jerrold Eades, Councilman Edward Rizzo, Councilman Richard Gagliardi, Councilman James Jeffers, Councilman Ronald Schalck, Water & Wastewater Superintendent Cheri Major, Bookkeeper Richard Andino, Attorney Penelope Dennis, Town Clerk Meeting opened with the pledge to the flag. Minutes of the previous meeting are approved on a motion made by Councilman Eades, seconded by Councilman Gagliardi, 5 ayes, 0 nays, carried. The bookkeeper reports that the tentative budget for the general fund is complete, water and sewer is being worked on. There are two more budget workshops on the 24th and the 25th at 6:00 PM. The Supervisor updates the board with the year to date numbers. Old Business: Supervisor Adams states that the Town has received from Senator DeFrancisco a SAM Grant for $79,829.00 for use in upgrades to the Town Park. This a reimbursable grant – the Town spends the money, then we are reimbursed. A thank you goes out to Senator DeFrancisco. The Town id waiting to hear back from Tompkins County Health Care Consortium if the Town has been approved to join. The Town has started negotiations with the Teamsters with another meeting planned in October. Also, the town is reviewing dental and vision insurance numbers. The WIIA Grant application has been submitted, the Town is requesting 60% of the cost. New Business: Mary Beth Leeson, from Cuddy & Ward, is present to discuss the 2017 audit. There are two letters included; one regarding NYS fund balance policies-establish reserve policies and one regarding fixed assets policies. The fund balance is strong, strong cash balance, 2017 income was up, and net position is good. There Is further review and discussion on the audit. The Town Board needs to do a resolution creating for Civil Service requirements the position of Part-Time Assessor. There is discussion on the number of hours per week – civil service recommends 15-20 hours per week and board members ---PAGE BREAK--- would like to see up to 30 hours per week to correspond with the Employee Handbook. This is tabled until the next meeting. More information/information will be available. The Town Board would like information on unpaid water accounts. It is reported that all O&M charges have been paid. The Town Board would also like a list of all fire inspections. The Cayuga County Supervisors will meet on September 20th at 7:00 PM. Also, the State is reviewing commercial assessments within the town. Councilman Jeffers informs the board of a meeting of the Cayuga County Water Authority. He updates the board on the information that he garnered at the meeting. The Authority wants to take over all water in the county. Responsibility of each municipality for maintenance and the end result is still questionable. There is also discussion on a business that is looking to buy in the Town and in the City of Auburn. Proposed local Law B – 2018 is explained to the board by Attorney Andino. This law would allow an increase in the tax levy if it is needed. It would be for one year only – 2019. It is an unlisted action for SEQRA purposes. TOWN BOARD RESOLUTION September 18, 2018 TOWN OF SENNETT LOCAL LAW B OF 2018 Local Law Overriding the Tax Levy Limit Established in General Municipal Law §3-c in the Town of Sennett”) Councilman Eades introduced proposed Local Law No. B-2018, relating to the ability of the Town of Sennett to override the limit on the amount of real property taxes that may be levied by the Town of Sennett pursuant to General Municipal Law §3-c, and to allow the Town of Sennett to adopt a Town budget for the fiscal year 2019 in excess of the “tax levy limit,” and made the following motion, which was seconded by Councilman Jeffers: WHEREAS, no other agency has the legal authority or jurisdiction to approve or directly undertake the enactment of a local law in the Town of Sennett, such that there are no other involved agencies within the meaning of the New York State Environmental Quality Review Act (SEQR) with respect to the proposed enactment of said Local Law, with the result that the Town Board shall act as lead agency in this matter; and WHEREAS, the adoption to said Local Law is an unlisted action for purposes of environmental review under SEQR; and ---PAGE BREAK--- WHEREAS, the Town Board has determined that a short environmental assessment form (EAF) shall be required in connection with this matter; and WHEREAS, the said EAF has been prepared and has been reviewed by the Town Board; and WHEREAS, the Town Board has considered the adoption of said Local Law, has considered the criteria contained in 6 N.Y.C.R.R. Part 617.7 and has compared the impacts which may be reasonably expected to result from the adoption of said Local Law against said criteria. NOW, THEREFORE, it is RESOLVED AND DETERMINED, that the enactment of proposed Local Law No. B- 2018 is an unlisted action, there are no other involved agencies and this Board shall act as lead agency in this matter for purposes of SEQR review; and it is further RESOLVED AND DETERMINED, the Town Board has determined this action shall have no significant adverse impact on the environment; that, accordingly, an environmental impact statement (EIS) shall not be required; and that this resolution shall constitute a negative declaration under SEQR; and it is further RESOLVED, that the Town Board shall conduct a public hearing as to the enactment of proposed Local Law No. B-2018 at the Town Hall located at 6391 Cherry Street Road, Auburn, New York on October 16, 2018 at 7:00 p.m., or as soon thereafter as the matter can be heard, at which time all persons interested in the subject shall be heard. The question of the adoption of the foregoing resolution was duly put to a vote and upon roll call, the vote was as follows: Peter Adams Supervisor Voted Yes Rick Gagliardi Councilman Voted Yes Jerrold Eades Councilman Voted Yes James Jeffers Councilman Voted Yes Edward Rizzo Councilman Voted Yes The foregoing resolution was thereupon declared duly adopted. Also, the Supervisor is working to get the Drainage District funded this year. Department Reports: The Highway Department reports: installed a new culvert on Mandy Rue; brush pickup; mowed roadsides; sent trucks to Weedsport, Elbridge, Brutus and Skaneateles to help with paving and did routine ---PAGE BREAK--- maintenance on equipment. The Water & Sewer Department reports that they finished servicing hydrants in water district now they are being painted; water samples were done; water operation reports were done and given to DOH by the 10th; there were two after hour alarms at the Rte. 5 sewer pump station, we replaced a float and tightened all electrical connections as needed in the panel box; talked to two people scheduled to put up houses in WD#2/SD#1, they will need both services hooked up; van and backhoe were washed; grass was cut at Franklin St pump station and at the water tank; marked out many dig requests; marking out and repairing curb stops as needed; daily checks of Franklin St pump station and weekly checks of sewer pump stations. The ZBA has a meeting scheduled for the 27th. Nothing new for the Planning Board. Judge Timian reports $5,067.00 for August. Judge Riley reports $4,462.50 for August. The Town Clerk reports $767.64 for August. The court Clerk’s report is read and reviewed. The CEO’s report is read and reviewed. Attorney – requests an Executive Session to discuss pending issues. Assessor – nothing. The Public To Be Heard Segment is opened on a motion made by Councilman Eades, seconded by Councilman Jeffers, 5 ayes, 0 nays, carried. Jeremy Bacon, Turnpike Road, questions if there is a limit to the amount of surplus or the length of time? There is discussion on this. A motion to close the Public To Be Heard Segment is made by Councilman Jeffers, seconded by Councilman Eades, 5 ayes, 0 nays, carried. A motion is made by Councilman Jeffers, seconded by Councilman Eades to pay the abstract in the amount of $113,235.18. Roll Call Vote: Councilman Eades yes, Councilman Gagliardi yes, Councilman Rizzo yes, Councilman Jeffers yes, Supervisor Adams yes, carried. A motion is made by Councilman Eades to enter into Executive Session with Attorney Andino for discussions regarding proposed, pending or current litigation, seconded by Councilman Jeffers, 5 ayes, 0 nays, carried. A motion is made by Supervisor Adams to come out of Executive Session, 5 ayes, 0 nays, carried. Councilman Gagliardi made a motion which was seconded by Councilman Jeffers to authorize the Supervisor to execute a Stipulation of Settlement and Order for the Owens Brockway Glass tax certiorari matter conditioned upon final attorney review and approval which motion was approved by a unanimous vote of the Town Board.
