This Local Law shall be known as a "Local Law to Amend the Town of Victory Zoning Map." Section 1.2 Purpose. It is the purpose of this Local Law to promote the public health, safety and welfare of the citizens of the Town of Victory (the "Town") including those purposes set forth in Zoning Law § 101 of the Town of Victory, by amending the zoning classification of real property commonly known as 1035 Bell Road in the Town of Victory and designated as tax map numbers 37.00-1-25.111 and 37.00-1-25.112 in the Town from an hidustrial Planned Development District to an agricultural/residential zoning classification. It is the further purpose of this Local Law to effectuate the provisions of an Order of the Cayuga County Supreme Court, Hon. Mark H. Fandrich, presiding, duly entered on October 7, 2013 in an action entitled Town of Victory vs. Robert Rigdon and Patricia Rigdon, under Index No. 2011-0406 in said Court. Section 1.3 Statutory Authorization. This Local Law has been adopted pursuant to and in conformity with Town Law § 261 et seq.. Municipal Home Rule Law § 10 and the New York State Constitution. SECTION 2 INTERPRETATION AND CONFLICT WITH OTHER LAWS Section 2.1 Supremacy. This Local Law shall supersede all previous laws, ordinances and resolutions adopted for the purpose of establishing the Rigdon Industrial Plarmed Development District and any amendments thereto. Section 2.2 Interpretation. In their interpretation and application, the provisions of this Local Law shall be held to be minimum requirements, adopted for the promotion of the public health, safety, and welfare. Whenever the requirements of this Local Law are at variance with the requirements of any other lawfully adopted rules, regulations, ordinances, or local laws, the most restrictive, or that imposing the higher standards, shall govern. SECTIONS AMENDMENT OF ZONING LAW Section 3.1 Zoning Change. The Rigdon Industrial Planned Development District is hereby dissolved and the zoning classification of the real property commonly known as 1035 Bell Road in the Town of Victory and designated as tax map numbers 37.00-1-25.111 and 37.00- 1-25.112 is hereby be amended and reclassified from an Industrial Plarmed Development District 1 ---PAGE BREAK--- to an agricultural/residential zoning classification as those terms are defined in the Town of Victory Zoning Law, and the zoning map of the Town of Victory shall be and hereby is amended to reflect this change in classification. SECTION 4 MISCELLANEOUS Section 4.1 Separability. If any part or provision of this Local Law or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part, provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this Local Law or the application thereof to other persons or circumstances and the Town of Victory, by its Town Board, hereby declares that it would have enacted this Local Law or the remainder thereof had the invalidity of such provision or application thereof been apparent. ; Section 4.2 Headings. Section headings are used only for convenience and have no meaning or effect. Section 4.3 Effective Dafe.This Local Law shall become effective upon the filing of same with the Secretary of State.
