VILLAGE BOARD MEETING SEPTEMBER 12, 2016 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:02 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton, and Anthony Peppe were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Code Enforcement Officer Fred Delaney, Officer In Charge Rob Brown, and Officer Nick Atkins were also present. Mayor Mulvaney introduced the Village’s new part-time Police Officer Nick Atkins to the Village Board. The Board welcomed him to Moravia! · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the minutes for the August 22, 2016 Village Board Meeting. · BILLS A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bill #121 due to conflict of interest.) · PURCHASE ORDERS A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following two purchase orders: $590.00 to Custom Controls for the purchase of a Variable Frequency Drive for the Wastewater Treatment Plant. $746.32 to Webster’s Garage for the repair of the 2007 Chevy Truck for the Street Department. · DEPARTMENT REPORTS A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Treasurers Report for the month of August. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Public Works Report for the month of August. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Water Meter Replacement Report for the month of August. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Fuller Park Inspection Report for the month of August. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of August. ---PAGE BREAK--- A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of August. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Dog Control Report for the month of August. A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Police Report for the month of August. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the written and verbal Code Enforcement Report for the month of August. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Report for the month of August. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of August. · CABLE Mayor Mulvaney reported that he talked with Attorney Thomas Blair and distributed the updated Cable Franchise Agreement. Mayor Mulvaney requested the Board to review the Franchise Agreement by the next regularly scheduled Board meeting. The Board received a copy of a letter sent to Zito New York, LLC from Mayor Mulvaney notifying them of the Village’s Local Law pertaining to reimbursement for professional services (which was enclosed) and a letter to Ray Dyer (Southern Cayuga County Cablevision) pertaining to removal of the empty poles in the Village, necessary insurance that was needed and a reminder of reimbursement due from him pertaining to professional services the Village had accrued. The Board also received a copy of the Indemnification Agreement drawn up by Attorney Thomas Blair. After some discussion, and under the advisement of Attorney Blair, the Board directed the Mayor to send a letter to Ray Dyer reminding him of the professional service reimbursements that are due to the Village, insurances needed, and to send a copy of the Indemnification Agreement that Mr. Dyer needs to sign. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above). · VILLAGE ORDINANCES The Board approved the final copy of the Open Burning Law. Mayor Mulvaney stated he had received an email from Fire Chief Bill Andersen with no changes suggested. After some discussion, the Board directed the Village Clerk to request Village Attorney Charles Marangola to prepare the final Open Burning Law so that the Board could set a public hearing. · WATER LEAK DETECTION UPDATE ---PAGE BREAK--- Mayor Mulvaney reported that there was extremely low water pressure last week in Montville and was unable to find the leak. He stated that Mike Perkins (DPW) called in New York Leak Detection (NYLD) and they couldn’t find the leak either. (There are no maps, no tracer wire, and mostly plastic pipes.) Mayor Mulvaney also said that the Cayuga County Health Department was contacted and they were unable to help. However, the leak finally surfaced and was repaired. There was also a meeting with Mayor Mulvaney, Mike Perkins (DPW), Cayuga County Health Department, and Cayuga County Soil and Water to remediate future problems with having water outside the Village and not in a District. Mayor Mulvaney stated he would write a letter to the Montville residents to insert in their water bill in October. Mayor Mulvaney stated that there was another leak that needs to be repaired in front of Land of Lakes Realty and a water line that needs to be put in to Gary Debele’s business on Main Street. · ZONING AMENDMENTS (PB) Mayor Mulvaney stated that there was no update from the Planning Board on the Zoning Amendments. · SOLAR (STP) The Board received a copy of an email pertaining to the possibility of solar at the Sewer Treatment Plant through a grant. The email stated that the Central New York Planning and Development Board was preparing to issue Request for Proposals for the municipalities that were interested. · OAK HILL GRAVEL PIT Mayor Mulvaney stated that the Cayuga County Highway Department had ordered the poles in order to erect the decibel signs on Oak Hill Road. Mayor Mulvaney stated he would keep the Board updated on this agenda item. · VILLAGE OF MORAVIA EMPLOYEE POLICY REVIEW Mayor Mulvaney stated he spoke with Kean (STP) and Mike Perkins (DPW) about the “On Call” pay in the Village of Moravia Employee Policy that the Board has been discussing. After some discussion, the Board agreed to have 1½ hours for each morning and evening to check the water on Saturdays, Sundays, and holidays for the Department of Public Works and 2 hours once per day on Saturdays, Sundays, and holidays for the Wastewater Treatment Plant. The Board also wanted an addition to the policy stating that any time worked above and beyond the “on call”, the employee(s) from the Department of Public Works and/or the Wastewater Treatment Plant would receive overtime rate for actual hours worked. The Board directed the Village Clerk to make the revisions. This agenda item was tabled until the next regularly scheduled Board meeting. · INFORMATIONAL ITEMS The Mayor discussed looking into two used trucks for the Department of Public Works and the Sewer Treatment Plant in the near future. On the table for Board review was: - Vehicle Log Sheets for the month of August. - Obituary (former McGraw Village Clerk). Each of the Trustees received a copy of the following: - Letter from Village Attorney to Skeele Insurance Agency. - Letter from Cayuga County Board of Elections (no primary September 13th). ---PAGE BREAK--- - Cayuga County Association of Villages Minutes (06/21/16). - Memo from Board to OIC Brown (Crossing Guard salary and payroll). - Town of Moravia Minutes (4/27 & 5/18/16). - Quarterly Open Agenda Items.
