1 Village of Fair Haven Zoning Board of Appeals Hearing May 3, 2016 The hearing began at 7:00 p.m. ZBA members present Acting Chairman Christopher Drogi, Susan Stanistreet, Jimmy Kawar and Dave Guynn. Also present Clerk Terri DiGregorio, Deputy Mayor Walter Krehling, John Musico, Jeff Bame, Gay Williams and Alan Williams. Timothy Lowden for O’Connor’s Main Street Pub requests an area variance for relief from provisions of Zoning Article 150-18 to increase the square footage for signage at 559 Main Street tax map #8.20-2-63.  Mr. Lowden explained to the Board he removed the signs on the stairway to the upper deck and commented he would like to keep the two existing off premise signs. He is requesting a variance for 128 square feet of additional signage around the railing of his upper deck advertising daily specials. This signage would include five 20 square foot sections which would also eliminate items from falling through the railing of the upper deck onto the patrons below.  Mr. Lowden was reminded he was before this Board last year regarding violation of the Village of Fair Haven sign law in which he was directed to remove all off premise signs along the upper deck and stairway by December 31, 2015. Most of the signs were removed but two remain, therefore continuing to be in violation of the sign law. The Board of Trustees was asked to review and update the sign law if deemed outdated which was done over the period of a couple of meetings concluding the sign law was appropriate but required better enforcement.  Due to existing signage presently exceeding the allowed 48 square feet, the ZBA denied the requested variance on a motion by Chris Drogi and seconded by Susan Stanistreet. All aye, motion carried. Mr. Lowden stated he will be in Fair Haven May 13th to remove the signs in violation and reposition them. Alan & Gay Williams request an area variance for relief from provisions of Zoning Article 150-9 to construct an addition on to their existing home at 14770 South Hadcock Drive tax map #8.11-1-48.  Mrs. Williams explained the floor plan for the proposed addition to connect the house to the garage. They are requesting a 2 foot variance to the front and a 6 foot variance to the side noting part of the garage is already nonconforming. The Williams’ spoke to the neighbors on the side where the variance is requested and they had no objections. It was noted that the addition would not interfere with the connection to the public sewer.  A letter in favor of the project was received from Wesley and Elaine Maurer who own property across the street.  The variance was approved on a motion by Jimmy Kawar and seconded by Dave Guynn. All aye, motion carried. Jeffrey Bame requests an area variance for relief from provisions of Zoning Article 150-9 to construct a garage at 14186 South Hadcock Drive tax map #8.11-1-29.  Mr. Bame explained he is requesting a 7.5 foot front variance and a 5 foot side variance to build a 30’ x 32’ two car garage with a second floor. The proposed garage will be brought up to grade level by around 6 feet at the lowest point.  A letter in favor of the garage was received from William and Susan Crossett.  The variance was approved on a motion by Dave Guynn and second by Jimmy Kawar. All aye, motion carried. ---PAGE BREAK--- 2 MINUTES: The minutes from the December 17, 2015 hearing were approved on a motion by Susan Stanistreet and seconded by Chris Drogi. All aye, motion carried. COMMUNICATIONS: Upcoming training: Cayuga County 2016 Land Use Training Series and Wayne County Local Government Training for 2016 NEW BUSINESS: Susan Stanistreet suggested having a designated day each month to hold a ZBA hearing to avoid holding multiple hearings each month during the building season. No decisions were made at this time. ADJOURNMENT: The meeting was adjourned at 8:00 p.m. on a motion by Chris Drogi and seconded by Jimmy Kawar. All aye, motion carried.
