Regular Town Meeting, March 8, 2018 1 Town of Niles TOWN BOARD MEETING March 8, 2018 Niles Town Hall PRESENT: Joan Jayne, Supervisor Steven Cuddeback, Councilman Bernard Juli, Deputy Supervisor Attorney Brody Smith Clarence Edmonds, Councilman Patty Podolak, Deputy Town Clerk OTHERS PRESENT: Sean Murphy, Dave Powers, Dan Kehoe, Pat Steger A. Meeting called to order at 7:00 pm by Supervisor Jayne B. Pledge of Allegiance C. Open floor to the public Mr. Dave Powers requested an update on the Adams Property. Attorney Smith stated that the Code Enforcement Officer went out to the site and nothing has changed. He wrote an affidavit stating that nothing had been corrected. That paperwork has been given to a process server. Mr. Adams will be served a notice of appearance. There will be 3 attempts on 3 different days. An arraignment is scheduled for April 14th in Town Court. Discussion on amending the Town Code ensued. D. Approval of Minutes Regular Town Board meeting on 2/8/18 On a motion by Councilman Juli, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the minutes of February 8, 2018 be approved. E. Status on Water and Sewer Capital Project Mr. Chris Lawton, from Barton and Loguidice, DPC briefed the Board on the status of the Water and Sewer project. Mr. Lawton stated that the contractor is mostly done on the sewer lines. They are working on grinder pumps now. The digging work is done and the electricians will be there soon to install the electric. Mr. Lawton said that they have worked to solve the drainage issues. Mr. Lawton said in their original design they designed another outfall for storm water. The contractors while working discovered two other outfalls that were clogged and not functioning. There is money leftover in the contract. This change order is to not build the outfall that was designed but to get the two outfalls discovered by the contractors in working condition. Mr. Lawton said repairing these two discovered ---PAGE BREAK--- Regular Town Meeting, March 8, 2018 2 outfall will significantly improve the drainage and we can do it within the already approved budget. The reason for the change order is that it is additional work for the contractor but not additional spending for the district. The work will not involve our Highway department. Discussion ensued about easements, drainage and where work was being done. Mr. Lawton stated that the upkeep of the sewer and water systems are the responsibilities of the Water and Sewer district. RESOLUTION #2018-40 TO APPROVE CHANGE ORDER 2 OF THE NILES SEWER DISTRICT NO. 1 AND WATER DISTRICT NO.1 Replacement of an existing stormwater lateral between 320 Fire Lane 15 and 322 Fire Lane 15 and the addition of a new stormwater lateral between 326 Fire Lane 15 and 328 Fire Lane 15. This Change order has a cost of $18,000. The costs will be paid 50% our of the sewer project ($9,000) and 50% out of the water project ($9,000). On a motion by Councilman Cuddeback, seconded by Councilman Juli, the following resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-40 Change Order 2 is on file at the Clerk's office. F. Motion to approve Abstracts by Fund: RESOLUTION #2018-41 APPROVE ABSTRACT 3 (MARCH BILLS). a. A General Fund $16,488.47 b. DA Highway Fund $16,780.03 c. SR Garbage Fund $11,834.50 d. SF Fire District Fund $289,555.00 e. H1 Water Fund $7,291.25 f. H2 Sewer Fund $58,871.50 On a motion by Councilman Juli, seconded by Councilman Cuddeback the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-41 G. Executive Session RESOLUTION #2018-42 EXECUTIVE SESSION On a motion by Supervisor Jayne, seconded by Councilman Cuddeback, the following resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the Board go into Executive Session at 7:25 pm to discuss employment issue ---PAGE BREAK--- Regular Town Meeting, March 8, 2018 3 RESOLUTION #2018-43 RETURN TO REGULAR SESSION On a motion by Councilman Cuddeback, seconded by Councilman Edmonds, the following resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the Board return to regular Session at 7:49 pm RESOLUTION #2018-44 HIRE J. PATRICK DOYLE AS TOWN CODE ENFORCEMENT OFFICER A letter will be sent. There will be a 6 month probationary period. On a motion by Councilman Cuddeback, seconded by Councilman Edmonds, the following resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the Town of Niles Board adopt RESOLUTION #2018-44 H. Supervisor's Report RESOLUTION #2018-45 TO APPROVE JANUARY AND FEBRUARY TOWN SUPERVISOR'S REPORTS On a motion by Councilman Juli, seconded by Councilman Edmonds, the following resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-45 Charles Ripley, our Cayuga County legislator addressed the Board and public. Mr. Ripley stated that Congressman Katko (NY-24) thinks there will be some reimbursement for the damage that the 2017 summer storms caused. The Town Councilman asked about reimbursement for the damage done to Oak Hill Road and concerns were raised about high speed internet. Fiber optic is what is wanted in the Town. I. Departmental Reports A. Code Enforcement: Currently vacant. B. Assessor's: Assessor Tammy Schramm was not in attendance but she provided a report. Pictures were added to 280 parcels in January. The plan is to have all pictures done by the end of March. Renewal applications continue to come in; 90% have been returned. Ms. Schramm will be reviewing building permits and adding new inventory to the assessment roll. Change of assessment notices will be sent May 1st. Data mailers will be sent to property owners so that they may review their property inventory and either agree that it is correct or contact me about any errors. C. Attorney Report: Attorney Smith had nothing further to report. ---PAGE BREAK--- Regular Town Meeting, March 8, 2018 4 D. Town Clerk: Deputy Clerk Podolak gave report. The Clerk received shares totaled $92.00 and they have been deposited. Eighty Four percent of the property taxes have been collected totaling $2,207,311.16. We are in the 2% penalty phase for collection. We can continue to collect full payments until April 2, 2018. E. Highway Superintendant's Report: Superintendent Steger summarized his daily journal which was provided to the Board members. Highlights included repair of two garage doors, building mud flap brackets to use when paving, various maintenance on equipment, plowing and sanding. Salt was emptied from 3 plow trucks so the frame and rust spots could be cleaned, primed and painted. Tree work was conducted on Dewitt, Rowe, Case, Fitzpatrick and Vanderstouw Roads. The Historian, Dar Winters, also provided a report. She is researching a maple syrup business on Route 38A for a family. The Dog Control officer, Suzie Tracy had three complaints; dogs at large. She had a couple calls for other animal issues - she provided information on who to call. There was one lost and found match and she wrote two notices to comply. RESOLUTION #2018-46 APPROVAL OF DEPARTMENTAL REPORTS On a motion by Supervisor Jayne, seconded by Councilman Cuddeback, the following resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, to approve departmental reports. J. Other Business Supervisor Jayne stated that Meals on Wheels is a valuable service. The Office of the Aging sent the Supervisor a letter stating that at least five seniors in the Town of Niles were provided with over 1028 meals during 2017. The Board concurred that the Town should continue to support this service. The 2018 budget has $800 earmarked for the program. Abstract 3, which was approved, includes this payment. K.
