VILLAGE BOARD MEETING JANUARY 8, 2018 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Gary Fickeisen, Chris Fulton, Nancy McGuerty, and Anthony Peppe (entered at 7:06 p.m.) were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Code Enforcement Officer Patrick Doyle, Officer in Charge Robert Brown, and Village Attorney Charles Marangola were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the minutes for the December 26, 2017 Village Board Meeting. · BILLS A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bills #258 and #264.) (Mayor Mulvaney voted.) · DEPARTMENT REPORTS A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the Treasurer’s Report for the month of December. A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 3-0 vote to approve the Public Works Report for the month of December. (Trustee Peppe entered.) A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Water Meter Replacement Report for the month of December. A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of December. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of December. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Dog Control Report for the month of December. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Police Report for the month of December. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the written and verbal Code Enforcement Report for the month of December. Each of the Trustees received a copy of the Village’s ISO report pertaining to the Building Code Effectiveness Grading Schedule results which the Village received a 4 Classification. Code Enforcement Officer Patrick ---PAGE BREAK--- Doyle explained the results and answered questions of the Board. (Classifications are 1-10, with 1 being the best. It was noted that last year the Village had received a 99.) A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of December. It was noted that there was no Justice Report for the month of December. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above). · VILLAGE ORDINANCES Each of the Trustees received a copy of a memo from the Village of Moravia Planning Board stating that they had “no objections” concerning the proposed Zoning Amendment that was drafted by the Board of Trustees. Mayor Mulvaney stated that the Zoning Board had not had a meeting in order to give their input. This item was tabled until the next regularly scheduled Board meeting. · SEWER BREAKS & FLOODING Mayor Mulvaney reported that there was no news on this agenda item. · GOODNOUGH PROPERTY (SKINNER HILL ROAD) Village Attorney Charles Marangola presented a survey map he received from surveyor Bud Manzari with an old waterline highlighted across a piece of property on Skinner Hill Road that the Village has an easement to. Mr. Marangola explained the current easement and suggested to request the current “floating easement” to have an easement of fifteen feet (15’) on either side of the waterline. Mr. Marangola stated he would contact Karpinski’s office (representing the buyer of the property) to draw up the paperwork and present it to the Board. It was noted that the Village had received a letter from Karpinski’s office in April 2017 requesting a release of the easement. This item was tabled until the next regularly scheduled Board meeting. · RIGHT OF WAY (20 EAST CAYUGA STREET) Each of the Trustees received a copy of their letter to Camardo Law Firm pertaining to the Board’s denial to release the Village’s Right of Way at 20 East Cayuga Street and a letter in response letter from Camardo Law Firm. A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to enter Executive Session at 7:28 p.m. for possible litigation. (Village Attorney Charles Marangola was in attendance.) A motion was made by Trustee McGuerty seconded by Trustee Peppe and carried with a 4-0 vote to exit Executive Session at 7:48 p.m. · QUARTERLY FAIR HOUSING PUBLIC NOTICE ---PAGE BREAK--- A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the advertising of the quarterly Fair Housing Public Notice that each of the Trustees received. · ANNUAL CONTRACTS (LIBRARY, HISTORICAL SOCIETY, SCAT VAN) A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following contracts: Powers Library $3,000.00 Cayuga-Owasco Lakes Historical Society $ 600.00 Transportation Project for Cayuga County (SCAT Van) $ 600.00 · PERMISSION FOR WINTER WORKSHOP COCHRAN, PHOENIX, PERKINS, SMITH) A motion was made by Trustee McGuerty, seconded by Trustee Fulton to authorize Kean Sean Cochran, Dick Phoenix, Mike Perkins, and Bill Smith to attend W2Operator Training Group Winter Work Shop in Cortland on January 26, 2018. (No roll call was taken.) After some discussion pertaining to Part-Time Laborer Scott Cooper attending the Winter Workshop, a motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to amend the motion to authorize Kean Sean Cochran, Dick Phoenix, Mike Perkins, Bill Smith, and Scott Cooper (if Mayor Mulvaney discovers it would be good for Mr. Cooper to attend) to attend W2Operator Training Group Winter Work Shop in Cortland on January 26, 2018. · SPRING CLEAN-UP Each of the Trustees received a draft copy of the flier for Spring Clean-Up. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 approving Spring Clean-Up on April 21st and 22nd, 2018. · LETTER OF RESIGNATION (JUDGE WADE) Each of the Trustees received a copy of a resignation letter from Judge David Wade II as Acting Village Justice. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote accepting the Judge David Wade II as Acting Village Justice effective January 1, 2018. The Board directed Village Clerk Anne Riddell to send a thank you letter for the years of service Judge Wade gave to the Village. · SCHOOL CROSSING GUARD POSITION Village Clerk Anne Riddell explained that Village employee Gerald Hall was still listed as Part-Time Substitute School Crossing Guard and needed to be changed to Part-Time School Crossing Guard, per the Cayuga County Civil Service Department. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to remove Gerald Hall as Part-Time Substitute School Crossing Guard and appoint him as Part-Time School Crossing Guard, effective immediately. · CLEANER POSITION *See below. This item was tabled until the next regularly scheduled Board meeting. ---PAGE BREAK--- · EMPLOYMENT APPLICATION (CLEANER - JACKSON) An employment application from Brian Jackson for Part-Time Cleaner was on the table for Board review. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to accept and place on file the employment application from Brian Jackson for Part-Time Cleaner. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - NYSDEC Award letter 17,278 – Comprehensive Plan). - Town of Moravia Minutes (11/15/17). - Village’s response letter to a Village resident pertaining to storm drains. - Cayuga County Association of Village’s Agenda (01/23/18). On the table for Board review was: - Vehicle Log Sheets for the month of December. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to enter Executive Session at 8:05 p.m. to discuss personnel. (Code Enforcement Officer Patrick Doyle was in attendance.) A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to exit Executive Session at 8:52 p.m. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to direct Mayor Mulvaney to send a letter to Village property owner, Gary Debele, pertaining to his water service at 48 Church Street. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to adjourn at 8:56 p.m. Anne Riddell, Village Clerk
