VILLAGE BOARD MEETING APRIL 10, 2017 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, and Chris Fulton were in attendance. (Trustee Peppe was absent.) Village Clerk Anne Riddell, Treasurer Susan Wade, Officer in Charge Robert Brown, Code Enforcement Officer Fred Delaney, Village Attorney Charles Marangola, Matt Smokoski (Four Town), Tammy Perry (Four Town), and Park Street residents: Ruth Bradley, Charlotte Batzer, Jeff Saeli, Dan Hull, Jan Rose, and Dan Rose were also present. · PUBLIC HEARING – 2017-2018 BUDGET A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 3-0 vote to open the public hearing at 7:00 p.m. for the 2017-2018 Budget. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the minutes for the March 27, 2017 Village Board Meeting. · BILLS A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the following bills. (Mayor Mulvaney voting.) (Trustee McGuerty abstained from Bill #386 due to conflict of interest.) · TRANSFER A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 3-0 vote to approve the following transfers: From: A1990.4 Contingent To: A1110.4 Justice $1,000.00 · DEPARTMENT REPORTS A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the Treasurer’s Report for the month of March. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 3-0 vote to approve the Public Works Report for the month of March. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 3-0 vote to approve the Water Meter Replacement Report for the month of March. A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 3-0 vote to approve the Sewer Treatment Plant Report for the month of March. ---PAGE BREAK--- A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 3-0 vote to approve the Vehicle Log Sheet Report for the month of March. A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 3-0 vote to approve the Police Report for the month of March. Each of the Trustees received a copy of the Cayuga County E-911 Communications Center Spillman Public Safety Computer Network Use Agreement that was reviewed and approved by Village Attorney Charles Marangola. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve and authorize Mayor Mulvaney to sign the Cayuga County E-911 Communications Center Spillman Public Safety Computer Network Use Agreement. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the verbal and written Code Enforcement Report for the month of February and March. A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 3-0 vote to approve the Justice Building Inspection Report for the month of March. There was no Dog Control Report or Justice Report for the month of March. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above). · VILLAGE ORDINANCES Mayor Mulvaney stated that the review of the Village Ordinances was on hold so that the Board could discuss the Rental Permit Local Law #5 of 1990, which would be done later in the meeting. · ZONING AMENDMENTS (PB) – SITE PLAN REVIEW Mayor Mulvaney stated the Village Planning Board had not met recently to discuss the Site Plan Review due to not having a quorum. This item was tabled until the next regularly scheduled Board meeting. · SOLAR POWER GRANT (STP) Mayor Mulvaney stated that the Village received an email that the CNY Regional Planning and Development Board would be presenting their final recommendations soon. This item was tabled until the next regularly scheduled Board meeting. · RENTAL PERMIT LOCAL LAW #5 OF 1990 REVIEW Village Attorney Charles Marangola addressed the Board pertaining to their request of reviewing the Rental Permit local laws. Attorney Marangola suggested rescinding the two Village local laws pertaining to rental permits and amending the Village’s local law pertaining to the enforcement of the New York State Building Code. It was discussed that by doing this, only rentals that had three or more units would need to be ---PAGE BREAK--- inspected every three years versus the current laws (all rental units need to be inspected every two years). He also stated that the fees for rental inspection could be set be resolution. Attorney Marangola stated that he would have this prepared for the next regularly scheduled Board meeting for the Board to review. · POLICE POLICIES Village Attorney Charles Marangola reported to the Board that he and Officer in Charge Robert Brown had reviewed thirty-six (36) police policies that Officer Brown had drafted. Officer Brown stated that he would make the suggested changes and give the finished policies to the Village Clerk next week. This item was tabled until the next regularly scheduled Board meeting. · FOUR TOWN FIRST AID (BUILDING CONSTRUCTION) Matt Smokoski addressed the Board updating them on the future new two story building construction of the Four Town First Aid building. Mr. Smokoski stated that he had been in contact with Code Enforcement Officer Fred Delaney and that Mr. Delaney suggested that they ask for a variance or an exemption of an elevator that would need to be installed in the new building, according to the New York State Building Code. Mayor Mulvaney stated that the Village would check to see if an exemption would be allowed and get back to them. The Board thanked them for coming. · PARK STREET RESIDENTS (SPEED CALMING MEASURES) Ruth Bradley (Park Street resident) and several other Park Street residents addressed the Board and presented a petition. The petition requested that the Village Board consider traffic-calming measures on Park Street due to the high volume and the high speed of vehicles on this street. After some discussion, Officer in Charge Robert Brown stated that he would perform a traffic study over the next week and give a report. Ms. Bradley stated that she had spoken with the Moravia School Superintendent about closing the gates to the school’s back entrance to reduce the amount of school traffic entering the rear of the property from Park Street. The Board thanked them for coming and stated that they would review their request and contact them. · GARDEN CLUB REQUEST Each of the Trustees received a copy of a letter from the Moravia Area Garden idea Club (MAGiC) requesting up to $150.00 to purchase summer flowers (from Anna’s) for the planters on Main Street, assistance in emptying and refilling the pots with new soil, assistance in picking up garden debris from the Peace Garden in Fuller Park, and spreading some mulch on the Peace Garden. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the Moravia Area Garden idea Club (MAGiC) above request. · WATER RATE INCREASE (RESOLUTION) A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 3-0 vote to approve the following resolution: LET IT BE KNOW THAT, at the regular scheduled meeting held on April 10, 2017, the Board of Trustees of the Village of Moravia do hereby resolve to increase the water rates effective July 1st, 2017 water billing according to the following schedule. Water Rate Increases to be effective July 1st water billing. (Village Attorney Charles Marangola exited at 8:20 p.m.) · KILBORNE AGENCY DISCLOSURE STATEMENT A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to accept and place on file the Disclosure Statement from Walter Dabulewicz of Kilborne Insurance Agency, the Village’s Insurance Agent. · NATIONAL DAY OF PRAYER – LETTER Each of the Trustees received a copy of a letter written to Mayor Mulvaney pertaining to participation in the National Day of Prayer on Thursday, May 4, 2017. · PUBLIC NOTICE – VILLAGE ELECTION PUBLIC NOTICE IS HEREBY GIVEN that at the regular meeting of the Village Board of Trustees held on April 10, 2017, the following resolution was proposed by Trustee McGuerty, seconded by Trustee Fulton and adopted by a unanimous vote: WHEREAS that Annual Election for Village Officers will be held on Tuesday, June 20, 2017, and; WHEREAS the Village of Moravia shall constitute a single Election District for Village Elections, and; WHEREAS no person shall be entitled to vote at the Village Election whose name does not appear on the Cayuga County voter’s registration book; NOW THEREFORE BE IT RESOLVED that the Annual Village Election will be held at the Village of Moravia Justice Center, 48 West Cayuga Street, Moravia, New York on Tuesday, June 20, 2017 between the hours of 12:00 noon and 9:00 p.m. · LETTER OF RESIGNATION (STEVENS – MPD) Each of the Trustees received a copy of a letter of resignation from the Village’s Part-Time Police Officer Neil Stevens. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 3-0 vote to accept the letter of resignation from Part-Time Police Officer Neil Stevens, effective immediately. (It was noted that an appreciation letter would be sent to Officer Stevens for his service to the community.) · SOUTHERN CAYUGA COUNTY CABLEVISION ---PAGE BREAK--- After some discussion, a motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 3-0 vote to authorize Village Attorney Charles Marangola to send a letter to Ray Dyer, owner of Southern Cayuga County Cable, to collect legal reimbursements, a signed indemnification agreement, and a reminder that the old cable poles still needed to be removed in the Village. (It was noted that several requests had previously been made with no response.) · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - Cayuga County Association of Villages Agenda (memo). - Town of Moravia Minutes (02/15/17). - Justice Center Sprinkler Inspection (Davis-Ulmer). - Letter from NYS Municipal Workers’ Compensation Alliance recommendations from a recent visit to the Village of Moravia. On the table for Board review was: - Vehicle Log Sheets for the month of March. · PUBLIC HEARING – 2017-2018 BUDGET A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 3-0 vote to close the public hearing at 8:39 p.m. for the 2017-2018 Budget. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 3-0 vote to adopt the 2017-2018 Village of Moravia Budget, as presented. Trustee McGuerty gave a report on a recent seminar that she and Treasurer Susan Wade attended. (Material was put on the table for Board review.) A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to enter Executive Session at 8:49 p.m. to discuss personnel.
