TOWN OF STERLING PLANNING BOARD MEETING June 23, 2015 A Special meeting of the Town of Sterling Planning Board was held on Tuesday June 23, 2015 at the Sterling Town Hall at 7:00 pm with the following members present: June Ouellette ~ Chairman Sue Allen ~ Member Grover Horn ~ Member Vernon Bishop ~ Member Susan Lemon ~ Member Also Present : Christopher Ferlito, Larry Benedict, Mireille Watts, Virginia Fichera, Steve Keeling, Harold Burghart, Carolyn Keeville, Larry Flint, Kelly LaRock and Lynn Lyons. Chairman Ouellette called the meeting to order at 7:02 pm. CORRESPONDENCE – Towns & Topics PUBLIC HEARING Larry Benedict Chairman Ouellette read the notice into the record and opened the Hearing at 7:02 pm Notice is hereby given that the Planning Board of the Town of Sterling will hold a Public Hearing on Tuesday June 23, 2015 at 7:00 p.m. at the Sterling Town Hall, 1290 State Route 104A, Sterling, NY 13156. An Application for the Review of Subdivision by Larry Benedict will be heard regarding the Minor Subdivision of property located at 1383 State Route 104A, Sterling, NY 13156; Tax Map # 10.00-1-19. All those wishing to be heard in favor of or in opposition of said application may appear in person or by other representation at said time and place. By order of the Planning Board Lisa Somers, Clerk Mr. Benedict presented his revised subdivision map for the Board Members to review. The missing elements noted at the June 1st meeting had been added to the Board’s satisfaction. Mr. Benedict explained to the audience present that he owned 70 acres and wanted to subdivide a 5 acre parcel that contains the residential home that he is selling. He plans to continue farming the remaining acreage until the new homeowners are in a position to purchase it as well. The Board Members reviewed the short form EAF required for SEQR review with the applicant whom initialed a couple changes the Board initiated. The project was determined to have no adverse effects on the neighborhood. The Hearing was opened to the public for any comments or questions – there were none. The Hearing was closed at 7:30 pm on a motion moved by Member Allen and seconded by Member Horn, all were in favor and the motion carried. A motion to accept the Benedict minor subdivision as submitted was moved by Member Horn and seconded by Member Lemon, all were in favor without further discussion and the motion carried. Resolution 2015-07 BE IT RESOLVED, by the Planning Board for the Town of Sterling, upon the facts presented and the determination made, that the application for a Minor Subdivision of property owned by Larry Benedict and located at 1383 State Route 104A, Sterling, NY 13156; Tax map # 10.00-1- 19 is hereby GRANTED upon the following express conditions: NONE but to be filed with Cayuga County within 62 days. A roll call vote was taken: ---PAGE BREAK--- Chairman Ouellette Aye Member Allen Aye Member Horn Aye Member Bishop Aye Member Lemon Aye 5 Ayes, 0 Nays, and 0 Abstentions - APPROVED BUSINESS Steve Keeling –Preliminary meeting- Minor subdivision (#20.00-1-14) Mr. Keeling presented a surveyed subdivision map for property at 15129 State Route 104 in Martville for the Board to review for completeness in order to schedule a Public Hearing. The map needs the following revisions: 1. contiguous property owners across the road need to be added. 2. ‘Final’ needs to be added to the title block. A Hearing was scheduled for Monday July 6, 2015 at 7:00 pm. Steve Keeling – Sketch Plan Confernce – Minor subdivision Mr. Keeling has another property along State Route 104 that he would like to subdivide a parcel containing an existing mobile home from the remainder which he would merge with an adjacent parcel. The Board reviewed the dimensional requirements of minimum 2 acres, 200’ road frontage, depth to width ratio and setbacks for the structure. Mr. Keeling plans to return after a survey map can be drawn. PUBLIC HEARING Christopher Ferlito The Public Hearing for this project was tabled at the June 1st meeting in order for Mr. Ferlito to request an area variance which was denied by the ZBA on June 22nd. The applicant would like to continue with the Special Use Permit request by submitting a new map at the July meeting that will eliminate the need to pursue a variance. He proposes to have a surveyed map containing a new line that will establish the 1,000’ setback from all of the neighboring structures and will also identify a new area within the ‘life of mine boundary’ that is compliant with the Town regulations. Chairman Ouellette stated that she had the opportunity to walk the life of mine boundary at a meeting on June 12th held by the DEC with some of the involved agencies – Cayuga County Highway, Army Corps of Engineers, DEC representatives, the applicant and his geologist, Sterling Supervisor Randy Lawrence and PB Chairman June Ouellette were in attendance, the DOT was invited but declined to attend. The representative from the Army Corp of Engineers requested that the life of mine boundary at the southeast corner of the project be moved from the bottom of the hill to the top of the hill to further protect the Sterling Creek and associated wetlands. Virginia Fichera had many questions of the project and presented copies of 2 pages of the Comprehensive Plan and a Future Use map to the Board Members as well as hanging them in the hallway for residents to view. Another resident, Mirielle Watts, expressed concern for school buses using the narrow road along with hauling trucks and the safety issues it poses for the families with children on Sanford Road. Mr. Ferlito responded that changes had been made to the site plan by the DEC to mitigate these issues. The Planning Board awaits letters from the Town of Victory Highway, Cayuga County Highway, DOT and the DEC for responses ---PAGE BREAK--- to the 239Review comments as well as documentation of the DEC’s comment period which ended June 5th. PRIVILEDGE OF THE FLOOR Town of Granby and Hannibal residents, Lynn Lyons and Kelly LaRock, presented an article they had written and was published in the Valley News concerning another gravel mine approved by Special Use Permit on the Harris Hill Road. The mine has been problematic – rocks strewn into peoples yards, endless potholes and pothole repairs from the hauling trucks, noise and traffic. The residents wanted to stress to the Planning Board that they are in a position to be the only authority to control the affects of this project because the Special Use permit awarded is attached to the property for life regardless of the owner. The enforcement of the conditions stipulated with a special permit is key to controlling the mines activity and the DEC does not have jurisdiction once the trucks leave the mine and are on public roads – it then falls upon the Town’s resources to monitor and enforce. MINUTES Meeting minutes for June 1, 2015 were approved with corrections by a motion moved by Member Bishop and seconded by Member Lemon. All were in favor without further discussion and the motion passed. ADJOURN On a motion by Member Horn and seconded by Member Allen, the meeting was adjourned at 8:55 PM.
