Town of Throop Board Meeting September 15, 2018 BOARD MEMBERS PRESENT: ` Supervisor Tarby Council woman Young Councilman Paczkowski Councilwoman Banas TOWN OFFICIALS PRESENT: Dog Control Officer Schillace Zoning Officer Weed Town Clerk Malenick Minutes Supervisor Tarby called the meeting to order at 8:00 am opening with the pledge of allegiance. A motion to accept the minutes as written for August as accurate and true was made by Councilman Paczkowski. Councilwoman Banas seconded the motion. The motion passed unanimously. The following reports were read:  The Clerks Report: A motion to accept the clerks report was made by Councilman Paczkowski. Councilwoman Young seconded the motion. The motion passed unanimously  Codes and Zoning  Highway Report Public Forum Richard Jordan requested the minutes be read at every board meeting. Supervisor Tarby declined stating he did not feel it necessary to read the minutes aloud. Mr. Jordan asked how anyone would know that he ever actually saw the minutes. Supervisor Tarby replied that they all had copies in their hands and they sign the original document and it is recorded as a public document. Mr. Jordan stated he wants the Town to distribute the minutes. Supervisor Tarby stated he was more than welcome to FOIL request the minutes whenever he would like. Mr. Jordan accused Supervisor Tarby of withholding information from Throop residents because he doesn’t want anyone to know what he is up to. He then asked why the minutes were not on the website. Town Clerk Malenick stated there is a format issue we are trying to resolve. The webmaster needs the document sent to her in a word format and when It is scanned it converts it to a PDF. We are working to resolve the problem. ---PAGE BREAK--- Mr. Jordan then congratulated Supervisor Tarby for his win in the small claims court. Mr. Jordan previously filed a small claims case against the Town of Throop because he was unhappy with his assessment and had exhausted all other appeals and lost. He went on to explain that he sold his property and will be suing the Town with the proceeds from the sale. He then stated he wants his road re-paved. He said part of the road is in Sennett, and he didn’t expect Throop to pave that section, but he wants the section in Throop paved. Supervisor Tarby asked if Sennett was going to repave their section. Mr. Jordan told Supervisor Tarby to call them and find out. Supervisor Tarby stated he was not going to call the Town of Sennett. He stated there were no plans to re-pave Sittser Road at this time. Mr. Jordan then asked how to friend request the Town of Throop on Facebook, so he could leave his opinion on Facebook as well. It was explained to him that you don’t friend request a public Facebook Page. Councilwoman Young explained to him that on the Throop page, there is a thumb. You click on the thumb and that’s how you like the page. He also stated the Grievance Board was crooked and worthless, and told Supervisor Tarby to shove it. He stated all it was a bunch of people that has no knowledge of real estate whatsoever. He said they don’t make any decisions, The Town Assessor makes all the decisions, and they just go along with it. Frank Morgenthaler asked if there was any way the Town could enforce people to put their numbers on the mailboxes. He stated the Fire Department has a tough time finding houses when the numbers are not displayed on the mailboxes. Richard Jordan stated the Town Board does not run the meetings correctly. He accused Supervisor Tarby of shutting him down because he doesn’t want to hear what he has to say. Councilwoman Banas asked Mr. Jordan to please stop berating everyone on the Board. Mr. Jordan told her she was as bad as the rest of the Board, and was nothing but a yes man like everyone else. Supervisor Tarby stated most Boards won’t even enter into a discussion with the public at the regular board meetings. They give the public time to express their concerns, but don’t address it until the Board can discuss/investigate the topic. Mr. Jordan accused him of lying. Mr. Jordan then accused the Town Assessor of raising the prices of farm land because of a purchase made in another Town. Councilman Paczkowski stated the Town Assessor has nothing to do with what the price of farmland is going for. It is strictly marketplace value. Mr. Jordan stated a farmer sold 200 acres to the bottling plant on County House Road for 3 – 4 thousand dollars an acre. He then suggested they ask the Assessor why she called John O’Connell (a farmer that is leasing Mr. Jordan’s land) to confirm that he is farming the land that Mr. Jordan is claiming an Agricultural Exemption. “That’s how corrupt she is” Mr. Jordan stated. Supervisor Tarby told Mr. Jordan that was her job. Mr. Jordan replied, Yeah, I know it is, to be corrupt.” Supervisor Tarby stated it was time to move on and changed the forum to Old Business Old Business None A plaque was presented to Mike Vitale for 25 years of dedicated service to the Town of Throop and for being a Throop Town Board Member. Mr. Vitale was very moved and thanked the Town Board for their recognition. ---PAGE BREAK--- Supervisor Tarby made a motion to enter into executive session at 8:20 am to discuss personnel. Councilwoman Young seconded the motion. The Board reconvened at 8:46 am. The following bills were reviewed for payment General Fund Vouchers #589 - #611 in the amount of $8,284.54 were reviewed for payment. Councilman Paczkowski made a motion to pay Vouchers #589-#611 in the amount of $8,284.54 Supervisor Tarby seconded the motion. The motion passed unanimously. Highway Vouchers #363 - #372 in the amount of $3,948.82 were reviewed for payment. Councilman Paczkowski made a motion to pay vouchers #363-#372 in the amount of $3,948.82 Supervisor Tarby seconded the motion. The motion passed unanimously. Water Vouchers # 277 - #283 in the amount of $7,876.37 were reviewed for payment. Councilman Paczkowski made the motion to pay vouchers # 277-#283 in the amount of $7,876.37 Councilwoman Young seconded the motion. The motion passed unanimously. SW1 Vouchers #234-#238 in the amount of $4,146.23 were reviewed for payment. Councilman Paczkowski made a motion to pay vouchers #234-#238 in the amount of $4,146.23. Supervisor Tarby seconded the motion. The motion passed unanimously.
