TOWN OF SUMMERHILL April 10, 2018 Town Hall 13606 State Route 90 Locke, NY 13092 Town Board Members Present: Susan Stout, Supervisor Duane Reynolds, Councilman (7:07) Christopher Ryan, Councilman Mary Osgood, Councilwoman Daniel Ripley, Councilman Town Board Members Absent: None Other Town Officers Present: John Kirk, Barb Harvey, Linda Wright, John Chase, and Christina Ripley Residents: None Visitors: None Guests: None Recording Secretary: Carol Chase The meeting was called to order at 7:01 pm by Susan Stout. All stood for the pledge to the flag. Minutes from February 13, 2018 meeting: Motion 28-2018 Duane Reynolds made a motion to accept the minutes with the correction of the spelling of “ lien” on page 2, seconded by Mary Osgood. Carried 4 ayes Stout, Reynolds, Ryan, Osgood 0 nays Minutes of the March 13, 2108 meeting: Motion 29-2018 Mary Osgood made a morion to accept the minutes with the addition of the word”be” under Planning Report, seconded by Duane Reynolds. Carried 4 ayes Stout, Reynolds, Ryan, Osgood 0 nays REPORTS A. Town Clerk’s Report: $269 was collected for the month of March. The Clerk informed the board of a FOIL request from Scalfone Law office that was ”a needle in a haystack” situation and the Clerk obtained opinions from the Committee on Open Government to support this position and the agreed that it was not a reasonably described request. Motion 30-2018 Dan Ripley made a motion to accept the Clerks report as presented, seconded by Chris Ryan. Carried 5 ayes Stout, Reynolds, Ryan, Osgood, Ripley 0 nays B. Supervisor’s Report: Susan Stout; Balance of Accounts as of March 31, 2018 Motion 31-2018 Chris Ryan made a motion to approve the Supervisor’s report as presented, seconded by Dan Ripley. Carried 5 ayes Ryan, Ripley, Reynolds, Osgood 1 abstain Stout 1. General Money Market Fund: $121,645.29 2. Highway Money Market Fund: $352,220.51 3. General Consolidated Fund: $100.00 4. Code Enforcer’s Report: Kevin McMahon, 1 building permit issued,1 expired building permit notice, 1 building permit inquiries, 1 Certificate of Occupancy issued, 5 plan reviews for permits, $28.00 in fees collected, 15 site/driveway visits inspections, 2 framing/structural inspections, 1 plumbing/ heating/ vent inspection. Dog Control Report: No Report E. Highway Superintendent’s Report: John Kirk, All the trucks are inspected. They had to replace the radiator on the Oshkosh. The broom has new bristles. They have stripped down one truck. This year it is planned to redo 1.6 miles of Fillmore Rd. He plans on grinding off 4 feet and widening the road to 22 feet. He will put pug down and then go over it. He has 4 culverts to replace, 1 on Masten Rd. He may not be able to do East Lake Rd. If he has money left he will do something F. Variance Board: No Report I. Planning Board: Barb Harvey, She missed the March meeting. The County has training in August on Site planning. There is nothing new from the Albanese project. A letter was sent to them a month ago. Christina will have to resign as a Planning Board member but will stay on as Secretary. Barb would like to appoint Shane Baldino. The Town Board would like him to attend the next meeting. Christina will have to submit a resignation letter. The Planning Board has had a couple of workshops for tallying the survey results. There is a workshop this Thursday at 7pm and a meeting on April 19. Mary Osgood attended the planning workshop with Christina and Barb. She states it was a great workshop. The agenda included: A) Agricultural considerations when placing solar and other energy related products by Michael Saviola, Agricultural Specialist, NYS Ag & Mkts; B) NYS Agricultural district Law and Local Laws, How do they relate by Dr. Robert Somers, Manager- Farmland Protection Unit, NYS Ag & Mkts; C) Applying for, Developing, and, Implementing Town Agriculture and Farmland Protection Plans by John Brennan, Farmland Protection Specialist & Ag Districts Manager and Jeff Kehoe, Planning Grants Coordinator, NYS Ag & Mkts. J. Board of Assessment Review: No Report K. Historians Report: No Report L. Town Justice: Sherry Davenport, 20 cases, $1865 in fines and $1045 in surcharges for a total of $2912. OLD BUSINESS A. Update on Roof Repair: Susan finally got the preliminary specs on the roof repair. Kevin has reviewed it. The job must pay prevailing wage. Ric Galbato has a bid ad and will forward the completed ad to Susan. She will then forward it to the Board for review before placing the ad. B. Update on New Vision: John Chase says he feels duped and is irritated with the way New Visions is handling things. Carmen Branca was supposed to sit down with Susan and John before beginning. Susan will be calling Carmen and asking why he hasn’t submitted the plans for the State Routes. They are in the process of developing a pamphlet that they can hand out to residents. Large spools of cable will be arriving next week and they will be sectioning off part of the storage room out back. The Board would like a camera installed in the kitchen. Chris Ryan would like to know if they are covered for any damage to the hall and who will pay the electricity. The board would like the data center to have its own entrance, utilities and what compensation will the town receive in writing. Motion32-2018 ---PAGE BREAK--- Dan Ripley made a motion for New Visions to construct a room in the back storage area with an outside entrance, their own electricity and rent or compensation to the town. They must have liability coverage and insurance, seconded by Chris Ryan. Carried 5 ayes Stout, Ripley, Ryan, Reynolds, Osgood 0 nays Chris Ryan will call Carmen Branca. C. Email a copy of the Code of Ethics to the Board. D. Sterling Planning Services: Amy DeAngelo cannot get Doug Keirst from Cayuga County Soil and Water to meet with her. Doug said to meet with Tim from his office. Charlie has a meeting with Mr. Keirst in the morning and he will speak to him. Water is the connection for the grants. . E. Audits: Clerk and Tax Collector audit: Tabled NEW BUSINESS A. Calendars for Retirement Resolution: Please turn them in to Susan. B. Comp Alliance: Comp Alliance is our Workmen Compensation provider. There are other companies out there. Comp alliance has a “ joint and several liability clause”. If they have to pay a claim that exceeds their funds they can ask for additional payments from everyone to cover the claim. We pay Comp Alliance $15147 annually. The 497 New York State public entities Safety Group’s annual fee would be $17807. This company does not reach back for more money. They do give yearly dividends back to the town. Susan needs the Board to pass a resolution giving Susan permission to sign with the 497 Safety group. Motion 33-2018 Dan Ripley made a motion to allow Susan to end the contract with Comp Alliance and prepare a resolution to change to 497 NYS Public Entities Safety Group for the next meeting, seconded by Duane Reynolds. Carried 5 ayes Stout, Ryan, Reynolds, Ripley, Osgood 0 nays C. Scholarship Applications will be delivered to the Board members. D. Susan will be attending Finance school from May 9-11 E. Items in the Storage room and on the Porch: Susan and the Highway guys got rid of the trash but the remaining stuff needs to be looked at and determined whether we should keep it or get rid of it. Motion 34-2018 Mary Osgood made a motion to meet on April 30 from 12pm-2pm to sort the items, seconded by Duane Reynolds. Carried 5 ayes Stout, Ryan, Reynolds, Osgood, Ripley 0 nays F. Clean Up Day: The Town clean Up day will be June 2, 2018 8am-2pm at the Town Barn. G. Florence Lansdowne’s Memorial Service: The service will be held at the Fillmore Birth Site on June 16. H. Review of the Site Plan Law: Tabled I. Cold War Exemption Change: The Clerk will have a resolution for the next meeting. J. Procedure for Recommendations from the Planning Board to the Town Board when a new business wants to open in town: Tabled Until next month RESIDENT ISSUES 1. Duane Reynolds: Next month we should be thinking about solar farms and include them in the solar law. ---PAGE BREAK--- PAYMENT OF BILLS There were 25 General account bills, vouchers 80-103 &111, totaling 6,132.85 and 7 Highway account bills voucher numbers 104-110 totaling $4513.51 presented for payment Motion 35-2018 Chris Ryan made a motion to approve payment of these bills, seconded by Dan Ripley. Carried 5 Ayes Stout, Ryan, Ripley, Reynolds and Osgood 0 Nays The next regular Town Board meeting will be May 8, 2018 at 7pm. Motion 36-2018 A motion to adjourn was made by Duane Reynolds, seconded by Dan Ripley. Carried 5 Ayes Stout, Ryan, Ripley, Reynolds and Osgood 0 Nays The meeting was adjourned at 9:42pm.
