VILLAGE BOARD MEETING MARCH 26, 2018 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:03 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton, and Anthony Peppe were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Thane Benson (VFW Post #7127), and Village Attorney Charles Marangola were also present. · PUBLIC Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. Mr. Thane Benson representing the VFW Post #7127 wanted to address the Board pertaining to the Memorial Day Parade. · PUBLIC HEARING – APPROPRIATION OF SEWER REPAIR RESERVE FUND A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to open the public hearing at 7:04 p.m. for the Appropriation Of Sewer Repair Reserve Fund. · VFW PARADE REQUEST Thane Benson (VFW) requested to have the VFW Memorial Day Parade approved for Monday, May 28, 2018. Each of the Trustees received a copy of the Request for Parade Permit. A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the VFW Memorial Day Parade for May 28, 2018 at 10:30 a.m. and waive the deposit. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the minutes for the March 12, 2018 Village Board meeting, as amended. · BILLS A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the following bills. Mayor Mulvaney stated that CNY Tractor contacted the Village and stated that the repairs to the 2014 Massey Red Tractor are going to be higher than anticipated. He stated that we will receive the bill when the tractor is delivered. (This was informational only.) · TRANSFERS A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the following transfers. From: A1990.4 Contingent To: A1630.4 Office – Contingent $1,000.00 From: G1990.4 Contingent To: G8110.4 – Sewer Administration $1,000.00 ---PAGE BREAK--- · DEPARTMENT REPORTS A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Police Report for the month of February. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Report from David Wade for the month of January. (Mayor Mulvaney explained that it needed to be completed and filed for the month of January because his resignation date was January 1, 2018.) · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Each of the Trustees received a copy of a synopsis from Treasurer Susan Wade of the history of the New Meter Replacement program. · VILLAGE ORDINANCES Mayor Mulvaney stated that the Zoning Board would probably be meeting in May so that the Board of Trustees could receive their input. This item was tabled until the next regularly scheduled meeting. · SEWER BREAKS AND FLOODING Mayor Mulvaney stated that Cayuga County is still scheduled to come and put in fill where it is needed on North Main Street. · GOODNOUGH PROPERTY (SKINNER HILL ROAD) Each of the Trustees received a copy of the Partial Release of Easement and Agreement and TP-584 pertaining to the Goodnough property on Skinner Hill drawn up by Village Attorney Charles Marangola. After an explanation from Village Attorney Charles Marangola, a motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 5-0 vote, the Board approved the following resolution. WHEREAS, the Village Board of the Village of Moravia, New York, has considered a limited release of certain water rights pursuant to a proposed Partial Release of Easement and Agreement between the Village of Moravia, New York, and Dana L. Goodnough, as Trustee for The Phillip J. and Nancy C. Goodnough Irrevocable Trust, dated September 29, 2011,with respect to premises situated in the Town of Moravia, County of Cayuga, State of New York, and depicted on a Boundary Survey Map made by Watkins Land Surveying, PLLC, dated October 7, 2016 (Job No. 16-474.18); NOW, THEREFORE, BE IT RESOLVED by the Village Board of the Village of Moravia, New York as follows: 1. The Village Board of the Village of Moravia, New York, hereby accepts the aforesaid proposed Partial Release of Easement and Agreement between the Village of Moravia, New York, and Dana L. Goodnough, as Trustee for The Phillip J. and Nancy C. Goodnough Irrevocable Trust, dated September 29, 2011,with respect to premises situated in the Town of Moravia, County of Cayuga, State of New York, and depicted on a Boundary Survey Map made by Watkins Land Surveying, PLLC, dated October 7, 2016 (Job No. 16-474.18); and 2. The Village Board of the Village of Moravia, New York, hereby authorizes the Mayor of the Village of Moravia, New York, to execute the said Partial Release of Easement and Agreement and any other document or ---PAGE BREAK--- instrument with respect to this matter as the Village Attorney, Charles A. Marangola, Esq., may authorize or direct. The question of the adoption of the foregoing resolution was duly put to a vote, which resulted as follows: Mayor Gary Mulvaney Voting YES Trustee Nancy McGuerty Voting YES Trustee Anthony Peppe Voting YES Trustee Gary Fickeisen Voting YES Trustee Chris Fulton Voting YES · VILLAGE’S WATER/SEWER SYNOPSIS 2017 Mayor Mulvaney reported that the leak on West Cayuga Street was to be finished tomorrow according to Mike Perkins (DPW). · RIGHT OF WAY (20 EAST CAYUGA STREET) Each of the Trustees received a copy of two letters from Camardo Law Firm and an email response from Village Attorney Charles Marangola pertaining to the Board’s denial to release the Village’s Right of Way at 20 East Cayuga Street. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to enter Executive Session at 7:39 p.m. for possible litigation. (Village Attorney Charles Marangola was in attendance.) A motion was made by Trustee McGuerty seconded by Trustee Fickeisen and carried with a 4-0 vote to exit Executive Session at 7:52 p.m. (Village Attorney Charles Marangola exited at 7:53 p.m.) · VILLAGE OF MORAVIA EMERGENCY WATER PLAN, EMERGENCY OPERATIONS PLAN, AND EMERGENCY MANAGEMENT PLAN Each of the Trustees received a copy of the updated Village of Moravia Emergency Water Plan, Emergency Operations Plan, and Emergency Management Plan. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the updated Village of Moravia Emergency Water Plan, Emergency Operations Plan, and Emergency Management Plan. · LETTER OF REQUEST TO CC BOARD OF ELECTIONS (MACHINE) Each of the Trustees received a draft letter from the Village to Cayuga County Board of Elections requesting use of Cayuga County’s voting machine for a cost of $300.00. A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve a letter of request to be sent to the Cayuga County Board of Elections for use of the voting machine for the June 19, 2018 Village Election. ---PAGE BREAK--- · APRIL FAIR HOUSING PUBLIC NOTICE A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to declare April as Fair Housing Month and to publish the notice. · WILLIAMSON LAW SOFTWARE SUPPORT (PAYROLL) Each of the Trustees received a copy of the contract from Williamson Law for Payroll Software support. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the annual payroll software support contract with Williamson Law for a total of $760.00. · VILLAGE OF MORAVIA FISCAL STRESS REPORT Each of the Trustees received a copy of the Village’s Fiscal Stress report from the Office of the New York State Comptroller. Treasurer Susan Wade stated that the Village was still rated as “No Designation” which was good! A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to accept the Village of Moravia’s Fiscal Stress report from the Office of the New York State Comptroller. · SET PUBLIC HEARING – BUDGET 2018-2019 A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to set the public hearing for the Village of Moravia 2018-2019 budget for Monday, April 9, 2018 at 7:00 p.m. · LOCAL LAW #1 OF 2018 – PROPERTY TAX CAP Treasurer Susan Wade copied each of the Trustees a draft of Local Law #1 of 2018 pertaining to the property tax cap. She stated that this law would override the current 2% tax cap mandated by New York State, if needed. After some discussion, a motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to hold a public hearing on April 9, 2018 at 7:00 p.m. for Local Law #1 of 2018 – A Local Law Authorizing A Property Tax Levy In Excess Of The Limit Established In General Municipal Law §3-c. · CLOSE PUBLIC HEARING Mayor Mulvaney asked if there were any questions or comments from the Board or the public. There were none. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to close the Public Hearing at 8:21 p.m. · RESOLUTION - APPROPRIATION OF SEWER REPAIR RESERVE FUND A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 5-0 vote to approve the following resolution. RESOLVED, The Village of Moravia Board of Trustees do hereby appropriate money from the Sewer Repair Reserve Fund in the amount not to exceed $ 50,000 for the purpose of paying for Engineering Services and Contractor Services for the South Main Street Sewer Line Repair Project pursuant to section 6-d of the General Municipal Law. On the table for Board review was: - Letter to Village from Teter & Teter Design Consultants. - Town of Moravia Minutes (12/20/17, 01/24/18, 02/07/18, 02/21/18, 03/07/18). Following the regular meeting, the Board entered into a Budget Work Session. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to enter Executive Session at 9:15 p.m. to discuss personnel.
