1 Village of Fair Haven Public Hearing and Board of Trustees Meeting February 12, 2018 PUBLIC HEARING LOCAL LAWS #1 AND #2 OF 2018: Mayor Basile opened the public hearings at 6:32pm. The Board of Trustees meeting was called to order at 7:00 p.m. followed by the Pledge of Allegiance. Board members present Mayor James Basile, Deputy Mayor Walter Krehling, Trustee Holley Webster- Goolden and Trustee Judith Dunaway. Trustee Pete Hanford was excused. Also, present Village Clerk-Treasurer Terri DiGregorio, Ambulance Supervisor/Zoning Officer Stan and 11 guests. COMMUNICATIONS: • Cayuga County Association of Villages will hold their meeting at 6:30pm on 2/27 at the Cayuga County jail. The speaker will be Captain John Mack and a tour of the jail will be conducted. • In receipt of $42,058.00 from Town of Sterling for ambulance contracts. • In receipt of 9/17 Library Trustee’s meeting minutes. PUBLIC FORUM: • Meredith Barnes appeared to request an extension, for her two residences to connect to the public sewer. She stated she was unaware of the local law to connect to the sewer as she purchased the property in September. She will obtain a copy of the property transfer dye test for submission to the office which will qualify for an extension until May 31, 2018. • June Smith updated the Board on the progress of the West Bay Road Walking Trail. She mentioned if resolutions in support of the community trail were passed by the Sterling Town Board and the Fair Haven Village Board, this may help to obtain grant funds. They have a lot in the works at this time in support of the trail. MINUTES: The minutes from the January 4th 8th and 16th meetings were approved on a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden. All aye, motion carried. ABSTRACT #9 VOUCHERS: The following vouchers were approved for payment on a motion by Trustee Webster-Goolden and seconded by Deputy Mayor Krehling. All aye, motion carried. • General Fund: $39,039.43 • Water Fund: $7,206.62 • Trust & Agency: $3,681.61 • January Payroll: $46,722.40 General Fund Budget Modifications: The following budget modifications were approved on a motion by Trustee Dunaway and seconded by Deputy Mayor Krehling. All aye, motion carried. ❖ Transfer $1,362.92 from contingent to attorney contractual ❖ Transfer $1,799.58 from mortgage tax surplus to attorney contractual ❖ Transfer $2,624.51 from mortgage tax surplus to snow removal contractual ❖ Transfer $222.71 from unclassified revenue surplus to unemployment insurance Water Fund Budget Modifications: The following budget modifications were approved on a motion by Deputy Mayor Krehling and seconded by Trustee Dunaway. All aye, motion carried. ❖ Transfer $515.25 from contingent to transmission & distribution contractual ❖ Transfer $677.98 from transmission & distribution equipment to transmission & distribution contractual ❖ Transfer $39.30 from contingent to unemployment insurance ---PAGE BREAK--- 2 COMMITTEE REPORTS: • The attached January DPW report was submitted by Roger Granatiero. The report was accepted on a motion by Trustee Webster-Gooden and seconded by Deputy Mayor Krehling. All aye, motion carried. The road Work Expense Summary for 2018 was addressed by the Board with the assistance of Town of Sterling Highway Superintendent Brian Soper. A budget of $90,540.07 is planned to address Church St., 4th St., Lake St. Ext., Lansing St., Rail Road Ave., Rail Road Ave., Wildwood Dr. and Camp Rd. These streets will be paved and/or oil stone and sealed. It may be possible to address the end of Cottage St. near the boat ramp if any funds are left over. • The attached Treasurer’s report was submitted by Terri DiGregorio for period ending 01/31/2018. General fund balance $690,069.11 which includes WBB $4,842.41, Water fund $132,792.43, Trust & Agency $9,446.41, $20,001.00 and CDBG $1.00. The report was accepted on a motion by Deputy Mayor Krehling and seconded by Trustee Dunaway. All aye, motion carried. • The attached January Ambulance report was submitted by Stan The report was accepted on a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden. All aye, motion carried. • The attached January Code Enforcement report was submitted by Stan Just under 40 people have not connected to the public sewer. 22 properties have been issued a valid extension to connect by May 31st, 9 properties would not have to connect if Local Law #2 of 2018 is passed, 3 property owners have been served and are scheduled to go to court. On a motion by Deputy Mayor Krehling and Trustee Dunaway, Stan was directed to contact Tim Oleyourryk and Bob Grant to request copies of signed contracts with their contractors reflecting that they will be connected to the public sewer by May 31st. All aye, motion carried. The Code Enforcement report was accepted on a motion by Trustee Webster-Goolden and seconded by Deputy Mayor Krehling. All aye, motion carried. UNFINISHED BUSINESS: • NYSERDA $50,000.00 grant: Quotes for the grant have been received for LED street lights, garage insulation and the purchase of an electric vehicle. The next step is to submit the projects to NYSERDA. NYSERDA has 60 days to approve the three projects. It was noted the electric vehicle will need to have lights and a backup alarm installed. • FEMA: The Board of Trustees was recently informed that Cayuga County qualified for FEMA assistance due to the flooding in 2017. An applicant’s briefing meeting was held at the fire department for Cayuga County on 1/30/18. An exploratory conference call was held 2/9/18 and a second meeting will be taking place possibly next week with FEMA representatives and State representatives. • NYMS Grant: Documents have been signed and submitted on 2/9/18. NEW BUSINESS: • Due to the retirement of Custom Computers, the Village is in the process of obtaining quotes to contract with an IT company to service the computers. One quote has been received and an appointment scheduled for Thursday. • Frank Perkins submitted the Sterling Silver Seniors list of trips for 2018 so the Village can budget accordingly. • Ambulance and Fire Dept. contracts with Town of Wolcott were signed by Mayor Basile and Ambulance Supervisor • On a motion by Deputy Mayor Krehling and a second by, Trustee Dunaway the revised attached Procurement Policy was adopted. All aye, motion carried. • Blair Supply representative John Murphy will be attending the March 8th agenda meeting to discuss the Badger Beacon Mobile AMA Software and meter reader system as the current Orion Connect software for reading the water meters is no longer supported. The Trimble that is used to read the water meters is also no longer supported. The Board is looking at possibly purchasing a new Trimble, tablet or laptop to read meters. • Mayor Basile would like to reactivate the Architectural Review Committee regarding grants. Those members who are still interested are asked to meet on March 1st at the village hall. • Cayuga County Civil Service has requested the Board of Trustee abolish old job titles that are no longer used. Trustee Dunaway will work with Clerk-Treasurer DiGregorio on this. • Geoffrey Hanford was appointed to the Planning Board on a motion by Deputy Mayor Krehling and seconded by Trustee Dunaway. All aye, motion carried. There is still one vacancy on the Planning Board. ---PAGE BREAK--- 3 • Private consultant Amy D’Angelo will be hired to assist the Planning Board with updating the Comprehensive Plan. A maximum of $1,300.00 for 20 hours will be allotted for this project. The funds will be used from the zoning account which has a surplus of funds. This was approved on a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden. All aye, motion carried. • Deputy Mayor Krehling asked for a motion to allow Mayor Basile to attend the New York State Building Officials Conference April 10-16 in Liverpool at a cost to $360.00. This was approved on a motion by Trustee Webster-Goolden and seconded by Trustee Dunaway. All aye, motion carried. • On a motion by Trustee Webster-Goolden and seconded by Trustee Dunaway Clerk-Treasurer DiGregorio will be allowed to attend Advanced Accounting School in Big Flats May 22-24. The fee for the class is $85.00. There will be no hotel costs as she has a place to stay in the area. FINAL COMMENTS: • Jay Sawyer stated he agrees with Local Law but does not agree with Local Law #2 regarding revisions to the sewer law. He believes all properties in the Village should connect to the public sewer. He also stated the life expectancy of a septic system is 25 to 35 years and most of the properties who still have septic would be in that category. Mr. Sawyer went on to state he had spoken with Mark Russo from the NYSDEC who will be looking into the details of the consent order. Mayor Basile reminded Mr. Sawyer that he was not mayor when the previous version of the law was passed but understands there is a hardship for those who are 100 feet or more from the sewer connection. Mayor Basile stated the revision clarifies the law back to what it was believed to have been originally. If the DEC demands all properties in the Village of Fair Haven must comply and connect to the public sewer, the law will be revisited. • Trustee Dunaway stated she is in favor of the law because she remembers discussions regarding connecting to the sewer should not be a hardship for those properties that had great distances to connect. She stated this law is more in line with what was intended. • Zoning Officer stated this should have been clarified years ago and is not in favor of the revision to the sewer law. • Trustee Webster-Goolden supports the law as she believes everyone should connect to the public sewer. • Deputy Mayor Krehling stated he also supports the law. • In conclusion, Mayor Basile stated, dye testing could be made more stringent for those who would fall under the revised law if passed. CLOSE PUBLIC HEARINGS: Mayor Basile closed the public hearings at 9:06pm. Local Law #1 of 2018 was passed on a motion by Deputy Mayor Krehling and seconded by Trustee Webster-Goolden.
