Town of Victory Board Meeting 5/08/17 April minutes Council members present: Others in attendance: Mike Wiggins-Supervisor Deb Davis-Judge Leonard Hand Julia Iozzio-Clerk Lester VanDyke Nancy Sheldon-Deputy Clerk Terrance McBride Bob Day-Code Enforcer Robin Bartholomew Harvey Mills-Planning Board Chris Cramer-Zoning Board Pat Coleman-Highway Hugh Craine Butch Kellogg Meeting called to order. Pledge said at 7pm The board accepted the building vouchers. Lester motioned to accept the vouchers 2nd by Leonard. Minutes were reviewed and accepted. Robin motioned to accept the minutes and 2nd by Lester. Supervisors report ending 03/31/17 was read: General fund: $379,919.34 Cash reserve, CD: $198,612.73 Petty cash: $50.00 Special reserve, Capital Project: $199,027.00 Money market Special reserve: $60,000.00 Total for General fund: $837,609.07 Highway funds: $608,536.87 Victory Street Lighting Dist.: Cash- Checking: $2,843.84 Cash in time Deposits: $3,197.04 Total: $6,040.88 Westbury Street Lighting Dist.: Cash-Checking: $2,069.47 Cash in time Deposits: $ 289.66 Total: $2,359.13 The increase in the General Fund was from the court fees and clerk fees: $12,427.00 ---PAGE BREAK--- Mike ordered the equipment for the playground that had been approved in a previous meeting. The next step is to upgrade with safety zones around the equipment. Wood chips were suggested. The hope is that the highway dept. could do the work. They will be asked. The person that put in the well will be contacted to inquire about putting in the pump in (Upton Rd.) as well as run power. The weather is starting to get nicer for the work to be completed. Nodine Heating did service on the boiler/furnace in the Museum and no issues were found. The new Zoning Law were handed out to each board member. David Nelson was told not to come out until the board had the opportunity to go over the handout. After review of the law the decision will be made as to whether or not a special meeting should be held. The hope is that by the next meeting all should have reviewed the law. There is also a SEQR required, but when he is needed was uncertain. Harvey explained the process after the law was reviewed. At the Supervisors meeting George Wethey attended for the county superintendents. He said that they were repaving roads in Victory Conquest Townline Rd. this year. Cuomo is to sunset the Pave New York program. The program should be in force by 2020. At the same seminar there was a gentleman who came from the comptroller's office, giving the view on “fund balance”. The takeaway was, that every board member should be familiar with the info. Last June a public hearing was held for local law to override the tax cap. The thought was to do the same for this year. We should know by next month (May) if it is necessary. The suggestion was to have the local law written and ready just in case it’s needed. Mike will get in touch with the town’s attorney and ask about the procedure. . The clerk’s report was read: Clerk’s Report: (as of 03/31/2017) 55-Dog licenses =$544.00 13- Garbage Permits =$2,080.00 1- Records copies 10.00 0-Subdivision 00.00 0-Variance =$00.00 2- Building permits =$60.00 0- Marriage Lic. =$00.00 Nancy Sheldon was sworn in as the town clerks deputy. Nancy will be covering for the clerk while she is on vacation and then away at the NYSATC yearly conference. It was stated that Nancy needed to fill out the proper paperwork for the position. The Civil Servants application is said to be needed by both Nancy and Bob Day. ---PAGE BREAK--- Bob handed out a report sheet. He’s checking into some of last years permits to see where they stand. He has issued a few permits. He has taken pictures of the gravel bed on Duck Lake Rd. in order to have some frame of reference/baseline to see if the property gets disturbed from said point on. He was only able to take pictures from the road. He started to do fire permits/inspections that are overdue for the multi occupancies in the area. He’s also followed up on some of the complaints. He’d found that a few just needed to be “asked” to maintain their properties. He attended a code conference last week. He found that there have been new qualifications if one wishes to put in a mobile home. This change has come from the state. Due to the fire codes persons wishing to use party tents must not only get a permit but may require certain equipment. Energy code is also a new concept that now requires homes to have a “blower door test”. The cost could be about $700.00 Any new additions must meet the new energy codes as well. The question was posed if a couple getting married wanted a tent that they would need a permit. There is a size restriction on venues hosting one hundred people or more. Also building homes on floodplains are an issue. If you were to build a home on a floodplain and you happen to flood insurance, for example, it might originally cost you $500.00. The cost could go up to as high as $5000.00 per year for the same policy. It was suggested when residents are applying for a permit, that’s when the floodplains issue should be checked. Mike referred to a letter he’d received regarding distracted drivers from NYMIR. The letter was offering a defensive drivers prevention course. You do get a break on your insurance but only on one driver. The course is $19.95 for the 6hr. course. Bob suggested we get in touch with our insurance company if they or someone they could recommend for a possible representative to come out and offer the class. The other suggestion was to open the class to others as a courtesy. Hugie Craine had a question for the highway dept. regarding the ditch in front of his house in the shoulder of the road. He stated that it had some very deep holes. He wanted to know who was responsible for the repair and if the crew could do something in the immediate? The crew stated that they would go out and take a look at it sometime. Mike got a quote on a volleyball net. It basically took ¾ of the budgeted monies, $1,500 with shipping. Wood Chips have been ordered for the equipment that we have. Rubber chips were suggested but the cost is more but Mike will look into some options. The posts were approximately $700.00 plus the volleyball set up another $700.00 Robin spoke of possibly getting some of the equipment donated to the park. She stated she’d look into it. Mike was offered the suggestion, to help with costs, if wood posts as opposed to metal posts would be less expensive? Mike would look into it. At 7:40 Mike made a motion to go into executive session to discuss a recent update on a pending workers compensation case. Lester 2nd, all ayes. At 7:53 the board returned and Mike motioned to come out of executive session Lester 2nd. All ayes. No decision was reached. With no more business, Leonard motioned to adjourn. Terry 2nd, all ayes. Meeting closed at 7:54.
