VILLAGE BOARD MEETING MAY 9, 2016 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton, and Anthony Peppe (entered 7:04 p.m.) were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Village Attorney Charles Marangola, and Code Enforcement Officer Fred Delaney were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the minutes for the April 25, 2016 Village Board Meeting. · BILLS A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the following bills. (Mayor Mulvaney voting.) (Trustee McGuerty abstained from Bill #421 due to conflict of interest.) (Trustee Peppe entered.) · TRANSFERS A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the following transfers. From: 3120.1 Police Pers. Serv. $2,700.00 To: A1110.4 Justice Cont. $ 250.00 A1420.4 Attorney $ 1,200.00 A1630.4 Office Cont. $ 1,000.00 A1670.4 Central Office Mailing $ 250.00 From: A1990.4 Contingent To: A4540.4 Ambulance $ 3,298.00 From: G1990.4 Contingent To: G8110.4 Sewer Admin. $ 1,000.00 · RESERVE FUND RESOLUTION A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following resolution: RESOLVED, that pursuant to Section 6-c of the General Municipal Law, as amended, this Board of Trustees has hereby established a Capital Reserve Fund to finance the cost of acquisition of a police vehicle. The Village Treasurer is hereby directed to deposit $ 6,000.00 from the 2015/2016 Budget into the Police Vehicle Reserve Fund, which currently has a balance of $ 22,860.91. The Village Treasurer is authorized to invest, from time to time, the moneys of this fund pursuant to Section 6-f of the General Municipal Law. ---PAGE BREAK--- No expenditure shall be made from this fund, except upon authorization of this Board pursuant to Section 6-c of the General Municipal Law. · DEPARTMENT REPORTS A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Treasurers Report for the month of April. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Public Works Report for the month of April. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Water Meter Replacement Report for the month of April. A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of April. A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of April. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Dog Control for the month of April. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Police Report for the month of April. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the written and verbal Code Enforcement Report for the month of April. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of April. It was noted that there was no Justice Report for the month of April. · CABLE Mayor Mulvaney reported that he spoke with Attorney Thomas Blair and that Attorney Blair was continuing to work on the cable agreement with Zito New York, LLC. Attorney Blair would keep the Board updated as time progressed. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that three new water meters were installed in May, to date. · VILLAGE ORDINANCES ---PAGE BREAK--- After some discussion pertaining to the sample laws that the Board received on Open Burning, the Board requested Mayor Mulvaney check with the Moravia Fire Department for their input. Mayor Mulvaney stated he would check and report back to the Board at the next regularly scheduled Board meeting. · WATER LEAK DETECTION UPDATE Mayor Mulvaney reported that he spoke with Mark Manzari from New York Leak Detection (NYLD) and Mr. Manzari had almost completed a map of the Village water lines. Mr. Manzari also stated that he would be making an appointment with Mike Perkins (DPW) to check the repaired water leaks from last year. · ZONING AMENDMENTS (PB) Mayor Mulvaney noted that each of the Trustees received a copy of the Planning Board Minutes from April 18, 2016 pertaining to the zoning amendments. · SOLAR (STP) Village Attorney Charles Marangola had reviewed the Agreement and the Memorandum of Understanding pertaining to the Solarize CNY Initiative for the Wastewater Treatment Plant. He reported to the Board that though there was no financial obligation if the Board chose to sign the agreement and the MOU, that they should be fairly sure that they wanted to move ahead with this project. Mayor Mulvaney reminded the Board that there was no financial obligation at this point and that this was the first step to inquire as to whether this was a feasible project. After some discussion, Village Attorney Charles Marangola stated that he would contact some colleagues for their opinions. This item was tabled until the next regularly scheduled Board meeting. · OAK HILL GRAVEL PIT Mayor Mulvaney stated that there was no news on the Oak Hill Gravel Pit. He also stated that the Decibel signs would be put up by the Cayuga County Highway Department due to their large size, according to Mike Perkins (DPW). · 2016/2017 TAX WARRANT A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to authorize Mayor Mulvaney to sign the Tax Warrant for 2016-2017 for the total of $303,660.56. General Fund $ 290,562.00 Delinquent Water $ 4,793.50 Delinquent Sewer $ 8,305.06 TOTAL $ 303,660.56 · ANNUAL CONTRACTS – VFW, AMERICAN LEGION, FIRE DEPARTMENT A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the annual contracts for the VFW, American Legion, and the Moravia Fire Department for $100.00 each. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to authorize Treasurer Susan Wade to cut checks for the three above annual contracts for $100.00 each. · INFORMATIONAL ITEMS The Village Board of Trustees each received a copy of the following: ---PAGE BREAK--- - CHIPS notification (Balance - $19,835.89). - Town of Moravia Minutes (02/17 & 03/16/2016). - Village of Moravia Planning Board Minutes (04/18/2016). - Cayuga County Association of Villages Agenda for May. On the table for Board review was: - Vehicle Log Sheets for the month of April. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to enter Executive Session at 8:00 p.m. to discuss personnel. (Village Attorney Charles Marangola and Village Clerk Anne Riddell attended.) A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to exit Executive Session at 8:32 p.m. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to make the recommended changes pertaining to a letter to inactive part-time police officers. Trustee Peppe gave a report of the meeting pertaining to the Summer Recreation Program.
