Regular Town Meeting, June 14, 2018 1 Town of Niles TOWN BOARD MEETING June 14, 2018 Niles Town Hall PRESENT: Joan Jayne, Supervisor Steven Cuddeback, Councilman Bernard Juli, Councilman Clarence Edmonds, Councilman Attorney Brody Smith Patty Podolak, Deputy Town Clerk OTHERS PRESENT: Pat Steger, Kelly Anderson, Patrick Doyle and Jim Matijas A. Meeting called to order at 7:00 pm by Supervisor Jayne B. Pledge of Allegiance C. Open floor to the public Mr. Jim Matijas addressed the Board and inquired about the Department of Environmental Conservation meeting that was held at the Town Hall on 6/7/18. Supervisor Jayne said the meeting was about the improvements that the State is doing to Carpenter's Falls. Trails will be improved and made more safe and there will be 40 parking spots put in. Mr. Matijas asked once it's complete what are the Town's responsibilities. Supervisor Jayne explained that the State is responsible for maintenance and provides liability. Our Highway Department will plow the 40 parking spots in the winter so people don't park on the road which will block the plows. D. Approval of Minutes Regular Town Board meeting on 5/10/18 On a motion by Councilman Cuddeback, seconded, by Councilman Juli the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the minutes of May 10, 2018 approved as amended. Motion to approve Abstracts by Fund: RESOLUTION #2018-58 APPROVE ABSTRACT 4 (APRIL BILLS). a. A General Fund $19,050.67 b. DA Highway Fund $71,235.89 c. SR Garbage Fund $11,815.26 e. H1 Water Fund $1,755.00 f. H2 Sewer Fund $2,097.67 On a motion by Councilman Cuddeback, seconded by Councilman Juli the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-58 F. To Comply with recommended County Civil Service Classifications: Supervisor Jayne, Superintendent Steger and Bookkeeper Anderson met with the Director of Civil Service. This classification change will reduce the administrative burden for the Highway Superintendent by making seasonal employees part time employees. RESOLUTION #2018-59 TO COMPLY WITH RECOMMENDED COUNTY CIVIL SERVICE CLASSIFICATIONS a. Abolish 2 Motor Equipment Operator Seasonal Positions b. Create 3 Laborer Part Time Positions On a motion by Supervisor Jayne, seconded by Councilman Juli the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-59 G. Department Reports a. Supervisor's Report: - no comments or questions from the Board b. Code Enforcement Officer's Report: Code Enforcement Officer Doyle briefed the Board on May's activities. Three building permits were issued in May; in-ground pool, single family home and a stand-by generator. Routine inspections were done on ongoing builds and new permits. Updated photos were provided to Attorney Smith for the May 26, 2018 court appearance on Adams case. A meeting was attended with Supervisor Jayne on 6/6/18 concerning the harmful algae blooms and water quality on Skaneateles Lake. Attended the 6/11/18 Board of Appeals meeting. ---PAGE BREAK--- Regular Town Meeting, June 14, 2018 3 c. Highway Superintendant's Report: Superintendent Steger summarized his daily journal which was provided to the Board members. Work is continuing on clearing trees. Work on Mack Road (ditching) is continuing. Four roll offs and two packers and two steel containers were filled on May's clean-up day. Helped Summerhill, Locke and Moravia with various projects - Highway Departments work together. Mowing continues. F-350 was delivered. Mower hit rock in ditch - broke gear casting and bent shaft; being repaired. Roger Slater will be budgeted next year to attend the annual Supervisor's training and conference. Repairs to the Salt Barn are being investigated. Superintendent Steger is getting some quotes from various engineers/contractors. d. Attorney Report: -Attorney Smith stated that after the barn fire in 2012 our insurance company paid the claim and then the insurance company sued several parties that they felt may be responsible for the fire. Attorney Smith's office was queried for information and his office complied with the information request. The outcome is still unknown. -Water & Sewer district - coordinating with the Bookkeeper on payments and financing. Construction is complete. -Adam's matter - arraignment occurred. The property owner pled not quality. Attorney Smith sat down with the defendant and the Odd Fellows separately. He is attempting some way to resolve this without going to trial. -Real Property tax questions - Attorney Smith spoke with the Town Assessor and some citizens on some assessment issues. -There was a question on how Attorney Smith's company bills. There is a $1200 retainer fee which includes all routine Town business. There is additional charges for outside routine Town work (Water & Sewer District and lawsuits for example). e. Town Clerk: The Clerk received shares totaled $952.00 and they have been deposited. f. Dog Control Report: There was four complaints, one lost and found match, two dogs redeemed and one notice to comply wrote. g. Historians Report: The Historian is putting Mabel Crosby books in order and making a complete listing of all the books the Town has. ---PAGE BREAK--- Regular Town Meeting, June 14, 2018 4 h. Assessor's Report: The Assessor sat with the tentative roll available May 8, 10, 12 and 22. Grievance Day was held May 24, 2018; three property owners appeared. Board of Assessment Review changes were entered into the database. There will be an informational meeting on June 20 for the public to announce the reassessment project and to go over the timeline and ask questions. July 1, 2018 the final roll will be posted. August 31, 2018 the school bills will be mailed. Work continues on the 2019 reassessment. RESOLUTION #2018-60 APPROVAL OF SUPERVISOR'S REPORT AND DEPARTMENTAL REPORTS On a motion by Councilman Cuddeback, seconded by Councilman Edmonds, the following resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, to approve the Supervisor's and departmental reports. H. Other Business a. Supervisor Jayne explained to the Board that Patrick Murray has agreed to be an alternate on the Board of Appeals. On a motion by Councilman Cuddeback, seconded by Councilman Edmonds, the following resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli Nays RESOLVED, to approve Patrick Murray to the Board of Appeals as an alternate. b. Supervisor Jayne briefed the Board and the public that Community Day is going to be held on July 22, 2018 from 1-4 pm. She hopes for good attendance. The tent is ordered and music will be provided by Petty Thieves. Attorney Smith is paying for the band. The Clerk's office is sending out invites next week and has advertised in the paper. c. Supervisor Jayne briefed that she has been asked to have the speed limit reduced on Murray Road. Discussion ensued on how that limit reduction would be enforced and if a speed bump could be installed. d. Solar Moratorium - Councilman Juli asked when the moratorium was up. Attorney Smith stated that as far as he knew it was with the Planning Board for comment. He doesn't see any need to extend the moratorium. He advised the Board to make a decision on whether they want a solar law or not. ---PAGE BREAK--- Regular Town Meeting, June 14, 2018 5 J.
