1 Village of Fair Haven Board of Trustees Meeting May 8, 2017 The meeting was called to order following the Pledge of Allegiance at 7:00 p.m. Board members present, Mayor James Basile, Deputy Mayor Walter Krehling, Trustee Holley Webster-Goolden, Trustee Judith Dunaway and Trustee Pete Hanford. Also, present Village Clerk-Treasurer Terri DiGregorio, Deputy Clerk Johanne Van der Linden, Ambulance Supervisor/Zoning Officer Stan and 16 guests. STATE OF EMERGENCY DECLARATION FOR BAYFRONT: On April 25th Mayor Basile declared a State of Emergency until further notice for the bay front area in the Village of Fair Haven due to the rising water level of Little Sodus Bay. An Emergency Order to establish a “No Wake Zone (5mph) in Little Sodus Bay” until further notice was also issued. On May 7th Mayor Basile issued an Emergency Order closing all Village owned boat launches and the West Barrier Bar Park until further notice. These orders are issued every Monday and sent to the Cayuga County Clerk’s office for recording. Many volunteers filled sand bags and helped to build sand bag levies. The Emergency Management office held a satellite office at the Village Hall. COMMUNICATIONS: • Three trees have been planted on Main Street replacing the diseased trees. A total of 6 trees will be purchased and planted on Main Street under the $1,000.00 NYS Forestry Tree Grant awarded to the Village. The Village did add some additional funds to purchase the sixth tree. • Attorney Norman Chirco was interviewed by Board of Trustees at the agenda meeting. He is the second attorney interviewed. • The Board reviewed and approved the Village of Fair Haven newsletter to be mailed out to residents. • Village of Red Creek has invited the Village of Fair Haven Board of Trustees to attend their Wayne County Association meeting at Colloca Estate Winery on May 17th. The topic of discussion is county wide shared services plan. Trustees Webster-Goolden and Hanford will be attending. • In receipt of quarterly sales tax from Cayuga County $102,537.44 which is around $5,000.00 more than anticipated. • In receipt of announcement from the NYSDOT regarding CHIPS highway aid to improve village streets. Aid from three different programs for a total of $70,540.07 is available. • In receipt of March CCAV meeting minutes with the next meeting scheduled on May 23rd hosted by the Village of Aurora. • In receipt of April 12th library Trustee’s meeting minutes. • The Board of Trustees end year meeting will be held on May 30th 6:30pm. PUBLIC FORUM: • Public complaints were received regarding a police boat on the bay exceeding the 5mph no wake speed limit as a state of emergency due to the extreme high water had been declared. • Chamber of Commerce representative, Anita Hadcock, asked permission from the Board of Trustees to close South Richmond St. from 11am to 2pm for scooter races and to hold traffic on Main St. for the fairy parade for the Mayfest celebration Saturday May 20th. She also inquired about a location to hold the junk in your trunk sale and was advised to use the parking lot off Belle Ave. Permission was granted by the Board. • The Mayor and Village Board was commended on the sandbagging operation. Guests brought up a discussion on the rising level of Lake Ontario and how much of it is due to the International Joint Commission plan for 2014. It has been said that the high level of Lake Ontario is also due to the heavy snow melt and excessive spring rains. Meeting guests inquired about how the south shore communities on Lake Ontario could get together to discuss the plan with state and federal officials. Worries about the economy of the area were brought up. Mayor Basile stated the community threshold is $285,000.00 to qualify for FEMA. MINUTES: The April 10th and 26th minutes were approved and the April 6th minutes were amended and approved on a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden. All aye, motion carried. ABSTRACT #12 VOUCHERS: Payment of the following vouchers were approved on a motion by Deputy Mayor Krehling and seconded by Trustee Hanford. All aye, motion carried. • General Fund: $28,558.53 • Water Fund: $7,142.95 • Trust & Agency: $3,149.64 • April Payroll: $33,389.93 Budget modifications will be approved at the end year meeting on May 30th. ---PAGE BREAK--- 2 COMMITTEE REPORTS: The following attached reports were accepted on a motion by Trustee Dunaway and seconded by Trustee Hanford. All aye, motion carried • April DPW report submitted by Roger Granatiero. • Treasurer’s report submitted by Terri DiGregorio for period ending 04/30/2017. • April Ambulance report submitted by Stan • April Code Enforcement report submitted by Stan UNFINISHED BUSINESS: • The Vehicles & Traffic Article IV Parking Prohibitions amendment along with the revisions for the sewer law regarding 100 feet will be addressed when a village attorney is hired. • meetings will be set up to review the Comprehensive Plan with the Planning Board and Community Development Committee. • The Board is still considering candidates for the Zoning Board of Appeals as one position remains open • The signed stamped documents to amend the pubic officers law, in relation to residency requirements for clerk-treasurer or deputy clerk were sent to the New York State Assembly and Senate on a motion by Deputy Mayor Krehling and seconded by Trustee Webster- Goolden. All aye, motion carried. NEW BUSINESS: • Fair Haven Fire Department officials will attend the June 8th agenda meeting. • On a motion by Deputy Mayor Krehling and a second by Trustee Dunaway permission was granted for Clerk-Treasurer DiGregorio to attend accounting school October 17th – 19th and for Deputy Clerk Van Der Linden to attend accounting school November 14th – 16th. All aye, motion carried. • Mayor Basile will contact the CCWSA to obtain their past minutes for the village website. He plans to discuss a representative from the north end of the county to be appointed to their Board of Directors. • Water customer account A2160 requested relief from a large water bill totaling $445.09 due to the outside water faucet being turned on when he was not there. $100.00 has recently been paid on the account. On a motion by Trustee Dunaway and seconded by Deputy Mayor Krehling, the Board agreed to waive the late fee and ask the homeowner to sign a payment agreement. All aye, motion carried. • A request for a 1” water line was approved for Mark Podlesh of West Bay Road on 7/13/2015. He is now requesting a start date for the water line be installed but would like a 2” line. This will be addressed at a later date when Mr. Podlesh can explain why he has changed his request. FINAL COMMENTS: • Rick Shambo stated he recently made expensive improvements to Screwy Louie’s on Main Street and expressed needing more time to connect to the public sewer. He reminded the Board of Trustees, in 2009 the residents were told in a public meeting, they didn’t have to connect until their systems failed. Mr. Shambo also pointed out the sewer law is awaiting revisions as the intent of the law was to reflect homeowners didn’t have to connect if their residence was 100 feet or more from the sewer line. On a motion by Deputy Mayor Krehling and a second by Trustee Hanford the business known as Screwy Loui’s at 596 Main Street was granted an extension until October 1, 2018 according to the connection schedule set forth in the sewer law for Grant’s Vacation Park. Also noted, if at any time the system fails, or if the property is sold, this agreement is void and connection to the public sewer would have to be made at that time. All aye, motion carried. • The property at 14492 Lake Street was brought up as the building has fallen down and is unsafe. It was noted, caution tape and barriers are in place to warn the public. Stan talked to the owner’s insurance company and advised to fence it in or tear it down. They are still waiting for test results regarding asbestos. It was supposedly to come down this week. Stan will speak to the owner again. The Board of Trustees entered into executive session to discuss matters leading to the appointment of a particular person and discipline of a particular person on a motion by Trustee Webster-Goolden and seconded by Trustee Dunaway. All aye, motion carried. The Board of Trustees exited executive session on a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden. All aye, motion carried. During executive session there were no decisions. ADJOURNMENT: The meeting was adjourned at 9:00 p.m. on a motion by Trustee Webster-Goolden and seconded by Trustee Dunaway. All aye, motion carried.
