VILLAGE BOARD MEETING JANUARY 23, 2017 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Gary Fickeisen, Tony Peppe, Nancy McGuerty, and Chris Fulton were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Village Attorney Charles Marangola, Officer in Charge Rob Brown, and Village Planning Board Chairperson Paul Nelson (entered 7:05 p.m.) were also in attendance. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the minutes for the January 9, 2017 Village Board Meeting, as amended. · BILLS A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained on Bill #144 due to conflict of interest.) · DEPARTMENT REPORT A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Report for the month of December. · CABLE Mayor Mulvaney explained that the public hearing for the Cable Franchise Agreement with Zito New York, LLC was not published in the Republican Register as presumed. He further explained that the public hearing needed to be held again. A motion was made to approve: WHEREAS, the Board of Trustees of the Village of Moravia, New York, hereby acknowledges that the public notice for the public hearing held on January 9, 2017 to take public comment and to give due consideration for the proposed Cable Franchise Agreement between Zito New York LLC and the Village of Moravia was not publicized in the Village of Moravia’s official newspaper. NOW THEREFORE, BE IT RESOLVED that the Board of Trustees of the Village of Moravia, New York, hereby approves to publish and hold a public hearing either on February 13, 2017 or February 27, 2017 at approximately 7:00 p.m. per the outcome of Zito New York, LLC’s response, for the purpose of taking public comment on, and giving due consideration for the proposed Cable Franchise Agreement between Zito New York, LLC and the Village of Moravia, concerning the provision of cable and other services to the Village. Village of Moravia Mayor Gary Mulvaney YES Trustee Anthony Peppe YES Trustee Gary Fickeisen YES Trustee Nancy McGuerty YES Trustee Chris Fulton YES · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW WATER METER REPLACEMENT Mayor Mulvaney reported that a couple of new water meters had been installed due to either being broken or a new service. · VILLAGE ORDINANCES Mayor Mulvaney stated that the Board would start reviewing more of the Village Ordinances after the Board had reviewed the Site Plan Review with Village Attorney Charles Marangola. · ZONING AMENDMENTS (PLANNING BOARD) Each of the Trustees received a copy of the changes/deletions to the Site Plan Review Draft from Village Attorney Charles Marangola at a previous meeting. Village Attorney Charles Marangola addressed the Board pertaining to the changes/deletions he recommended for the drafted Site Plan Review. After his explanation, the Board approved of his recommendations. Village Attorney Charles Marangola will meet with Village Planning Board Chairperson Paul Nelson in the near future to make the changes as noted. (Mr. Nelson will receive a copy of recommended changes.) This item was tabled until the next regularly scheduled Board meeting. (Village Planning Board Chairperson Paul Nelson exited at 7:27 p.m.) · SOLAR POWER GRANT (WWTP) ---PAGE BREAK--- The Board received a copy of an email from Chris Carrick updating the Village on the SolarizeCNY solar procurement process for the Sewer Treatment Plant. The email stated that they had received twelve (12) proposals that were being considered. This item was tabled until the next regularly scheduled Board meeting. · MEMORANDUM OF UNDERSTANDING (CC 911 CENTER) Village Attorney Charles Marangola addressed the Board pertaining to the Memorandum of Understanding that was received from the Cayuga County 911 Center. Attorney Marangola stated that he still believed that agreeing and signing of the MOU was not a good idea for the Village. He maintained that it would put the Village at risk, as the liability would fall back on the Village and not on the Cayuga County Sheriff’s Department. Officer in Charge Rob Brown reiterated his concern for the surrounding areas that did not have immediate police presence and concern for fellow police officers in need of assistance. Attorney Marangola stated that he understood, however, the police coverage for Cayuga County is the County’s responsibility and not the Village’s responsibility. Attorney Marangola reminded the Board that they were Village Trustees and therefore their first concern is for the Village residents. After much discussion, Mayor Mulvaney stated that he would call the Cayuga County Legislature and send a letter addressing the Board’s concerns for more police coverage from the Cayuga County Sheriff’s Department in the southern end of Cayuga County. Mayor Mulvaney also stated he would contact the surrounding municipalities to discuss this issue with them. This item was tabled until the next regularly scheduled Board meeting. · POLICE POLICIES Village Attorney Charles Marangola had received several drafted police policies from Officer in Charge Rob Brown. After some discussion, Attorney Marangola and Officer in Charge Rob Brown agreed to review the policies that were being requested by the Village’s insurance company and report back to the Board. This item was tabled until the next regularly scheduled Board meeting. · RENTAL PERMIT LOCAL LAW #5 OF 1990 REVIEW Mayor Mulvaney stated that there was no update on the Rental Permit Local Law #5 of 1990 Review. This item was tabled until the next regularly scheduled Board meeting. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - Letter from the Village to Zito New York, LLC (re: legal reimbursement). - Letter to Village from two Code Enforcement Officers. - Village of Moravia Planning Board Minutes (12/19/16). - Village’s Water/Sewer synopsis for 2016 prepared by Village Treasurer Susan Wade. (Mayor Mulvaney stated that with a 48% loss of water in 2016, he had contacted New York Leak Detection and requested they assist the Village in solving this large of a water loss.) - Cayuga County Water & Sewer Authority Water/Sewer Survey completed by Mayor Mulvaney. (Mayor Mulvaney reported on a recent meeting he attended pertaining to the grant the County received for water and wastewater planning.) - Email from Cayuga County Health Department (re: meeting – Montville Water). ---PAGE BREAK--- Senator Seward 2017 Highlights were on the table for Board review.
