VILLAGE BOARD MEETING JULY 24, 2017 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton, and Anthony Peppe were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Kean and Sean Cochran (WWTP), Village Attorney Charles Marangola (entered at 7:08 p.m. / exited at 8:06 p.m.) and Kari Terwilliger (Cayuga County Planning Department) were also present. · PUBLIC Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the minutes for the July 10, 2017 Village Board meeting. · BILLS A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the following bills. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that no new water meters were installed. · VILLAGE ORDINANCES This item was tabled until the next regularly scheduled Board meeting due to several open projects that the Board is currently working on. · ZONING AMENDMENTS (PB) – SITE PLAN REVIEW Each of the Trustees received a copy of the Final Determination from the Cayuga County GML 239-l, m & n Review Committee pertaining to the proposed Local Law #3 of 2017, Site Plan Review. The report stated that the committee “recommends approving the proposed action without change.” The Committee also recommended the Village to consider requiring the submission and review of Stormwater Pollution Prevent Plans due to the recent flood events. Village Attorney Charles Marangola stated that he would contact the County and update the Board at the next regularly scheduled Board meeting. · NYSERDA GRANT (SOLAR PERMIT PROCESS) Kari Terwilliger (Cayuga County Planning Department) addressed the Board and distributed a resolution and a disclosure pertaining to a Solar Permit Process for the Village. She explained that if the Board approved of both, the Village would receive a $2,500.00 grant that could be used towards updating the Village’s Comprehensive Plan. ---PAGE BREAK--- A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 5-0 vote to approve the following resolution and to authorize Mayor Mulvaney to sign the disclosure. WHEREAS, the New York State Energy Research and Development Authority (NYSERDA) is offering financial incentives to municipalities that adopt a uniform New York State solar permit process, and WHEREAS, the Village of Moravia Code Enforcement Officer has advised the Village Board of Trustees that the New York State uniform process is consistent and compatible with the Village of Moravia Zoning Code and permitting practices, and WHEREAS, the Village Board of Trustees supports the use of solar energy as a renewable energy source; now therefore, be it RESOLVED by the Village Board of Trustees of the Village of Moravia that the Village of Moravia hereby fully and formally adopts the New York State Unified Solar Permit process for NY – Sun Solar Powering New York, and establishes the permit fee at $75. Upon Roll Call Vote: Mayor Gary Mulvaney Voting YES Trustee Anthony Peppe Voting YES Trustee Gary Fickeisen Voting YES Trustee Nancy McGuerty Voting YES Trustee Chris Fulton Voting YES · SOLAR POWER GRANT (STP) Each of the Trustees received a letter at the last meeting pertaining to the SolarizeCNY Municipal Solar Project from the Central New York Regional Planning and Development Board. After some discussion between the Board and Village Attorney Charles Marangola, the Board decided not to pursue this grant at this time. (It was noted that there could be issues with this project and the Village’s Zoning Law.) The Board directed Village Clerk Anne Riddell to send a letter to Chris Carrick of the CNY Region Planning and Development Board to this effect and thank him. · POLICE POLICIES Mayor Mulvaney reported that there was no news on the drafted police policies. This item was tabled until the next regularly scheduled Board meeting. · MEMORANDUM OF UNDERSTANDING (MEDICAL DROP – MPD) Mayor Mulvaney reported that Officer In Charge Robert Brown was unable to attend tonight’s meeting to discuss the Memorandum of Understanding. This item was tabled until the next regularly scheduled Board meeting. · EMPLOYMENT APPLICATIONS (POWERS & FENNER) ---PAGE BREAK--- Applications for employment for Laborer from Dawn Powers and Steven Fenner were on the table for Board review. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to accept and place on file the employment applications from Dawn Powers and Steven Fenner. · SEWER BREAK AND FLOODING Sean Cochran and Kean of the Village’s Wastewater Treatment Plant spoke to the Board about the South Main Street sewer pipe collapse (preventative maintenance) and the newer North Main Street sewer “break”. (It was noted that the North Main Street break was due to the several recent floods.) They recommended hiring an engineer to assist them with specifications for both of these repairs. Sean Cochran also stated that not much could be done on the North Main Street break until the culvert is repaired. However, he stated that they have plugged the pipe and Spaulding will be pumping the manhole on a regular basis until the repair is made. He also stated that only one property is affected by the break. The Board agreed to hire an engineer to assist with these two projects. There was also some discussion pertaining to industrial waste going through the Wastewater Treatment Plant facility that is causing some issues. The Board directed the Village Clerk to send registered letters to the Cayuga Correctional Facility, Owasco Meats, and Hillcrest Dairy stating the problems and sending a copy of the Village’s Sewer Law. Sean Cochran also distributed a Report of Noncompliance Event that was sent to Matthew Russo, of the NYSDEC. The Board then discussed the recent floods. · WASTEWATER TREATMENT PLANT TRUCK Mayor Mulvaney reported that the Village Office received a $2,300 estimate from Webster’s Garage for repairs that are needed on the Wastewater Treatment Plant Truck. He also had a quote from Trucks & Stuff for a 2005 truck for $15,000. The Board agreed to keep looking for a used truck. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the CHIPS notification. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to adjourn at 8:58 p.m. Anne Riddell, Village Clerk
