SPECIAL MEETING TOWN BOARD OF GENOA JUNE 12, 2017 A special meeting of the Town Board of Genoa, Cayuga County, State of New York was held at the Town Hall, 1000 Bartnick Road, Genoa NY on June 12, 2017 Present Lorie Sellen-Gross, Supervisor Cheryl Shields, Board Member (absent) Don Slocum, Board Member Brandon White, Board Member Al Board Member Sue Moss, Clerk The Special Board meeting was called to order at 7 p.m. by Supervisor Lorie Sellen-Gross with the Pledge of Allegiance to the Flag. Lorie informed the Board that Resolution 55-2017 was approved on June 10, 2017 at a Special Board meeting. She went over the steps for this meeting as outlined by the Town Attorney. The Town conducted a State Environmental Quality Review Act (SEQRA) review. The Town has already determined it will be the lead agency and sent out the required notices of intent. All involved agencies have replied and concurred in the Town's role as lead agency under SEQRA. Part I - Project and Setting - The Town Board and each Board Member has had and fully reviewed the Part 1, and that all advice from the Town’s consultants has been duly reviewed. RESOLUTION 59-2017 APPROVE SUPERVISOR'S SIGNATURE VERIFYING ALL INFORMATION INCLUDED IN PART I IS TRUE TO THE BEST OF HER KNOWLEDGE On a motion of, Board member Slocum seconded by Board member White, the following resolution was ADOPTED Ayes 4 Sellen-Gross, Slocum, White, Nays 0 Part 2 - Identification of Potential Project Impacts - The 18 impact questions were read and the answers were recited by Councilperson White. The Town Board, in considering such factors, did not believe that any minor or minor potential impacts would be or be likely to become a moderate or significant impact such that a negative declaration will be issued. Part 3 - Evaluation of the Magnitude and Importance of Project Impacts and Determination of Significance While there are some minor impacts, the fact is that these all remain minor and are all mitigated due to: the fact that construction impacts are temporary, and construction and other impacts are further mitigated by permitting processes and storm water management processes during ---PAGE BREAK--- SPECIAL TOWN BOARD MEETING June 12, 2017 Page 2 construction; (ii) that much of the project is replacement and upgrades in place where existing infrastructure and improvements are already located; (ii) that much of the work is to occur in already disturbed areas or, more significantly, along and within highway rights-of-way; and (iv) that the project will in actuality have a net positive impact on the environment, including by protecting and helping preserve aquifers and groundwater and enhancing public health. RESOLUTION 60-2017 SUPPORT OF THE NEGATIVE DECLARATION OF PART 3 On a motion of Councilperson White, seconded by Board member Slocum, the following resolution was ADOPTED Ayes 4 Sellen-Gross, Slocum, White, Nays 0 Roll Call: Brandon White - aye Don Slocum - aye Lorie Sellen-Gross - aye Al - aye Resolved that the support of the negative declaration of Part 3 be approved BE IT RESOLVED by the Town Board of the Town of Genoa, Cayuga County, as follows: Section 1. It is hereby determined that the Board adopting this resolution has declared itself to be the lead agency under the State Environmental Quality Review Act (“SEQRA”) and the regulations promulgated there under for purposes of determining the environmental impact of the project described in Section 3 hereof, and completed all requisite requirements in connection therewith, including completion of a coordinated review to the extent required by law.. Section 2. It is hereby determined that the project described in Section 3 hereof is a Type I Action which, it has been determined will not have any significant adverse impact upon the environment. Section 3. The project which is the subject of this resolution is described as follows: Several capital improvement projects to update and protect the existing ground water wells, to provide for treatment upgrades, to provide for metering and pump station upgrades, to upgrade electrical systems and distribution telemetry and efficiencies, to make infrastructure reconstruction and upgrades, and replace obsolete equipment and parts nearing or past the end of their useful life, and to upgrade water lines and install hydrants along SR 90, including original furnishings, equipment, machinery, apparatus, appurtenances and incidental improvements and expenses in connection therewith at a maximum estimated cost of $1,782,041. Section 4. This resolution shall take effect immediately. RESOLUTION 61-2017 MOTION DIRECTING TOWN CLERK TO ASSURE FILING AND POSTING OF A PUBLIC NOTICE IN TIME FOR A PUBLIC HEARING ON WATER DISTRICT CAPITAL IMPROVEMENT PROJECT TO BE HELD ON JUNE 23, 2017 AT 8 AM AT GENOA TOWN HALL ---PAGE BREAK--- SPECIAL TOWN BOARD MEETING June 12, 2017 Page 3 WHEREAS, the Town Board of the Town of Genoa, Cayuga County, New York, has caused to be prepared a map, plan and report, including an estimate of cost, pursuant to Section 202-b of the Town Law, relating to the increase and improvement of the facilities of the Genoa-King Ferry Water District, in the Town of Genoa, Cayuga County, New York (the “Genoa-King Ferry Water District”), consisting of several capital improvement projects to update and protect the existing ground water wells, to provide for treatment upgrades, to provide for metering and pump station upgrades, to upgrade electrical systems and distribution telemetry and efficiencies, to make infrastructure reconstruction and upgrades, and replace obsolete equipment and parts nearing or past the end of their useful life, and to upgrade water lines and install hydrants along SR 90, including original furnishings, equipment, machinery, apparatus, appurtenances and incidental improvements and expenses in connection therewith at a maximum estimated cost of $1,782,041; WHEREAS, said project has been determined to be a “Type I Action” pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act (“SEQRA”), the implementation of which as proposed, it has been determined will not result in any significant adverse environmental effect; and WHEREAS, it is now desired to call a public hearing on the question of the increase and improvement of the facilities of said Genoa-King Ferry Water District, in the matter described above, and to hear all persons interested in the subject thereof, concerning the same, in accordance with the provisions of Section 202-b of the Town Law; NOW, THEREFORE, IT IS HEREBY ORDERED, by the Town Board of the Town of Genoa, Cayuga County, New York, as follows: Section 1. A public hearing will be held in the Town Hall, 1000 Bartnick Road, Genoa, New York, in said Town, on June 23, 2017, at 8:00 o'clock A.M., Prevailing Time, on the question of the increase and improvement of the facilities of the Genoa-King Ferry Water District, in the Town of Genoa, Cayuga County, New York, in the manner described in the preambles hereof, and to hear all persons interested in the subject thereof, concerning the same, and to take such action thereon as is required or authorized by law. Section 2. The Town Clerk is hereby authorized and directed to cause a copy of the Notice of Public Hearing hereinafter provided to be published once in the official newspaper, and also to cause a copy thereof to be posted on the sign board of the Town, such publication and posting to be made not less than ten, nor more than twenty, days before the date designated for the hearing. Section 3. The notice of public hearing shall be in substantially the form attached hereto as Exhibit A and hereby made a part hereof. Section 4. This Order shall take effect immediately. Moss, Town Clerk ---PAGE BREAK--- SPECIAL TOWN BOARD MEETING June 12, 2017 Page 5 EXHIBIT A NOTICE TO TOWN OF GENOA RESIDENTS OF PUBLIC HEARING UPON PROPOSED GENOA KING FERRY WATER DISTRICT IMPROVEMENT PROJECT UNDER TOWN LAW § 202-b Please take notice that a public hearing will be held upon June 23, 2017, at 8:00 am, at the Genoa Town Hall, 1000 Bartnick Road, Genoa, New York 13071, for the purpose of receiving public comment upon the proposed Genoa-King Ferry Water District Improvement Project, consisting a capital improvement project to upgrade existing groundwater wells, to provide for treatment, metering and pump station, and electrical systems and distribution upgrades, to replace obsolete equipment and parts nearing or past the end of their useful life, and to upgrade water lines and install hydrants along SR 90, including original furnishings, equipment, machinery, appliances, appurtenances and incidental items and expenses therefor, all pursuant to a Map, Plan and Report from Hunt Engineering dated July 2016, revised March 2017, which calculates a total project cost of $1,782,041. No land will be acquired for the project, but rights to use land and some easements or permits will be needed along SR 90 for hydrant installation and for relocation of two private septic systems to meet recommended wellhead setbacks. At the time and place of such hearing the Town Board will take statements, testimony, and evidence from all persons interested in the subject hereof and concerning the same, and the Town Board may or will take such other action thereupon as is required or permitted by law.
