SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-1 August 2013 SECTION 3: PLANNING PROCESS INTRODUCTION This section includes a description of the planning process used to develop the Cayuga County Multi- Jurisdictional All-Hazard Mitigation Plan, including how it was prepared, who was involved in the process, and how the public was involved. To ensure that the Plan met the requirements of the DMA 2000, an approach to the planning process and plan documentation was developed to achieve the following two goals: 1. The Plan will be multi-jurisdictional and consider natural hazards facing Cayuga County, thereby satisfying the natural hazards mitigation planning requirements specified in DMA 2000. Cayuga County invited all municipalities in Cayuga County to join with them in the preparation of a Cayuga County Multi-Jurisdictional All-Hazard Mitigation Plan. Cayuga County and all its municipalities (with the exception of the Town of Cato) are participating in the Plan as indicated in Table 3-1 below. Table 3-1. The Cayuga County Multi-Jurisdictional All-Hazard Mitigation Plan (HMP) was written using the best available information obtained from a wide variety of sources. Throughout Plan development, a concerted effort was made to gather information from municipal and regional agencies and staff as well as stakeholders, federal and state agencies, and the residents of Cayuga County. The HMP Planning Committee solicited information from local agencies and individuals with specific knowledge of certain natural hazards and past historical events. In addition, the Committee took into consideration planning and zoning codes, ordinances, and other recent planning decisions. The hazard mitigation strategies identified in this Plan have been developed through an extensive planning process involving local, county and regional agencies, County residents, and stakeholders. ---PAGE BREAK--- SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-2 August 2013 2. The Plan was developed following the process outlined by DMA 2000, FEMA regulations, and FEMA and NYSOEM guidance. Cayuga County elected to follow this process to ensure that the plan would be developed to meet all the requirements to support Plan review. This section of the Plan describes the mitigation planning process, including Preparing to Plan; Planning Partnership – Organization and Activity; Stakeholder and Public Outreach and Involvement; Coordination with Existing Mitigation Efforts and Programs; Integration of Existing Data, Plans, and Information; and Continued Public and Stakeholder Involvement. HAZARD MITIGATION IN CAYUGA COUNTY – PREPARING TO PLAN Many parties supported preparation of this plan, including the Steering Committee, Planning Committee, and other stakeholders. This planning process does not represent the start of hazard risk management in Cayuga County; rather it is part of an ongoing process that various State, County and local agencies, and individuals have continued to embrace.  Various regional, county and local agencies and governments have been involved in natural hazard risk assessment, mitigation planning and project activities, prior to and/or unrelated to the current planning effort. Such activities provide a strong foundation for subsequent efforts, and an awareness and understanding of the need for and benefits of mitigation planning across a broad range of regional, county and local governments and stakeholders. Several examples of such activities are presented here.  All jurisdictions in Cayuga County participate in the National Flood Insurance Program, and manage their floodplains according to the requirements of participation in that program. PLANNING PARTNERSHIP - ORGANIZATION AND ACTIVITY This section of the Plan identifies how the planning process was organized with the many “planning partners” involved, and outlines the major activities that were conducted in the development of this Plan. Organization of Planning Partnership Recognizing the need to manage natural risk within Cayuga County, and to meet the requirements of the DMA 2000, the Cayuga County Legislature assigned the Cayuga County Emergency Management Department with the responsibilities of managing a natural hazards mitigation plan project. On November 10, 2011 FEMA notified NYSOEM that Cayuga County’s application for a planning grant to create a county-wide Multi-Jurisdictional All-Hazard Mitigation Plan under FEMA’s Hazard Mitigation Grant Program (HMGP 1857) was approved. On May 1, 2012 the Cayuga County Legislature signed the State of NY Multi-Year Funding Agreement for the grant funding. Through an open bid process, Cayuga County selected a contract planning consultant (Tetra Tech Inc. –Morris Plains, NJ). A contract between Tetra Tech Inc. (Tetra Tech) and Cayuga County was executed on July 18, 2012. Specifically Tetra Tech, the “contract consultant,” was tasked with:  Working with Cayuga County’s Hazard Mitigation Committee and their partners to identify mitigation actions (Projects) for which Cayuga County and partners may seek grant funding,  Recommending actions to ensure County and participating partners are in good standing and demonstrate continued compliance with National Flood Insurance Program (NFIP) regulations, including local floodplain ordinances and permitting requirements, and ---PAGE BREAK--- SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-3 August 2013  Preparing a FEMA approved All-Hazards Mitigation Plan for Cayuga County. In support of these tasks, the consultant scope included:  Assistance with the development and implementation of a public and stakeholder outreach program  Data collection  Facilitation and attendance at meetings (Planning committee, stakeholder, public and other)  Outreach to other various outside groups, facilities, and agencies as outlined in Cayuga County’s original Request for Proposals for information vital to risk identification and mitigation strategies  Review of hazards of concern, and preparation of hazard profiling and risk assessment  Assistance with the development of mitigation planning goals and objectives  Assistance with the prioritization of mitigation actions  Authoring of the Draft and Final Plan documents To facilitate plan development, with support from their contract consultant, Cayuga County developed a Steering Committee to provide guidance and direction to the planning effort, and to ensure the resulting document will be embraced both politically and by the constituency within the planning area. The Steering Committee was charged with:  Providing guidance and oversight of the planning process on behalf of the general planning partnership;  Attending and participating in Steering Committee meetings;  Assisting with the development and completion of certain planning elements, including: o Identification of “Hazards of Concern,” o Public and Stakeholder Outreach, o Mitigation Planning Goals and Objectives, o Identification and screening of appropriate mitigation strategies and activities; and  Reviewing and commenting on plan documents prior to submission to NYSOEM and FEMA. The Steering Committee provided guidance and leadership, oversight of the planning process, and acted as the point of contact for all participating jurisdictions and the various interest groups in the planning area. The makeup of this committee was selected to provide the best possible cross section of views to enhance the planning effort and to help build support for hazard mitigation. Prior to the general project Kick-off meeting, a more limited working group was assembled to initiate the planning process and assist with overall project administration, including the formation of the full Steering Committee. This group included the co-chairs as well as county representatives from the Cayuga County Department of Planning and Economic Development and Office of Emergency Management. The Steering Committee was comprised of appropriate municipal personnel, local emergency first responders, and other stakeholders to effectively guide the overall process, provide significant input, and partner with Tetra Tech to develop a FEMA-approved Plan. On August 16, 2012, the Steering Committee met for the first time and continued to meet throughout the year. Municipalities were provided with a copy of the Planning Partner Expectations and asked to formally notify Cayuga County of their intent to participate (via a Letter of Intent) and to identify a planning point of contact to serve on a Planning Committee and represent the interests of their respective community. A Planning Committee was assembled to represent each of the municipalities participating in the Plan, consisting of all members of the Steering Committee, and at least one representative from each of the participating municipalities. Each municipality received a copy of the “Planning Partner Expectations” which outlined the responsibilities of the participants and the agreement of the partners to authorize the Steering Committee to represent the jurisdiction in the completion of certain planning elements as noted above. The Planning Committee was charged with the following:  Represent their jurisdiction throughout the planning process  Establish Plan development goals ---PAGE BREAK--- SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-5 August 2013  Establish a timeline for completion of the Plan  Ensure that the Plan meets the requirements of DMA 2000 and FEMA and NYSOEM guidance;  Solicit and encourage the participation of regional agencies, a range of stakeholders, and citizens in the Plan development process  Assist in gathering information for inclusion in the Plan, including the use of previously developed reports and data  Organize and oversee the public involvement process  Identify, develop and prioritize appropriate mitigation initiatives.  Review, amend, and approve all sections of the Plan  Develop and author the jurisdictional annex for their jurisdiction  Develop, revise, adopt, and maintain the Plan It is noted that the Letter of Intent to Participate identifies the above “Planning Partner Expectations” as serving to identify those activities comprising overall participation by jurisdictions throughout the planning process. It is recognized that the jurisdictions in Cayuga County have differing levels of capabilities and resources available to apply to the planning process, and further, have differing exposure and vulnerability to the natural hazard risks being considered in this Plan. It was Cayuga County’s intent to encourage participation by all inclusive jurisdictions, and to accommodate their specific needs and limitations while still meeting the intents and purpose of Plan participation. Such accommodations have included the establishment of a Steering Committee, engaging a contract consultant to assume certain elements of the Planning process on behalf of the jurisdictions, and the provision of additional and alternative mechanisms to meet the purposes and intent of mitigation planning. Ultimately, jurisdictional participation is evidenced by a completed annex of the Plan wherein jurisdictions have individually identified their planning points of contact, evaluated their risk to the hazards of concern, identified their capabilities to effect mitigation in their community, and identified and prioritized an appropriate suite of mitigation initiatives, actions, and projects to mitigate their natural hazard risk; and eventually, by the adoption of the Plan via resolution. Extensive outreach efforts by the Cayuga County Planning Department resulted in nearly perfect participation by stakeholders and Cayuga County municipalities. Planning Department leads effectively engaged city, town, and village staff members and other representatives from 32 of the 33 Cayuga County municipalities, ensuring a complete understanding of the process and the goals of the mitigation plan. Table 3-3 shows the current municipal members of the Planning Committee, at the time of this Plan’s publication. Please note that while Steering Committee members are also part of the overall project Planning Committee, the list below only identifies those Planning Committee members representing participating municipalities. This summary table identifies only the formal meetings held during plan development, and does not reflect the larger universe of planning activities conducted by individuals and groups throughout the planning process. In addition to these meetings, there was a great deal of communication between Planning Committee members through electronic mail (email) and by phone. After completion of the Plan, implementation and ongoing maintenance will become a function of the Planning Committee. The Planning Committee is responsible for reviewing the Plan and accepting public comment as part of an annual review and as part of the five year mitigation plan update. Table 3-4 presents a summary of key milestones and planning partnership efforts implemented during the development process for this Plan. This table also identifies which DMA 2000 requirements the activities satisfy. Table 3-4. All participants were encouraged to attend the Kick-off Meeting and Jurisdictional Annex Workshop. During the planning process, the consultant contacted each participant to offer support, explain the process, and to facilitate the submittal and review of critical documents. Diligent efforts were made to assure broad regional, county, and local representation in this planning process. To that end, a comprehensive list of stakeholders was developed with the support of the Steering and Planning Committees. Stakeholder outreach was performed early throughout, the planning process. In addition to “mass media” notification efforts, identified stakeholders were invited to attend the Kick- off meeting, while key stakeholders were requested to participate on the Steering and/or Planning Committees. The following is list of the various stakeholders that were invited to participate in the development of this Plan, along with a summary of how these stakeholders participated and contributed to the Plan. This summary listing cannot represent the sum total of stakeholders that were aware of and/or contributed to this Plan since formal and informal outreach efforts were utilized throughout the process by the many planning partners involved in the overall effort. Documentation of such sweeping efforts is impossible. Instead, this summary is intended to demonstrate the scope and breadth of the stakeholder outreach efforts made during the development of this Plan. Information and input provided by these stakeholders has been included throughout this Plan where appropriate, as identified in the references On June 6, 2013 an email was sent to the City of Auburn, towns and village for public/stakeholder review/comment of the Draft Plan and announcement of the public meeting. This email included a flyer containing this information for posting at the City/Town/Village hall. Also on this day, this email and flyer were sent to emergency management services personnel (County-wide). On June 14, 2013 an email was sent to neighboring counties’ emergency management offices for public/stakeholder review/comment of the Draft Plan and announcement of the public meeting. On the same day, a press release was sent to the media. On June 18, 2013 a flyer was distributed to 600 cars who attended the Cayuga County Household Electronics Day recycling event containing information on the public/stakeholder review/comment of the Draft Plan and announcement of the public meeting. Throughout the course of updating the Hazard Mitigation Plan, the Committee Chair sent numerous correspondences to participating stakeholders to update them on the process, make them aware of important meeting dates, and other plan review activities. This effort is intended to increase the likelihood of hazard mitigation becoming one of the standard considerations in the evolution and growth of Cayuga County. The Planning Committee has made the following efforts toward public participation in the development and review of the Plan:  The public was informed of the hazard mitigation planning effort commencement at the kick-off meeting, and through press releases, new articles, and public service announcements. To inform the public and county agencies of the ongoing Plan effort, updates regarding the mitigation planning process have been made at county-wide meetings including County legislature, emergency management, highway superintendent, Association of Town Supervisors, Cayuga County Planning Board, and the Cayuga County Association of Villages groups. In addition informational brochures were distributed to instructors and students of the 2013 Tractor Safety Training Course and flyers were posted in the lower Cornell Cooperative Extension Atrium and the outdoor Cornell Cooperative Extension entrance bulletin board ---PAGE BREAK--- SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-23 August 2013  A public website is being maintained as another way to facilitate communication between the Planning Committee and County residents (http://co.cayuga.ny.us/planning/hazmit). The public website contains a project overview, Planning Committee contact information, and sections of the HMP for public review and comment. See Figures 3-1 and 3-2 for screenshots of this public website.  Links to the public website have been established by the Town of Brutus, the Village of Moravia, and the Village of Weedsport. In addition, all participating municipalities have been requested and are expected to post links to the Cayuga County Hazard Mitigation website on the home web pages of each jurisdiction.  Links to the public website have been established by the Cayuga County Soil and Water Conservation District and the Cayuga County Health and Human Services Links and limited project information are posted on the Facebook page.  The public has been informed of the mitigation planning process through media coverage and articles appearing throughout the planning process. Copies of these articles may be found in Appendix C.  In order to facilitate coordination and communication between the Planning Committee and citizens and involve the public in the planning process, the Plan will be available to the public through a variety of venues. A printed version of the Plan will be maintained at Cayuga County Emergency Management Office.  Cayuga County has created a page on its website devoted to the All-Hazard Mitigation Plan (http://co.cayuga.ny.us/planning/hazmit) to inform residents of the project and to allow for direct input. The website went live in October 10, 2012. The page contains information on the project and methods the public can participate in the Planning process (Appendix  A press release was sent on October 10, 2012 to local media outlets including the Citizen News, Com News Moravia, Wayuga.com, and 9WSYR. Sample news clippings are provided in Appendix C to illustrate media coverage. An on-line natural hazards preparedness citizen survey was developed to gauge household preparedness that may impact Cayuga County and to assess the level of knowledge of tools and techniques to assist in reducing risk and loss of those hazards (http://co.cayuga.ny.us/planning/hazmit). The questionnaire asked quantifiable questions about citizen perception of risk, knowledge of mitigation, and support of community programs. The questionnaire also asked several demographic questions to help analyze trends. Responses were collected and incorporated into SWOO discussions and the catalog of mitigation actions. A summary of survey results is provided in Appendix H of this plan.  The questionnaire has been available on the public website since October 10, 2012, and further advertised on their website devoted to Hazard Mitigation Planning. Response rates to date are considered good. Appendix H summarizes public input received through the website, the online survey, and other sources.  Response surveys were distributed to Fire Departments, EMS, Hospitals, and Law Enforcement stakeholders on November 16, 2012. Recipients included 28 Fire Departments and Rescue/Ambulance Units, Cayuga County Sheriff's Office, and the New York State Police. ---PAGE BREAK--- SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-24 August 2013  A hazard mitigation planning tri-fold brochure (see Appendix C) was developed to inform the public of the planning process, provide local contact information, and encourage the public to review the plan and provide input.  In July 2013, the Draft Plan was posted to the public website (http://co.cayuga.ny.us/planning/hazmit). This was an opportunity for public comment on the Draft Plan before it while it was under review by NYSOEM. All public comments were directed to the Cayuga Planning and Economic Development Department for collection and review by the planning committee. Any public comments received will be incorporated into the plan before submittal to FEMA.  On June 6, 2013 an email was sent to the City of Auburn, towns and village for public/stakeholder review/comment of the Draft Plan and announcement of the public meeting. This email included a flyer announcing the Draft Plan posting, an upcoming public meeting to be held prior to Plan submittal to FEMA, and providing a link to the mitigation website for posting at the City/Town/Village hall. Also on this day, this email and flyer were also sent to emergency management services personnel (County-wide). A copy of the flyer is provided in Appendix C.  On June 14, 2013 an email was sent to neighboring counties’ emergency management offices for public/stakeholder review/comment of the Draft Plan and announcement of the public meeting. On this day, a press release was sent to the media.  On June 18, 2013 a flyer was distributed to 600 cars who attended the Cayuga County Household Electronics Day recycling event announcing the Draft Plan posting, an upcoming public meeting to be held prior to Plan submittal to FEMA, and providing a link to the mitigation website. A copy of the flyer is provided in Appendix C.  On July 8, 2013, an email distribution was sent out to Cayuga County School Districts to inform them of the planning process, provide local contact information, and encourage school district representatives to review the plan and provide input.  A public notice announcing the Draft Plan posting, an upcoming public meeting to be held prior to Plan submittal to FEMA, and providing a link to the mitigation website was distributed on August 7, 2013. 600 copies of the announcement were included in litterbags that Cayuga County Department of Planning and Economic Development distributed as part of an electronics collection and recycling event. Examples of public outreach efforts are presented in Appendix C. The community had an opportunity to comment on the draft HMP before submittal to NYSOEM/FEMA. The HMP was posted on the public website in June 2013 for review. COORDINATION WITH EXISTING PLANNING EFFORTS AND PROGRAMS Local municipalities are charged with the development of local HMPs required under Section 322 of the Stafford Act by New York. Therefore, the Planning Committee coordinated the development of this HMP. In New York, Article 2B Section 23 of State Executive Law authorizes local communities to prepare local disaster plans based on the contention that local municipalities are best equipped to assess their and weaknesses, opportunities, and constraints. Local governments have intimate knowledge of the local geography, and in a disaster, local government personnel are on the front lines providing personnel and equipment to support the community. Cayuga County and the participating jurisdictions are involved in this above program, hence the development of this Plan. Examples of other hazard mitigation programs in which County is involved with are the National Flood Insurance Program (NFIP), and the Hazard Mitigation Grant Program (HMGP). These programs assist Cayuga County in receiving funding for flood mitigation projects and flood insurance (the HMGP also can provide funds to mitigate other natural hazards). Data from Cayuga County, based on participation in these programs, was incorporated in the risk assessment in Section 5 and used to identify mitigation options in Section 9. Continued involvement in these flood-related programs will help to administer funds and resources to support this HMP. Federal Hazard Mitigation Funding Opportunities Federal mitigation grant funding (Stafford Act 404 and 406) is available to all communities with a current hazard mitigation plan (this plan); however most of these grants require a “local share” in the range of 10- 25% of the total grant amount. Participation in FEMA 404 HMGP may cover mitigation activities including raising, removing, relocating or replacing structures within flood hazard areas. The FEMA mitigation grant programs are described below. Hazard Mitigation Grant Program (HMGP) The HMGP is a post-disaster mitigation program. It is made available to states by FEMA after each Federal disaster declaration. The HMGP can provide up to 75% funding for hazard mitigation measures. The HMGP can be used to fund cost-effective projects that will protect public or private property in an area covered by a federal disaster declaration or that will reduce the likely damage from future disasters. Examples of projects include acquisition and demolition of structures in hazard prone areas, flood- proofing or elevation to reduce future damage, minor structural improvements and development of state or local standards. Projects must fit into an overall mitigation strategy for the area identified as part of a local planning effort. All applicants must have a FEMA-approved Hazard Mitigation Plan (this plan). Applicants who are eligible for the HMGP are state and local governments, certain nonprofit organizations or institutions that perform essential government services, and Indian tribes and authorized tribal organizations. Individuals or homeowners cannot apply directly for the HMGP; a local government must apply on their behalf. Applications are submitted to NYSOEM and placed in rank order for available funding and submitted to FEMA for final approval. Eligible projects not selected for funding are placed in an inactive status and may be considered as additional HMGP funding becomes available. ---PAGE BREAK--- SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-28 August 2013 Flood Mitigation Assistance (FMA) Program FMA provides funding to assist states and communities in implementing measures to reduce or eliminate the long-term risk of flood damage to buildings, manufactured homes, and other structures insurable under the NFIP. The FMA is funded annually; no federal disaster declaration is required. Only NFIP insured homes and businesses are eligible for mitigation in this program. Funding for FMA is very limited and, as with the HMGP, individuals cannot apply directly for the program. Applications must come from local governments or other eligible organizations. The federal cost share for an FMA project is 75%. At least 25% of the total eligible costs must be provided by a non-federal source. Of this 25%, no more than half can be provided as in-kind contributions from third parties. At minimum, a FEMA-approved local flood mitigation plan is required before a project can be approved. FMA funds are distributed from FEMA to the state. NYSOEM serves as the grantee and program administrator for FMA. Pre-Disaster Mitigation (PDM) Program The PDM program is an annually funded, nationwide, competitive grant program. No disaster declaration is required. Federal funds will cover 75% of a project’s cost up to $3 million. As with the HMGP and FMA, a FEMA-approved local Hazard Mitigation Plan is required to be approved for funding under the PDM program. Repetitive Flood Claims (RFC) Program The RFC program is an annually funded, nationwide mitigation grant program with the goal of reducing flood damages to individual properties for which one or more claim payments for losses have been made under flood insurance coverage, and will result in the greatest amount of savings to the National Flood Insurance Fund (NFIF) in the shortest period of time. RFC funding is available for property acquisition and structure demolition or relocation, structural elevations, and minor localized flood reduction projects. Federal funding covers 100% of the project costs. Severe Repetitive Loss (SRL) Program The SRL program is an annually funded, nationwide mitigation grant program with the goal of reducing flood damages to residential properties that have experienced severe repetitive losses under flood insurance coverage, and as such, will result in the greatest amount of savings to the NFIF in the shortest period of time. SRL funding is available for property acquisition and structure demolition or relocation, structural elevations, and minor localized flood reduction projects. Federal funding covers 75% of the project costs (90% if the community has a repetitive loss strategy). Federal Disaster and Recovery Assistance Programs Following a disaster, various types of assistance may be made available by local, state and federal governments. The types and levels of disaster assistance depend on the severity of the damage and the declarations that result from the disaster event. Among the general types of assistance that may be provided should the President of the United States declare the event a major disaster are the following: Individual Assistance (IA) IA provides help for homeowners, renters, businesses and some non-profit entities after disasters occur. This program is largely funded by the U.S. Small Business Administration. For homeowners and renters, those who suffered uninsured or underinsured losses may be eligible for a Home Disaster Loan to repair or replace damaged real estate or personal property. Renters are eligible for loans to cover personal ---PAGE BREAK--- SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-29 August 2013 property losses. Individuals may borrow up to $200,000 to repair or replace real estate, $40,000 to cover losses to personal property and an additional 20% for mitigation. For businesses, loans may be made to repair or replace disaster damages to property owned by the business, including real estate, machinery and equipment, inventory and supplies. Businesses of any size are eligible. Non-profit organizations such as charities, churches, private universities, etc. are also eligible. An Economic Injury Disaster Loan provides necessary working capital until normal operations resume after a physical disaster. These loans are restricted, by law, to small businesses only. Public Assistance (PA) PA provides cost reimbursement aid to local governments (state, county, local, municipal authorities and school districts) and certain non-profit agencies that were involved in disaster response and recovery programs or that suffered loss or damage to facilities or property used to deliver government-like services. This program is largely funded by FEMA with both local and state matching contributions required. Community Development Block Grants (CDBG) CDBG are federal funds intended to provide low and moderate-income households with viable communities, including decent housing, as suitable living environment, and expanded economic opportunities. Eligible activities include community facilities and improvements, roads and infrastructure, housing rehabilitation and preservation, development activities, public services, economic development, planning, and administration. Public improvements may include flood and drainage improvements. In limited instances, and during the times of “urgent need” (e.g. post disaster) as defined by the CDBG National Objectives, CDBG funding may be used to acquire a property located in a floodplain that was severely damaged by a recent flood, demolish a structure severely damaged by an earthquake, or repair a public facility severely damaged by a hazard event. National Flood Insurance Program Established in 1968, the NFIP provides federally-backed flood insurance to residents of communities that enact and enforce regulations that more carefully regulate development within floodplain areas. For individual property owners to be eligible to buy the federally-backed flood insurance, their property must be located within a community that participates in NFIP. There are three components to the NFIP: flood insurance, floodplain management and flood hazard mapping. Communities participate in the NFIP by adopting and enforcing floodplain management ordinances to reduce future flood damage. In exchange, the NFIP makes federally backed flood insurance available to homeowners, renters, and business owners in these communities. Community participation in the NFIP is voluntary. Flood insurance is designed to provide an alternative to disaster assistance to reduce the escalating costs of repairing damage to buildings and their contents caused by floods. Flood damage in the U.S. is reduced by nearly $1 billion each year through communities implementing sound floodplain management requirements and property owners purchasing flood insurance. Additionally, buildings constructed in compliance with NFIP building standards suffer approximately 80% less damage annually than those not built in compliance (FEMA, 2008). For a community to be eligible in NFIP, it must adopt and enforce a floodplain management ordinance to regulate proposed development in floodplains and officially designate a local floodplain coordinator/administrator. The intent of the program is to ensure that new construction does not exacerbate existing flood hazards and is designed to better withstand flooding. All jurisdictions in Cayuga County participate in the NFIP. The communities also have Flood Insurance Rate Maps (FIRM) that at a minimum show floodways, 100-year flood zones, and 500-year flood zones. Each municipality in Cayuga County has a local floodplain manager. All floodplain managers have been informed of the planning process, reviewed the plan documents, and provided direct input to the Plan. Community Rating System (CRS) The NFIP has been successful in protecting property owners who acquire flood insurance through the program from catastrophic financial losses due to flooding, and in requiring that new buildings constructed within 100-year flood plains are better protected from flood damage. ---PAGE BREAK--- SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-32 August 2013 In the 1990s, the Flood Insurance Administration (FIA) established the CRS to encourage local governments to increase their standards for floodplain development. The goal of this program is to encourage communities, through flood insurance rate adjustments, to implement standards above and beyond the minimum required in order to:  Reduce losses from floods  Facilitate accurate insurance ratings  Promote public awareness of the availability of flood insurance CRS is a voluntary program designed to reward participating jurisdictions for their efforts to create more disaster-resistant communities using the principles of sustainable development and management. The Village of Moravia is the one community within Cayuga County that is currently participating in the program. By enrolling in CRS, county municipalities can leverage greater flood protection while receiving flood insurance discounts. The Village of Moravia has attained a CRS class 8 which represents a 10% discount in flood insurance premiums. Active involvement in this program is included as a mitigation activity for interested jurisdictions in Section 9. New York State Department of Environmental Conservation (NYSDEC) – Division of Water - Bureau of Flood Protection and Dam Safety: Within the NYSDEC – Division of Water, the Bureau of Flood Protection and Dam Safety cooperates with federal, state, regional, and local partners to protect lives and property from floods, coastal erosion and dam failures through floodplain management and both structural and non-structural means; and, provides support for information technology needs in the Division. The Bureau consists of the following Sections:  Coastal Management: Works to reduce coastal erosion and storm damage to protect lives, natural resources, and properties through structural and non-structural means.  Dam Safety: Is responsible for reviewing repairs and modifications to dams, and assuring that dam owners operate and maintain dams in a safe condition through inspections, technical reviews, enforcement, and emergency planning.  Flood Control Projects: Is responsible for reducing flood risk to life and property through construction, operation and maintenance of flood control facilities. Specifically, NYDEC personnel inspect four 1946-1962 era federal flood control projects annually. Also they are responsible for the maintenance of the Moravia flood control project within the Village and to the Lake. Floodplain Management: Is responsible for reducing flood risk to life and property through proper management of activities including, development in flood hazard areas and review and development of revised flood maps Cornell Cooperative Extension of Cayuga County Cornell Cooperative Extension of Cayuga County (CCCCE) is a community-based educational outreach agency with state and national networks. CCCCE has educational outreach programming in the areas of Agriculture, 4H Youth Development, Environmental Education, Small Business and Nutrition. CCCCE staff work with Cayuga County residents to assess important community issues and needs and to develop and implement appropriate strategies and programs to address those needs. CCCCE has been serving Cayuga County for over 90 years. ---PAGE BREAK--- SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-33 August 2013 Cayuga County Land Use Plan A Land Use Plan for Cayuga County was adopted by the Cayuga County Planning Board in December of 1997. Its purpose was to attempt to identify techniques and principles that would allow the County Planning Board and local planning boards to respond to changing circumstances and variations in projects and programs. One of the five primary objectives of the Plan is to “protect our natural resources and encourage their wise use.” In its discussion of issues associated with rural growth, the Plan advocates a regulatory framework to accomplish the protection of rural resources based upon the capacity of the land to accommodate activities proposed for it. Physical features such as floodplains are described as the predominant factors in determining appropriate land uses, development density, and areas and shapes of lots. The Plan also cites as a major goal the “identification of ways to achieve the integration of linkage between the planning process and resource/environmental protection necessary to achieve sustainable growth.” Floodplains are specifically mentioned as an example of the types of critical/sensitive characteristics that must be identified before consideration of environmental concerns can be integrated into the standard project review process. Considering its focus on resource protection and capacity-based regulation, any efforts to formulate and implement hazard mitigation strategies would be fully consistent with the goals and objectives of the Cayuga County Land Use Plan and contribute toward its implementation as envisioned by the Plan’s authors more than fifteen years ago. Cayuga County Soil and Water Conservation District As the result of petitions and resolutions submitted to the Cayuga County Board of Supervisors (today the County Legislature) by the Farm Bureau, Grange, Dairymen's League, and other farm organizations the Cayuga County Soil Conservation District was formed on August 8, 1944. The horizons have expanded, and today they are also involved in wastewater management (the first District in New York State to do so), Nutrient Management, the Envirothon, on the local, state, and national levels, and the economic development of Cayuga County. The has working relationships with all of the County townships, villages, county departments and agencies, City of Auburn departments, several New York State departments, many federal agencies such as the US Army Corps of Engineers, the US Fish and Wildlife Service, and the NRCS. New York State Canal Corporation The New York State Canal Corporation is a subsidiary of the New York State Thruway Authority, formed through State legislation transferring the Canal System from the New York State Department of Transportation to the Authority on April 1, 1992. Since its inception, the Program has been providing matching grants to municipalities and not-for-profit corporations for capital projects consistent with the recommendations in the Report on the Future of New York State Canals and the 1995 Canal Recreationway Plan. The Corporation has provide grant funding for municipalities and non-profits for 57 capital projects along the Canal System to preserve and rehabilitate canal infrastructure, enhance recreational opportunities for water and land-based users, and promote tourism, historic interpretation and community revitalization. ---PAGE BREAK--- SECTION 3: PLANNING PROCESS DMA 2000 Hazard Mitigation Plan – Cayuga County, New York 3-34 August 2013 Cayuga County Agriculture and Farmland Protection Plan Cayuga County is in the process of updating its County-wide Agricultural and Farmland Protection Plan, first published in 1996. The new plan will incorporate protection tools such as Purchase of Development Rights (PDR’s), and a strategic vision for agricultural economic development and farmland protection. The updated plan will identify strategies to protect farmland from future development, which can influence how land use decisions are made for many years and may align with hazard mitigation strategies of Cayuga County jurisdictions. The current plan update allows for the incorporation of hazard mitigation initiatives into community-specific goals and recommendations, which would reinforce the All-Hazard Mitigation Plan. The overarching goal of the Agricultural and Farmland Protection Plan is the preservation, conservation, management or improvement of farmlands, including protection from flood and other severe weather hazards. For example, one of three ranking factors in New York State Department of Agriculture and Markets (NYSDAM)’s decision-making process for choosing properties to receive state grants for PDR purchase is the potential of the land to act as a buffer to significant natural public resources. Recommendations and resulting policy actions from the Agricultural and Farmland Protection Plan may lead to funding assistance for the acquisition of PDRs, conservation easements, or other interests in prime agricultural areas. Local Data The Planning Committee reviewed and incorporated existing data and plans to support the mitigation plan. A number of electronic and hard copy documents were made available to support the planning process. Municipalities now in the process of creating and/or updating their plans are the Town of Brutus and Village of Weedsport, so they will be the immediate focus. CONTINUED PUBLIC INVOLVEMENT Cayuga County is committed to the continued involvement of the public. Therefore, copies of the Plan will be made available for review during normal business hours at the Cayuga County Emergency Management Office. A notice regarding annual updates of the Plan and the location of Plan copies will be publicized annually after the Planning Committee’s annual evaluation and posted on the public website (http://co.cayuga.ny.us/planning/hazmit). Each jurisdiction’s Supervisor/Mayor or Clerk shall be responsible for receiving, tracking, and filing public comments regarding this Plan. The public will have an opportunity to comment on the Plan as a part of the annual mitigation planning evaluation process and the 5-year mitigation plan update.
