TOWN OF MENTZ REGULAR MEETING JULY 17, 2018 Supervisor Nielens called the meeting to order at 7:03 PM, led the Pledge of Allegiance to the Flag and asked for a moment of silence. Members Present: Supervisor Nielens, Councilman Mark Emerson, Councilwoman Barbara Clancy, Councilman Jeff Mills and Councilman Matt Poyneer. Others Present: Attorney Kevin Cox, Town Clerk Charleen Wood, Deputy Town Clerk/Cemetery Superintendent Lucy Ware, Highway Superintendent David Nielens, Planning Board Jeff Emerson, Code Enforcement Officer Jay Moose, Fire Department David Ware, Falcone Insurance Cindy Shepard, B & L Matt Schooley, Public, Rick Warrick, Jessica Marks and Kim & Terry Voudren, Minutes Approval: Minutes of the June 19, 2018 meeting: Motion made by Jeff Mills and seconded by Richard Nielens to approve/accept the minutes as presented. Motion carried 4-0-1 with Matt Poyneer abstaining. Budget Transfer: FROM: A1990.4 $200.00 TO: A1220.4 $200.00 Motion made by Matt Poyneer and seconded by Jeff Mills to transfer the funds. Motion carried 5-0. Audit of Bills: Motion made by Matt Poyneer and seconded by Jeff Mills to approve the following audit of bills. Motion carried 5-0. General A $28,060.43 VO 168-200 General B $ 73.27 VO 13-14 Highway DB $28,595.83 VO 46-51 TA $ 1 ,645.82 VO 13-14 DA $ 3,061.34 VO 18 Old Business: Fire Department Car Show – David Ware – Mr. Ware stated that the Fire Department would like to close Sponable Drive from the Legion to the Masonic Temple from 8AM – 3PM for the car show. Motion made by Matt Poyneer and seconded by Barbara Clancy to grant this request. Motion carried 5-0. ---PAGE BREAK--- Road Preservation Local Law – Motion made by Matt Poyneer and seconded by Mark Emerson to hold a Public Hearing on August 6, 2018 at 7:00 PM to address this issue. Motion carried 5-0. NY Central Bridge Contract – Matt Schooley – stated that there was a pre-construction meeting on July 17 and they will be meeting every other week beginning August 7, at 9:00 AM, Mr. Schooley stated that we are waiting for 1 permit and that hopefully construction will begin the week of July 23. We are also awaiting proof of insurance as well as contract documents and specifications. New Business: Falcone Insurance – Cindy Shepard – discussed various plans available Motion made by Matt Poyneer and seconded by Jeff Mills to accept Gold +6 with $75 per month put in an HSA account. Motion carried 5-0. Reports: Highway Department – David Nielens – written report – stated that Corey Schenck had received his CDL license; the school is giving the Town topsoil that we will stockpile at the land fill; stated that Trumble Road and Howland Island Road needed repair, but they are the County’s responsibility. Roads & Bridges – Matt Poyneer – covered under Matt Schooley’s report Code Enforcement – Jay Moose – written report Buildings & Grounds – Mark Emerson – stated that the state boiler inspection was 7/13 and meets all standards; E & V will come 7/23 to clean the furnaces Dog Control – Lucy Ware – written report Youth, Parks & Rec. – Jeff Mills – stated that little league field had been repaired and seeded; there were 3 championships this year played on the Little League fields; he is awaiting the response from the fencing company as to when they can install the fence. Landfill - Mark Emerson – stated that all is going well; he is still awaiting response to tour the Madison County transfer station Cemetery – Lucy Ware – stated that the vault roof had been completed and that all is going smooth Planning Board – Dwight Wethey/Jeff Emerson – one sub-division in the works ZBA Board – Lucy Ware – No Report Historian – Mike Riley – No Report Village Liaison – Dick Nielens – all running smooth – re-watering $47,000 over a 5-year period – in-kind services count toward the $47,000 Veteran’s Memorial – Joe Felice/Lucy Ware – meeting 6/21; quote for sidewalk in the works; new flags ordered; flag pole light installed; working on engraving large stone. Next meeting scheduled for 7/19. Attorney for Town: Kevin Cox – No Report ---PAGE BREAK--- Public to be Heard: Rick Warrick, Jessica Marks and Kim & Terry Voudren discussed their concerns over the manure lagoon on Maiden Lane Road which are: Environments concerns, air quality, flood lands, road erosion, property values, by products of the lagoon. The was not Town notification nor was the County Highway Department notified of the building of the lagoon. It was suggested that the Town contact DEC to see if proper permits were issued, contact Cayuga County for any details they might have, and write political leaders. Jay Moose, Code Enforcement Officer, gave the following information: Agricultural operations are permitted without a permit and the way our zoning laws are written this is an approved operation. Mr. Moose will look into the situation and see what, if anything can be done. Concrete proof is needed to issue a stop work order.
