VILLAGE BOARD MEETING SEPTEMBER 26, 2016 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:04 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, and Chris Fulton were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Kean (STP), and Maire and Mark Yowan were also present. (Trustee Tony Peppe was absent.) · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the minutes for the September 12, 2016 Village Board Meeting. Sewer Treatment Plant Operator Kean explained to the Board about a bill and two estimates that were received from W2O Pump & System Services for a motor rebuild and repairs to a pump. The Board thanked him for trying to explain. (It was noted that Mr. stated that the work for the two estimates dated September 9, 2016 were not urgent and were not approved.) · BILLS A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the following bills. · CABLE Each of the Trustees received a copy of an email sent to Attorney Thomas Blair with changes/revisions that were needed on the last copy of the Cable Franchise Agreement. Mayor Mulvaney asked if there were any other changes/revisions that the Board had. There were no more changes/revisions requested. Attorney Blair had responded via email that Zito New York, LLC was in agreement with all of the changes/revisions. After some discussion about the Public, Educational and Government access channel (PEG), the Board requested to have the channel available (and written into the contract) for the future. (It was noted that the Village would need to find an administrator to handle the advertisements on this channel, which would take some time.) The Board also received a copy of a reminder letter to Ray Dyer (Southern Cayuga County Cablevision) pertaining to legal counsel invoice reimbursements and the Indemnification Agreement to be signed. · TRANSFERS From: F1990.4 Contingent To: F9720.6 Statutory Bonds $ 300.00 ---PAGE BREAK--- G1990.4 Contingent G8130.2 Equipment $ 500.00 · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW WATER METER REPLACEMENT Mayor Mulvaney reported that there was no report on the new water meter replacement program. · VILLAGE ORDINANCES Each of the Trustees had received the final copy of Local Law #3 of 2016 “Regulating Open Burning”. Mayor Mulvaney asked if there were any questions, revisions, or changes. The Board responded there were not. The Board proceeded to then review Part 1 of the SEQR. The Mayor asked if there were any questions. The Board responded there was not. A motion was made by Trustee Fulton, Seconded by Trustee McGuerty and carried with a 4-0 vote to approve the following resolution: WHEREAS, the Village of Moravia seeks to regulate open burning within the Village, by the passage of proposed Local Law No. 3 of the year 2016 entitled “Regulating Open Burning”; and WHEREAS, no other agency has the legal authority or jurisdiction to approve or directly undertake the enactment of a local law in the Village of Moravia, such that there are no other involved agencies within the meaning of the New York State Environmental Quality Review Act (SEQRA) with respect to the enactment of said Local Law, with the result that the Village Board of Trustees shall act as lead agency in this matter: and NOW, THEREFORE BE IT RESOLVED, that the Village Board of the Village of Moravia hereby determines that: 1. The action is an Unlisted Action; 2. The Village Board of the Village of Moravia shall act as lead agency; 3. The Town of Moravia, Moravia Fire Department, and the Cayuga County Department of Planning and Economic Development are interested agencies in connection with the SEQRA review; 4. The action will require the preparation of a Short Environmental Assessment Form to provide information with regard to the environmental issues pertinent therein; and it is further RESOLVED, that the Village of Moravia shall hereby notify all interested agencies that it shall be lead agency for this action unless it receives written objection to this determination within thirty (30) days from the date of mailing of such notice; and BE IT FURTHER RESOLVED that proposed Local Law No. 3 of 2016 and any other documents with respect to the proposal be submitted to the Cayuga County 239 L&M Committee as required under New York State General Municipal Law §239, m, for review and comment; and be it further RESOLVED, that the Mayor of the Village of Moravia is hereby directed to sign the Short Environmental Assessment Form Part 1 – Project Information with respect to this Local Law, and is hereby further authorized to sign any other forms and documents in connection with said Local Law; and be it further ---PAGE BREAK--- RESOLVED, that the Village Board of the Village of Moravia will conduct a Public Hearing at the Village Offices on November 14, 2016 at 7:00 p.m., or as soon thereafter as the matter can be heard, for the purpose of taking public comment on, and giving due consideration to, the enactment of Proposed Local Law No. 3 of the year 2016; and be it further RESOLVED, that a copy of said Local Law is available at the Village Clerk’s Office for public inspection during regular business hours; and BE IT FURTHER RESOLVED, that the Village Clerk be and hereby is authorized and directed to publish notice of said Public Hearing in the official newspaper. He stated that it would be enclosed with the October water bills. · ZONING AMENDMENTS (PLANNING BOARD) Mayor Mulvaney reported that there was no other news from the Village Planning Board pertaining to the Zoning Amendments. · SOLAR POWER GRANT (WWTP) Mayor Mulvaney stated that there was no update or news on the Solar Power Grant for the Wastewater Treatment Plant. This item was tabled until the next regularly scheduled Board meeting. · OAK HILL GRAVEL PIT Mayor Mulvaney stated that there was no news on the Oak Hill Gravel Pit and was still waiting for the Cayuga County Highway Department to put up the decibel signs. · VILLAGE OF MORAVIA EMPLOYEE POLICY REVIEW Each of the Trustees received a final copy of the Village of Moravia Employee Policy for their approval. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the changes to the Village of Moravia Employee Policy for 2016. ---PAGE BREAK--- · SUMMER RECREATION COMMITTEE REPORT (PEPPE) The Summer Recreation Committee Report agenda item was tabled until the next regularly scheduled Board meeting since Trustee Peppe was absent. · PARADE PERMIT REQUEST (HOMECOMING) A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 3-0 vote to approve the Request for Parade Permit for the Homecoming Parade scheduled for October 8, 2016 and to waive the deposit, pending a current Certificate of Insurance. (It was noted that the Moravia Police Department would be sent a memo requesting their assistance and inviting the Cayuga County Sheriff’s Department to participate. Ms. Yowan stated that she had already contacted the New York State Police.) · HALLOWEEN PARADE REQUEST Village Clerk Anne Riddell received a phone call requesting permission for the Halloween Kiddie Parade on October 31, 2016. A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 3-0 vote to approve the Halloween Kiddie Parade (sponsored by the Ladies’ Fire Auxiliary) beginning at 6:00 p.m. starting at the Modern Market Parking Lot and finishing at the Four Town Building on Monday, October 31, 2016. (It was noted that the Moravia Police Department would be copied.) · RESCHEDULE VILLAGE BOARD MEETING (10/10/2016 COLUMBUS DAY) A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 3-0 vote to reschedule the Monday, October 10, 2016 Village Board meeting to Tuesday, October 11, 2016 at 7:00 p.m. due to Columbus Day being observed on Monday, October 10, 2016. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - Dog Control Officer Inspection Report (Ag & Markets). - Cayuga County Association of Villages Minutes (08/23/16). - Letter from Cayuga County Water & Sewer Authority pertaining to the outside water customers (Montville). On the table for Board review was a sample law for Erosion and Sediment Control from the Cayuga County Planning Department. (It was noted that each of the Trustees would receive a copy of this in the next Village Board meeting’s agenda packet.) Mayor Mulvaney reported that there was a tree stump that needed to be removed on Grove Street where a tree had been taken down earlier this summer. Mayor Mulvaney explained that the roots had grown under the sidewalk causing the sidewalk to be in major disrepair. Mayor Mulvaney directed Village Clerk Anne Riddell to send a letter to the property owner stating that the sidewalk would need to be removed (which the Department of Public Works could assist) and replaced (which would be the responsibility of the property owner). Trustee ---PAGE BREAK--- Fickeisen stated he was starting a list of sidewalks that are in need of repair and would give the on-going list to Village Clerk Anne Riddell.
