Town of Victory Board Meeting February 9, 2014 Council members present Michael Wiggins Supervisor Lester VanDyke Nancy Sheldon Others present Steven Yonker Highway Supervisor Victoria Davis Town Clerk Christopher Palermo Town Attorney Pat Coleman, Nick Blanchard, David Weilert Supervisor called meeting to order at 7:00pm, with the pledge of allegiance. No resolution presented to the board. Billing vouchers were submitted to the board for audit on abstract #002. Motion to accept vouchers as presented made by Lester VanDyke, Seconded by Nancy Sheldon; Carried. General Fund: $8552.05 Highway Fund: $8064.11 Street lighting Fund: $293.90 Minutes from January 2015 board meeting were presented to the board. Motion to accept a minute as presented was made by Nancy Sheldon Seconded by Lester Vandyke; Carried. Supervisors report: General Fund Town wide: $673,494.31 Highway Fund Town wide: $127,278.18 Total All Funds Town wide: $811,214.76 The large increase is due to sales and mortgage taxes. The supervisor received a letter from the Cayuga County Board of Elections. They stated that after a review of the last election they do not feel our polling place is sufficient and would like to discuss the options that are available. Clerks report: 1 building permits for $25.00 31 Dog license for $253.00 237 Garbage permits for $11,850.00 2 Gemological copies for $44.00 Taxes collected $651,914.00 of full payments and $84,862.12 in First installments the last day to collect with out fee and a 1st installment is February 10th. ---PAGE BREAK--- Code Enforcement report: Bruce stated he did one permit for a total of $25.00 as well as inspections. He is also completing the list for the Cato Fire Dept. that show the vacant houses, he is unsure if the plaques are the way to go. They then make the houses a target for theft. Highway Department report: Steve stated they have continued to plow and able to get some boom axing done. He has continued to speak with Cindy from RTI. She will guarantee $16,000.00 on the 2012 Ford pick-up. The new truck price on the State bid would be $24,176.62 a difference of $8176.62. This would be with keeping our plow now. The approval would need to be in by February 27th to get this rate. If we order now the truck would be here in June and the auction to sell the other would be in May leaving the Town to one truck for a month. A professional detail for the truck to get the most value at auction would be around $130.00. He also discussed the loader, after further research she will guarantee $85,000.00 for the loader. He then spoke with Milton CAT who would give 101,000.00 for the loader we have and sell us a 2015 938m with all the specifications Cindy would like to see to bring to auction for $151,232.00. We will keep the loader until our new one is delivered. Nancy would like to discuss the purchase of a new pick-up truck by Lester did not feel it should be discussed until Leonard is available. Nancy verified that if we did not order by February 27th that we would not be able to receive that rate. Lester stated he will speak to Leonard and will let Nancy and Mike know what he comes up with. The budget includes $70,000 for new equipment and the Loader and Pick-up would take approximately 62,000.00 of that. The clerk is able to write a check this week for taxes received to make the funds available. Lester will speak to Leonard before a decision is made, Mike did not see issues with these purchases and Nancy stated she was for the purchase. Nancy questioned who would speak Eleanor on her opinion; Lester stated she did not need to be involved since she had not been part of the prior discussions. Steve also presented the two grievances to the board. The new grievance discusses the inaccuracy of the Highway department workers paystubs. Nancy questioned why Red Creek Schools had to close Monday March 2nd. Steve stated he would not instruct a school to close but did inform the bus garage when they called him that snow removal was slow that morning due to the volume of snow that received and that it was still snowing at that point. They make the decision to close on there own. She also questioned if he had been calling the guys out later than normal because they are not coming by her house until after 6:00am. Steve stated they try and end the route by 6:30 as to not interfere with buses and that her road is near the end of the route, they have been consistently being called at the same time. Lester presented a list of all expenditure by the town for 2014 and the money that had been moved to the unexpended fund balance. ---PAGE BREAK--- David Weilert from Teamster Local 118 came to discuss the grievances from the Highway department. He presented every one with the language from the contract. He prepared a statement including information on the Union and the reason for the grievance. The town has stopped paying the wages as set forth in the contract in Article 13, the call in pay. Highway and Town Supervisor have denied the grievance in step one and two and Mike has held his position in phone conversations as well, bring it to step 3. They are here to ask the Town of Victory to honor the contract as it was intended and make the employees whole for all lost wages. He stated that if an agreement cannot be reached in step 3 that they are prepared to take this arbitration where they confident they will prevail. He believes that the Town is struggling with intent of language because they were not at the table during negation. The language is supported by the Town records and employees pay checks dating back to 2012. Beginning immediately at the start of the contract they had been paid in such a manner, showing that the Town supervisor and payroll department understood the intention. The Highway workers as of 2/16/2015 are owed a combined amount of $1570.00 . Labor management meetings are available and helpful to new people entering in to help reduce any misunderstanding. Nancy did not agree that that is how it was presented to him, Lester agrees with her. He also believes that the only reason it had been paid this way was because a highway man was doing payroll for a short period. After further discussion between the board and Mr. Weilert, the board enters executive session at 8:15pm. No motion is heard by clerk or by the recording, when the board returns from executive session at 8:50 the clerks asked who made the motion to enter. Nancy states she made the motion and Lester seconded. Motion to close the meeting at 8:55 made by Nancy Sheldon and seconded by Lester VanDyke
