TOWN OF STERLING PLANNING BOARD MEETING March 10, 2015 A special meeting of the Town of Sterling Planning Board was held on Tuesday March 10, 2015 at the Sterling Town Hall at 7:00 pm with the following members present: June Ouellette ~ Chairman Sue Allen ~ Member Grover Horn ~ Member Excused: Members Vernon Bishop and Susan Lemon. Also Present : Richard Fernuist, Mark and Mary Myers, Louis and Nanda Speciale, Judy Dunway and Walter Krehling. Chairman Ouellette called the meeting to order at 7:01 pm. PUBLIC HEARING Mark Myers – Special Use Permit (#9.00-1-29) Chairman Ouellette read the notice into the record and opened the Hearing at 7:03 pm. Notice is hereby given that the Planning Board of the Town of Sterling will hold a Public Hearing on Monday March 10, 2015 at 7:00 p.m. at the Sterling Town Hall, 1290 State Route 104A, Sterling, NY 13156. An Application for a Special Permit by Mark Myers will be heard regarding the operation of a restaurant on property located at 809 State Route 104A, Sterling, NY 13156; Tax Map # 9.00-1-29. All those wishing to be heard in favor of or in opposition of said application may appear in person or by other representation at said time and place. By order of the Planning Board Lisa Somers, Clerk Mark Myers was asked by the Board to outline his project proposal for the audience present at tonight’s Hearing. He presented a site plan drawing that identified the building dimensions, parking area, location of proposed future patio and road dimensions; he also stated that he planned minor renovations to clean up the space but nothing structural would be changed. He supplied a narrative detailing his intentions with the business, he also supplied a copy of the Health Department inspection that details the existing water and septic on the property which were found to be in good condition – both were accepted as part of the application. He completed his discussion by stating that he had received a use variance from the ZBA to continue operating a restaurant business conditional to obtaining a Special Permit from the Planning Board, a necessary element because the previous business had been closed for more than two years which triggered a cessation of the non-conforming status the property had possessed. Many of the audience were in favor of the application because of the history the diner has had in the community as well as the needed business to promote the tourism in the area. Without further comments from the audience or the Members, the Hearing was closed at 7:28 pm. The Members agreed that the project would not have any adverse environmental effects on the surrounding neighborhood and signed the SEQR forms. A motion to approve a Special Permit for Mark Myers to continue the use and operation of a family restaurant business was moved by Member Horn and seconded by Member Allen. All were in favor and the motion carried. Resolution 2015-02 BE IT RESOLVED, by the Planning Board for the Town of Sterling, upon the facts presented and the determination made, that the application for a Special Permit to allow the continued operation of a family restaurant business, per submitted site plan and narrative, on property ---PAGE BREAK--- owned by Mark Myers and located at 809 State Route 104A, Sterling, NY 13156; Tax map # 9.00-1-29 is hereby GRANTED upon the following express conditions: NONE. A roll call vote was taken: Chairman Ouellette Aye Member Allen Aye Member Horn Aye 3Ayes, 0 Nays, and 0 Abstentions - APPROVED BUSINESS Tim McIntyre - The clerk presented subdivision maps that were left in the planning mailbox for the Members to review in preparation of the April meeting when Mr. McIntyre will be present to begin the subdivision process.
