TOWN OF MENTZ PUBLIC HEARING AUGUST 6, 2018 Supervisor Nielens called the meeting to order at 7:00 and led the Pledge of Allegiance to the Flag. Members Present: Supervisor Nielens, Councilman Mark Emerson, Councilwoman Barbara Clancy, Councilman Matt Poyneer Councilman Jeff Mills arrived at 7:20. Others Present: Attorney Kevin Cox, Town Clerk Charleen Wood, Deputy Clerk Lucy Ware, Highway Superintendent David Nielens, Public: Jessica Marks, Tammy Smith, Sharon Vitale, Ben Vitale, Leslie & Kim Voudren, Jay Wilcox, John, Sherry & Jessi Menotti, Sally Smith, Pamela McDowell, Kenneth Cook, Lisa & Todd Thomson, Allison Childress, Caroline Childers, Jay Moose, Janine Svitavsky, Pay & Joel Glimpse, Katelynn Ulrich, Alan & Alyssa Fronce, Meghan Ehrhart (The Citizen), Gary VanFleet, Rich Ray, Richard & Bonnie Warrick, Gene & Eloise DeLue, Belinda Tanner, Robert Warrick, Pat Whitcomb, Christine Koch, David & Cheryl Funke, Sherdi McCormick, Sven Hoebling, Patricia Pickary- Mapley and others that did not sign the roster or writing was illegible. Public Hearing: Local Law to Establish Road Preservation: The Town Clerk read the legal notice regarding the local law Motion made by Mark Emerson and seconded by Barbara Clancy to open the public hearing at 7:00 PM. Motion carried 4-0 with Jeff Mills absent The Supervisor asked for comments, questions or concerns on the local law – there were none at this time. Manure Lagoon: Several community members spoke regarding the lagoon stating: Contamination of wells, preservation of land, out of county waste, roads cannot handle traffic, home value decreased, this project was started without town officials or community knowledge. We need specifics on the operation. All county residents pay for road repair since Maiden Lane is a county road. Mr. Vitale discussed CH4 contractor and digester in the county stating that the materials would be liquified and become effluent and then used to fertilize crops. He also stated that once the process was completed there would be no odor. Supervisor Nielens asked if there were any questions or concerns regarding the Road Preservation Law – there were none ---PAGE BREAK--- Suggestions were made by public to reach out to OGS and government offices. Is the lagoon taxable? It was suggested that we meet once a week Community members realize that the Town has no legal recourse for this project as it is governed by DEC Motion made by Jeff Mills and seconded by Barbara Clancy to close the public hearing at 8:10 PM. Motion carried 5-0 Motion made by Mark Emerson and seconded by Matt Poyneer to approve the Road Preservation Law. Motion carried 5-0. Supervisor Nielens stated that the August 21, 2018 meeting will be at 6 PM Motion made by Matt Poyneer and seconded by Barbara Clancy to adjourn at 8:30 PM. Motion carried 5-0.
