Regular Meeting, August 2017 1 Town of Niles TOWN BOARD MEETING August 10, 2017 Niles Town Hall PRESENT: Joan Jayne, Supervisor Steven Cuddeback, Councilman Bernard Juli, Deputy Supervisor Attorney Kevin McLoud Clarence Edmonds, Councilman Tara Lanning, Town Clerk OTHERS PRESENT: Kelly Anderson, Pat Steger, Stacey Morris, Calah Morris, Hannah Morris, Ava Morris, Eva Champion, Laura Granger A. Meeting called to order at 7:00 p.m. by Supervisor Jayne B. Pledge of Allegiance C. OPEN FLOOR TO THE PUBLIC Introduction of Eva Champion (Contact for Towns and Villages for Special Districts for Cayuga County Civil Service) and Laura Granger (Deputy Human Resources Administrator for Cayuga County Civil Service). Reaching out to Niles residents with questions or concerns about town employees and practices Stacie Morris, Dog Control Officer reports that a large tree fell on top of kennels (town owned); questions if town can help with expense of removing tree… no, because the kennels were not damaged. Supervisor Jayne reminded that no funds are available until a contract is signed for new kennels. Councilman Cuddeback suggests that she seek out bids for kennel improvements, preferably in budget reviews in October D. APPROVAL OF MINUTES On a motion by Councilman Cuddeback, seconded by Councilman Juli the following Resolution was ADOPTED Ayes Jayne, Juli, Cuddeback Nays E. RESOLVED that the minutes of July 13 be approved. F. DEPARTMENT REPORTS CODE ENFORCEMENT: Mr. VeVone reports that he received a call from the builder of property of Appletree Point. Contact Attorney Smith as owner may deed property to Town. Meeting should include attorney, highway superintendent, and assessor. The July storms ---PAGE BREAK--- Regular Meeting, August 2017 2 have caused much damage to lakeshore property. Councilman Juli reports that many questions were asked about repairing driveways, etc. Owners responsible for driveway repairs but material can NOT be put back in lake. Mr. VeVone has had contact with DEC. Also, more junk vehicles are turning up… post notice on website and send specific notices to violators on letterhead. ASSESSOR’S REPORT: No report available. ATTORNEY’S REPORT: Attorney McLoud reports that a meeting was held with the Weedsport Winter Wanderers who are requesting use of Church Road. A public hearing for a local law will be held at September meeting (9/13/17). Addressing Councilman Edmonds concerns from last meeting, Kevin called club, left message and created Snowmobile Waiver and Covenant not to Sue. Clerk with post notice for public hearing; as well as the special September meeting on Wednesday, September 13. Councilman Juli returns to conversation of kennel/tree issue to express his concern about the condition of the kennels which are owned by the town. Supervisor Jayne insists that the town should have been contacted before tree removal. Attorney McLoud states that the lease/ contract can be revisited at the time of renewal. Town owns kennels, insurance? G. TOWN CLERK’S REPORT: Received shares totaling $967.50 and has been deposited. Town Clerk asks Supervisor to make a Motion to approve Abstract 8. Motion by Supervisor Jayne to pay Abstract 8 (August bills), seconded by Councilman Cuddeback, motion carried H. HIGHWAY SUPERINTENDENT’S REPORT: Supervisor Jayne asks if the bikers have notified department of the ride on August 17; Mr. Steger states the roads will be fine. Several days spent to repair and cleanup storm damages. Met with Congressman Katco who visited the south end of Skaneateles Lake to assess damage from July storms to receive FEMA assistance. Also met and toured area with Senator Seward and Finch. Mr. Steger also reports that the department has been maintaining roads, gravel/grading, mowing, etc. Councilman Cuddeback asks about Old State Road erosion status… perhaps next year with funding town can work ditches to protect Dutch Hollow. Superintendent Jayne has received requests for Stop Ahead signs on New Hope and Burdock Roads. Mr. Steger will inquire with the county and/or state. RESOLUTION #2017-69 I. APPROVAL OF DEPARTMENT REPORTS On a motion by Councilman Juli, seconded by Councilman Cuddeback the following Resolution was ADOPTED Ayes Juli, Jayne, Cuddeback ---PAGE BREAK--- Regular Meeting, August 2017 3 Nays Resolved to approve department reports J. SUPERVISOR’S REPORT RESOLUTION #2017-70 APPROVE FINANCIAL REPORT Bookkeeper Kelly Anderson explains that there is just one page report because the details of the bills paid are already in the abstracts reviewed. Ms. Anderson reports some issues with the payroll service… caused software update. Also, in the fall will research Williamson Law system to settle gaps (i.e. bank vs. reports); and 2018 budget meetings will begin soon On a motion by Councilman Cuddeback, seconded Councilman Edmonds the following Resolution was ADOPTED Ayes Juli, Jayne, Cuddeback, Edmonds Nays Resolved to approve financial report K. OTHER BUSINESS: Community Day was a huge success… Supervisor Jayne thanks all who helped and the band will also return next year Assignments for 2017 Clean-Up Days: August 19: Councilman Cuddeback in West Niles; Next meeting will be on WEDNESDAY, SEPTEMBER 13 instead of Thursday Councilman Edmonds reports that the New Hope store has 4 new parking signs. Also Councilman Edmonds questions Mr. VeVone about residents zoning their property as agriculture to get the tax exemption; farmer must earn $10,000 yearly to be zoned agricultural. Discussion to address zoning concern as the town law will need to change. Also, questions Mr. VeVone has contacted owner of new building on Glen Haven Road… now has pergola. Councilman Edmonds reviewed town law regarding site plan review; Councilman Cuddeback reminder that the town sends letter to neighbors of new buildings and site plan L. Motion made by Councilman Cuddeback to adjourn, seconded by Councilman Juli, motion unanimously carried to adjourn at 8:09 p.m.
