VILLAGE BOARD MEETING AUGUST 14, 2017 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:04 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Anthony Peppe, and Chris Fulton were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Officer In Charge Robert Brown, Kean (WWTP), Sean Cochran (WWTP), Dick Phoenix (WWTP), Shawn Bray (MRB group), and Bill Davis (MRB group) were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the minutes for the July 24, 2017 Village Board Meeting. · BILLS A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bill #84 due to conflict of interest.) · PURCHASE ORDER A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the purchase order for $988.82 to USABlueBook for a DO (Dissolved Oxygen) Meter (Wastewater Treatment Plant). · DEPARTMENT REPORTS A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Treasurer’s Report for the month of July. A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Public Works Report for the month of July. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Water Meter Replacement Report for the month of July. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Fuller Park Inspection Report. A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of July. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of July. (Mayor Mulvaney reported that they are continuing to look for used trucks and will keep the Board updated.) A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Police Report for the month of July. ---PAGE BREAK--- A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Code Enforcement Report for the month of July. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Report for the month of July. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of July. It was noted that there was no Dog Control Report for the month of July. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above), however there had been a few new meters installed this month. · VILLAGE ORDINANCES This item was tabled until the next regularly scheduled Board meeting due to several open projects that the Board is currently working on. · ZONING AMENDMENTS (PB) – SITE PLAN REVIEW Village Clerk Anne Riddell stated that Village Attorney Charles Marangola called the Cayuga County Planning Department about the suggestion from the County’s GML 239-l, m & n Review Committee pertaining to incorporating Stormwater Pollution Prevention Plans. The County advised that the Village review their suggestion in the near future after the public hearing for Local Law #3 of 2017 entitled “Amending Local Law #1 of 1988 entitled ‘Village of Moravia Comprehensive Zoning and Land Use Law’ · POLICE POLICIES A final copy of the proposed Police Policies was on the table for Board review. (The Police Policies had also been emailed to each of the Trustees.) After some discussion and approval from Village Attorney Charles Marangola, a motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Police Policies as presented, effective August 14, 2017. · MEMORANDUM OF UNDERSTANDING (MEDICAL DROP – MPD) Each of the Trustees had previously received a copy of a Memorandum of Understanding to have a Medical Drop Box at the Village Justice Center. After Officer In Charge Robert Brown addressed some of the questions and concerns of the Board, changes were made to the hours/days the Medical Drop Box would be available to the public. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to authorize Mayor Mulvaney to sign the Memorandum of Understanding effective August 21, 2017. ---PAGE BREAK--- · SEWER BREAKS & FLOODING (MRB GROUP) Each of the Trustees received copies of emails from MRB group pertaining to the North Main Street and South Main Street sewer lines that need repair. After some discussion with Shawn Bray of the MRB group, a motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote accepting and authorizing Mayor Mulvaney to sign the two proposals from the MRB group for their professional services in addressing the North Main Street sewer break and the South Main Street sewer line replacement. · NYSDEC ANNUAL INSPECTION OF WWTP REPORT Each of the Trustees received a copy of the NYSDEC Annual Inspection of the Village’s Wastewater Treatment Plant Report. The Trustees also received emails from the MRB group stating that they had met with the staff at the Wastewater Treatment Plant addressing the concerns of the NYSDEC. Bill Davis of the MRB group addressed the Board with suggestions of possible grants that may be available to assist the Village in correcting many of the items listed in the Annual Inspection Report. Mr. Davis also briefly discussed each of the items with some possible recommendations. After some discussion, a motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to retain the services of MRB group to assist the Village in addressing the items listed in the NYSDEC Annual Inspection Report. (It was noted that the NYSDEC directed the Village to retain the services of a professional engineer to submit a report to them.) A motion was then made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote authorizing Mayor Mulvaney to send a letter and to sign the Certificate of Compliance from the NYSDEC, per their direction. · EMPLOYMENT APPLICATION (MATHER) An application for employment for Part-Time School Crossing Guard Substitute from Tim Mather was on the table for Board review. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to accept and approve Tim Mather for Part-Time School Crossing Guard Substitute at $18.00 per day, effective immediately. (Kean Sean Cochran, and Dick Phoenix exited at 8:55 p.m.) · MANAGEMENT CONTROL AGREEMENT (CAYUGA COUNTY INFO SERVICES) Each of the Trustees received a copy of a Management Control Agreement between the Cayuga County Information Services Department and the Village of Moravia Police Department. After an explanation from Officer In Charge Robert Brown and approval from Village Attorney Charles Marangola, a motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to authorize Mayor Mulvaney to sign the Management Control Agreement. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: ---PAGE BREAK--- - Declaration of a Local State Of Emergency Continuation (from Mayor). - Letter from Village to Village resident (re: overgrown grass). - Town of Moravia Minutes (01/18, 03/22, 04/19/17). - Email from Cayuga County (re: Shared Services Plan). - Email from Cayuga County Board of Elections (Primary 09/12/17). - Letter to major sewer users from Village (re: Sewer Use Law). On the table for Board review was: - Vehicle Log Sheets for the month of July. - Grout Tech Summary Report (Flood Damage Repair). Village Clerk Anne Riddell reported to the Board that Zito New York, LLC had received its renewal from the State of New York Public Service Commission.
