TOWN OF MENTZ REGULAR MEETING DECEMBER 19, 2017 Supervisor Nielens called the meeting to order at 7:00 PM; led the Pledge of Allegiance to the Flag and requested a moment of silence. Members Present: Supervisor Nielens, Councilman Mark Emerson, Councilwoman Barbara Clancy, and Councilman Matt Poyneer. Absent: Councilman Jeff Mills Others Present: Attorney Kevin Cox, Town Clerk Charleen Wood, Deputy Town Clerk/Cemetery Superintendent Lucy Ware, Highway Superintendent David Nielens, Code Enforcement Officer Jay Moose, Historian Mike Riley, Kari Terwilliger, Cayuga County Planning, Robert Warrick and Darin Rooker. Minutes Approval: Minutes of November 21, 2017 Meeting: Under Transfers: Remove the DA Transfer Under Cemetery Reports: Add that the Clancy’s declined reimbursement for the fence. Motion made by Mark Emerson and seconded by Barbara Clancy to approve/accept the minutes as amended. Motion carried 4-0 with Jeff Mills absent. SEQOR Determination for Town of Mentz Agriculture & Farmland Protection Plan – Kari Terwilliger – discussed the plan with comments from the State and addressed and questions. Motion made by Matt Poyneer and seconded by Mark Emerson to pass the resolution for the Negative Declaration for SEQR. Motion carried 4-0 with Jeff Mills absent. Public Hearings: Motion made by Barbara Clancy and seconded by Matt Poyneer to open the public hearing on Ag Protection Plan. Motion carried 4-0 with Jeff Mills absent. Motion made by Barbara Clancy and seconded by Matt Poyneer to open the public hearing on the Road Preservation Law. Motion carried 4-0 with Jeff Mills absent. Supervisor Nielens asked for questions or concerns on either of the topics of the public hearings. ---PAGE BREAK--- Discussion on the Road Preservation Law and how it would be enforced and the longevity of the road and if maintenance would be done continually. Motion carried 4-0 with Jeff Mills absent. Supervisor Nielens asked if there were any comments or questions on either of the Public Hearing topics. There were none. New Business: Appointment of Michael Riley to the Cayuga County Planning Board for the year 2018. Motion made by Mark Emerson and seconded by Matt Poyneer to appoint Michael Riley to the County Planning Board. Motion carried 4-0 with Jeff Mills absent. Camardo Law Firm Contract – Motion made by Mark Emerson and seconded by Matt Poyneer to approve the Camardo Contract for 2018 in the amount of $8,000. Motion carried 4-0 with Jeff Mills absent. Supervisor Nielens asked if there were any questions on the two Public Hearings. There were none. Motion made by Barbara Clancy and seconded by Matt Poyneer to close the Public Hearing on the Ag Protection plan at 8:15 PM. Motion carried 4-0 with Jeff Mills absent. Motion made by Barbara Clancy and seconded by Matt Poyneer to close the Public Hearing on Road Preservation at 8:16 PM. Motion carried 4-0 with Jeff Mills absent. AG & Farmland Protection Plan – Motion made by Matt Poyneer and seconded by Mark Emerson to adopt the resolution to adopt the Town of Mentz Agriculture and Farmland Protection Plan with amendments. Motion carried 4-0 with Jeff Mills absent. Reports: Highway Department – David Nielens – Written Report Roads & Bridges – Matt Poyneer – No Report Code Enforcement – Jay Moose – Written Report Buildings & Grounds – Mark Emerson – stated there had been issues with the door locking. He has contacted Peterman Lumber in Seneca Falls for resolution. It will cost $6800 to replace the door and make it operable. Other options will be investigated. Dog Control – Lucy Ware – Written Report Youth, Parks & Rec – Jeff Mills – sent word that he had located a person to install the fence Cemetery – Lucy Ware – Closed until spring – holding 2 in vault Planning Board – Dwight Wethey/Mike Riley – No Report ZBA Board - Lucy Ware – No Report Historian - Mike Riley – No Report Village Liaison – Richard Nielens – All is well Town Clerk – Charleen Wood – attended IT seminar on 12/4 and learned what is required by the state Veteran’s Memorial - Joe Felice – a meeting will be scheduled in the spring Attorney for Town: Kevin Cox – No Report Communications/Reminders: We have received the grant for re-watering along with Brutus and the Village of Port Byron MERRY CHRISTMAS Motion made by Matt Poyneer and seconded by Barbara Clancy to adjourn at 8:50 PM.
