VILLAGE BOARD MEETING MAY 23, 2016 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Anthony Peppe, and Chris Fulton were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Officer in Charge Rob Brown, and Village residents were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. Some Village residents addressed the Board and Officer in Charge Rob Brown with some of their concerns within the Village. After some discussion, the Board thanked them for coming. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the minutes for the May 9, 2016 Village Board Meeting. · BILLS A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following bills, as amended. · TRANSFERS From: A1990.4 Contingent To: A1110.4 – Justice $15.00 A1620.4 – Municipal Building $15.00 $30.00 · BUDGET MODIFICATION 2016/2017 A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Budget Modification for 2016/2017. (It was noted that Contingent from the General Fund was decreased by $1,000.00.) · DEPARTMENT REPORT A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Report for the month of April. · CABLE Mayor Mulvaney reported that he spoke with Attorney Thomas Blair and that the purchase of Southern Cayuga County Cablevision by Zito New York, LLC is moving forward with no problems. Mayor Mulvaney stated that he would keep the Board updated. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW WATER METER REPLACEMENT ---PAGE BREAK--- Mayor Mulvaney reported that two new water meters were put in this past week. · VILLAGE ORDINANCES After reviewing and discussing several sample laws pertaining to Open Burning, the Board directed Village Clerk Anne Riddell to draft up the law from the City of Batavia and insert/revise with the suggestions made by the Trustees. The Board also requested that a copy be given to the Moravia Fire Chief, Bill Anderson, for his suggestions and input. This item was tabled until the next regularly scheduled Village Board meeting. · WATER LEAK DETECTION UPDATE A map of the water lines in the Village was on the table for Board review that was created by Mark Manzari of New York Leak Detection (NYLD). Mayor Mulvaney reported that the Village would now have this on their computers for future reference. · ZONING AMENDMENTS (PLANNING BOARD) Mayor Mulvaney reported that there was no news from the Village Planning Board pertaining to the Zoning Amendments. · SOLAR POWER GRANT (WWTP) Village Clerk Anne Riddell reported a discussion she had with Village Attorney Charles Marangola’s pertaining to him speaking with colleagues from other municipalities pertaining to the Solar Power Grant. The attorneys had stated that they believed this was a “feel good project” and there were some concerns from one of the attorneys pertaining to the possible difficulty extinguishing solar fires. The attorney also expressed concern for Villages not having a Solar Law and possible SEQR issues. Village Attorney Charles Marangola advised the Board not to approve the resolution. After much discussion as to whether to proceed with exploring Solar Power at the Wastewater Treatment Plant, a motion was made by Trustee Fickeisen, seconded by Trustee McGuerty to not approve the following resolution and failed with a 2-2 vote. WHEREAS, the Central New York Regional Planning and Development Board (“CNY RPDB”), a public planning agency established in 1966 by Cayuga, Cortland, Madison, Onondaga, and Oswego Counties under the provisions of Article 12-B of the New York State General Municipal Law, has established a program designed to provide municipal entities and certain other public partners in the Central New York region with information, tools, and resources to make solar electric energy more accessible to their facilities and thereby reduce their energy costs through a regional solar initiative (the “Solarize CNY Initiative”); and WHEREAS, the Village of Moravia strongly supports the development of renewable energy in the Village of Moravia and the Central New York region, and recognizes the widespread benefits of the Solarize CNY Initiative developed by the CNY RPDB; and ---PAGE BREAK--- WHEREAS, Article 5-G of the New York State General Municipal Law authorizes municipal corporations and districts to enter into cooperative agreements for the performance or exercise of services, functions, powers or activities on a cooperative or contract basis among themselves or one for the other, and WHEREAS, the Village of Moravia deems it in the best interest of the Village of Moravia and its residents to enter into an intermunicipal cooperation agreement (the “Intermunicipal Cooperation Agreement”) to form an intermunicipal group (the “CNY Solar Intermunicipal Group”), for purposes of participating in the CNY Solar Initiative, including authorizing the CNY RPDB to study particular sites owned by the Village of Moravia and others, identified as potentially viable for installation of a solar photovoltaic facility for each site’s solar capacity and the resulting potential annual savings from producing solar energy, and on behalf of the CNY Solar Intermunicipal Group, to prepare and disseminate a joint solicitation package, including template agreements, and to make a recommendation for the selection of one or more solar provider(s) to develop, design, finance, construct, operate and maintain small to mid-sized commercial solar PV systems on a defined portfolio of project sites in Central New York and to sell the solar energy produced by such systems at a defined price, all as set forth in the Intermunicipal Cooperation Agreement and in accordance with all applicable laws, including any applicable procurement laws and policies. NOW THEREFORE, BE IT RESOLVED that the Board hereby determines that it is in the interests of the Village of Moravia to enter into the Intermunicipal Cooperation Agreement; BE IT FURTHER RESOLVED the Village of Moravia’s Mayor, is hereby authorized to execute and deliver the Intermunicipal Cooperation Agreement and such other documents, and take such other actions, as may be necessary or appropriate to carry out the intent of this resolution. The question of the foregoing Resolution was duly put to a vote and upon roll call was as follows: Trustee Anthony Peppe Voting Yes Trustee Gary Fickeisen Voting No Trustee Nancy McGuerty Voting No Trustee Chris Fulton Voting Yes A motion was then made by Trustee Fulton, seconded by Trustee Peppe to approve the following resolution. The question of the foregoing Resolution was duly put to a vote and upon roll call was as follows: Mayor Gary Mulvaney Voting Yes Trustee Anthony Peppe Voting Yes Trustee Gary Fickeisen Voting No Trustee Nancy McGuerty Voting No Trustee Chris Fulton Voting Yes · OAK HILL GRAVEL PIT Mayor Mulvaney reported that there was no update on the Oak Hill Gravel Pit and that the Decibel signs had not been put up yet. · WILLIAMSON LAW BOOK ANNUAL CONTRACT (TAX COLLECTION) A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the annual software support agreement for the tax program with Williamson Law for $400.00. · EMERGENCY HOME REPAIR LOAN DEFERMENT A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to defer the payments for an Emergency Home Repair Loan for another twelve (12) months (until May 25, 2017) for a Village Property owner. · FINGER LAKES RUNNERS CLUB (07/23/2016) Each of the Trustees received a copy of a letter from the Finger Lakes Runners Club for the annual Fillmore 5K on July 23, 2016. ---PAGE BREAK--- This item was tabled until the next regularly scheduled Village Board meeting so that the Village’s insurance company and the Village Attorney Charles Marangola could review. · EMPLOYMENT APPLICATION (SWAYZE) An application for employment from Travis Swayze was on the table for Board review. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to accept and place on file the employment application from Travis Swayze. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - Cayuga County Association of Villages Minutes (4/26/16). - Cayuga County Association of Villages Agenda for June. - Memo sent to Moravia Police Department with Local Law #2 of 2016 attached. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to enter Executive Session at 8:21 p.m. to discuss Personnel. (Officer in Charge Rob Brown was present.) A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to exit Executive Session at 8:53 p.m. A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to authorize Officer in Charge Rob Brown to mail the letter he drafted to three of the Village of Moravia Part-Time Police Officers.
