TOWN OF SUMMERHILL Organizational Meeting January 9, 2018 Town Hall 13606 State Route 90 Locke, NY 13092 Town Board Members Present: Susan Stout, Supervisor Duane Reynolds, Councilman Mary Osgood, Councilwoman Christopher Ryan, Councilman Daniel Ripley, Councilman Town Board Members Absent: None Other Town Officers Present: John Kirk, John Chase Residents: Bob Case, Don Forster, Jennifer Hogan Visitors: None Guests: Riccardo Galbato, Attorney at Law Recording Secretary: Carol Chase The meeting was called to order at 7:00 pm by Susan Stout, All stood for the pledge to the flag. Susan Stout introduced Riccardo Galbato to the Board. She would like the Board to appoint him as Town Counsel. He listed his current positions and experience with Municipal Law. He only practices Municipal Law. Chris Ryan asks if he would be doing the work or would it be an assistant. He answered that he may have an assistant do some of the work. Duane Reynolds asks if Mr. Galbato’s position with the Cayuga County Water Authority would be a conflict of interest if our lake develops blue green algae. Dan Ripley states that Mr. Galbato already deals with blue green algae in Owasco Lake. Motion 1-2018 Executive Session Mary Osgood made a motion to go into executive session to discuss a personnel matter at 7:12pm, seconded by Duane Reynolds. Carried 5 ayes Stout, Ryan, Ripley, Reynolds, Osgood 0 nays Motion 2-2018 Dan Ripley made a motion to come out of executive session 7:25pm, seconded by Duane Reynolds. Carried 5 ayes Stout, Ryan, Reynolds, Ripley, Osgood 0 nays Susan Stout introduced Jennifer Hogan. Mrs. Hogan would like to serve as the Town Historian. Jennifer is part of the Sherwood Historical Society, The Howland Home group, and she has worked with the Moravia History House. She owns land in Summerhill and plans on building a home in the spring. Mary Osgood asks if there is a residence requirement for the position. Susan answers, there is no residency requirement. Minutes of the December 12, 2017 meeting: Motion 3-2018 Dan Ripley made a motion to accept the minutes as written, seconded by Duane Reynolds. Carried 4 ayes Reynolds, Ryan, Stout, Ripley 1 abstain Osgood Minutes of the December 28,2017 meeting: Motion 4-2018 Duane Reynolds made a motion to approve the minutes of the Year End meeting as written, seconded by Dan Ripley. Supervisor’s Report: Susan Stout, Balance of Accounts, as of December 31, 2017 Motion 6-2018 Dan Ripley made a motion to approve the Supervisor’s report as presented, seconded by Duane Reynolds Carried 3 ayes Reynolds, Ryan, Ripley, Osgood 1 abstain Stout 1. D. Dog Control Report: Lindsay Anderson, 12 complaints, 1 dog adopted from October, 22 hours worked, 95 miles driven for the town E. Highway Superintendent’s Report: John Kirk, They are plowing every day. Let him know what the board wants him to do. They County may repair the post on the guardrail on Creech Rd. Susan will help set up an excel file on the computer ordered for the Town Barn. She would like a highway report that logs maintenance on the equipment and tracks daily activities. The new pick up needs signage. Chris Ryan thought the back passenger windows is an acceptable place to post them as long as it does not interfere with the drivers line of vision F. Town Justice: Sherry Davenport, November- There were 13 cases, $550 dollars in fines, $560 in surcharges was collected for a total of $1110. Carried 5 ayes Ripley, Ryan, Reynolds, Stout, Osgood 0 Nays Motion 8-2018 Executive Session Chris Ryan made a motion to go into executive session to discuss a personnel matter at 8:05pm, seconded by Dan Ripley. Carried 5 ayes Stout, Ryan, Reynolds, Ripley, Osgood 0 nays Motion 9-2018 Dan Ripley made a motion to come out of executive session at 8:20pm, seconded Mary Osgood. Resolution to adopt NYS Code of Ethics and Conflict of Interest Policy: Motion 10-2018 Dan Ripley made a motion to accept as written and posted the NYS Code of Ethics, seconded by Susan Stout Carried 4 ayes Stout, Ripley, Ryan, Reynolds 1 abstain Osgood C. Resolution to adopt the Rules of Procedure for the Town Board: Motion 11-2018 Chris Ryan made the motion to accept the Rules of Procedure for the Town Board, seconded by Dan Ripley Carried 4 ayes Stout, Ryan, Reynolds, Ripley 1 abstain Osgood D. Resolution to adopt the Rules of Public Participation during Board meetings: Motion 12-2018 Duane Reynolds made a motion to accept the Rules of Public Participation during Board meetings, seconded by Dan Ripley. Resolution authorizing the Town Supervisor to prepay periodic bills that are due before a board meeting: Motion 13-2018 Chris Ryan made a motion to allow the Supervisor to prepay periodic bills , seconded by Dan Ripley. Carried 5 ayes Stout, Ryan, Reynolds, Osgood, Ripley 0 nays F. Proposed addendum to the Town Employee Handbook: Adding a section on Jury duty and because of liability issues all town equipment is to be used for official town business only. Motion 14-2018 Chris Ryan made a motion to make the change to the handbook immediately, seconded by Dan Ripley. Carried 5 ayes Stout, Ryan, Ripley, Osgood, Reynolds 0 nays G. Audits Due: Justice – February Clerk Collector – March Supervisor – April H. There is no heat in the meeting room: The plumbers have been called OLD BUSINESS A. Exemptions: All Exemptions are due March 1st B. The roof over the porch is caving in: There was discussion about having Kevin look at the damage and suggest our next step and also getting 3 quotes for repair and 3 quotes for removing the roof. RESIDENT ISSUES None PAYMENT OF BILLS There were 11 General account bills voucher numbers 1-10&16 totaling $4229.91 and 5 Highway account bills voucher numbers11-15 totaling, $13482.12 presented for payment. Motion 15-2018 Dan Ripley made a motion to approve payment of these bills, seconded by Mary Osgood.
