1 Village of Fair Haven Zoning Board of Appeals Hearing July 27, 2017 The hearing began at 7:00 p.m. Board members present were Chairman Christopher Drogi, Susan Stanistreet, Paul Fallon, Sharon Basile and Alternate Sharon MacLeod. David Guynn was excused. Seven visitors were present including the applicants Joni Taubman, Chuck Bour and Daria Bour. The Zoning Board of Appeals members introduced themselves and Chairman Drogi explained hearing procedures. Clerk DiGregorio acknowledged proper notification of the meeting was made. Notice is hereby given that the Zoning Board of Appeals of the Village of Fair Haven will hold a public hearing on July 27, 2017 7:00 p.m. at the village hall meeting room located at 14523 Cayuga Street, Fair Haven NY to hear the following requests. Any person or persons requiring additional information or wishing to be heard may contact the Village Clerk’s Office at [PHONE REDACTED] or attend the meeting. Robert & Joni Taubman request an area variance for relief from provisions of Zoning §150-9 to construct a foyer and expand the porch on their property located at 14653 Fancher Ave. tax map #8.12-1-12. • Joni Taubman proceeded to explain that they hired Gerber Homes to build a small addition to square off the front of the house as they plan to live there all year round soon. The survey presented did not show the Fancher Ave. right-of-way. It was later determined by the legend on the survey map indicating the street line, that the term “street line” was another term for right- of-way. The Village of Fair Haven tax map was also used to determine the width of the road and location of the Fancher Ave. right-of-way. • A neighbor, George Hanford, present at the hearing was in favor of the proposed addition. • The SEQR was approved on a motion by Susan Stanistreet and seconded by Paul Fallon. All aye, motion carried. • On a motion by Susan Stanistreet and a second by Paul Fallon a 23.6-foot front variance was granted to build an addition not to exceed 96 square feet. All aye, motion carried. Charles & Daria Bour request an area variance for relief from provisions of Zoning §150-9 to place a shed on their property located at 14672 Fancher Ave. tax map #8.12-1-8. • The Bour’s explained the need for a storage shed and the reason for the placement thereof, being the only somewhat flat spot on their property. A communication was received from neighbor Susan Traniello in favor of the proposed shed. Another neighbor, George Hanford, present at the hearing, was also in favor of the proposed shed. • Clarification of a shed being an accessory structure was determined as accessory structures are allowed to be placed 10 feet from a principal structure and 10 feet from all lot lines. Therefore, determining the variances needed. • The SEQR was approved on a motion by Susan Stanistreet and seconded by Chairman Drogi. All aye, motion carried. • On a motion by Susan Stanistreet and seconded by Paul Fallon a 5-foot rear variance and a 3- foot east side variance was granted for a a 10’ x 12’ shed. All aye, motion carried. ---PAGE BREAK--- 2 COMMUNICATIONS: • Copies of John Gadjo decision were distributed to the ZBA members. • Chris Drogi signed the Hadcock and Bader & Howe decisions from the last hearing. • There is one request for an area variance by Gary Clark to build a garage at 14942 West Bay Road scheduled for the August 24th 7:00 p.m. hearing date. MINUTES: • The June 29th meeting minutes were approved on a motion by Paul Fallon and seconded by Chairman Drogi. All aye, motion carried. NEW BUSINESS: • Susan Stanistreet recommended the building permit fee schedule be posted on the Village website. This will go before the Board of Trustees at the next board meeting. • Jay Sawyer asked the Zoning Board of Appeals members if they would be receptive to hearing a request for a use variance by the Cayuga County Water & Sewer Authority if they were to purchase the garage on Wilcox Street for their use. Another thought was for the CCWSA to request the Village of Fair Haven to possibly purchase the garage and sell it to the Cayuga County Water & Sewer Authority. Susan Stanistreet voiced her opinion that the neighbors were strongly against the operation of a business in their residential neighborhood. Chairman Drogi stressed, that area is not zoned for that use and the same result of denial would occur if another hearing was held requesting a use variance. UNFINISHED BUSINESS: • The Board of Trustees revised the building permit fee schedule to reflect a flat $250.00 fee plus the cost of advertising to request a variance. This was approved at the July 10th board meeting. • The ZBA members decided on the colors of orange with black lettering for the variance sign. These signs will be placed in the front yards of the applicants requesting variance hearings. ADJOURNMENT: The meeting was adjourned at 8:35 p.m. on a motion by Chairman Drogi and Paul Fallon.
