Regular Meeting, April 2017 TOWN OF NILES TOWN BOARD MEETING April 13, 2017 Niles Town Hall PRESENT: Joan Jayne, Supervisor Steven Cuddeback, Councilman Clarence Edmonds, Councilman Attorney Brody Smith, Attorney Joseph MacDuffee, Councilman Tara Covert, Town Clerk Tiffany Landis, Deputy Town Clerk OTHERS PRESENT: Suzanne Sinclair, Chris Lawson, Bill Sheppard, Robin Sheehan, Pat Steger, Roger Slater A. Meeting called to order at 7:00 p.m. by Supervisor Jayne B. Pledge of Allegiance C. OPEN FLOOR TO THE PUBLIC No remarks D. APPROVAL OF MINUTES On a motion by Councilman Cuddeback, seconded by Councilman MacDuffee the following Resolution was ADOPTED Ayes MacDuffee, Jayne, Cuddeback, Edmonds Nays RESOLVED that the minutes of March 9, 2017 be approved. E. UPDATE ON WATER AND SEWER DISTRICTS: Chris Lawton and Attorney Smith announced that the water and sewer districts have been approved by the State Comptroller and that the town may move forward to establish and bond districts. RESOLUTION #2017- 17 a. WATER DISTRICT # 1. On a motion by Supervisor Jayne, seconded by Councilman Cuddeback to establish Water District Number 1. Resolution was ADOPTED Ayes MacDuffee, Juli, Jayne, Cuddeback, Edmonds Nays RESOLVED to accept the establishment of Water District ---PAGE BREAK--- Regular Meeting, April 2017 F. UPDATE ON SEWER AND WATER DISTRICTS Chris Lawton, Barton & Loguidice presented on the water and sewer districts. Still waiting for second approval by State Comptroller. No design, engineering or construction can begin until comptroller approval. Distributed both agreements (water and sewer). Each project has its own agreement. Includes scope of service. Audit will be needed to submit with the application. On a motion by Supervisor Jayne, seconded by Councilman Juli the following Resolution was ADOPTED Ayes MacDuffee, Juli, Jayne, Cuddeback, Edmonds Nays RESOLVED to accept Sewer and Water District report. G. DEPARTMENT REPORTS a. CODE ENFORCEMENT: Absent but sent report via e-mail. Attorney Smith discussed with Mr. VeVone that Mr. Hess is working to comply with the junkyard law. As for the Adams case, all vehicles have been registered. b. ASSESSOR’S REPORT: No report available. Attorney Smith states that Assessor Schramm would like to do the reval for the 2019 roll starting end of this year. A resolution to affect that change has been given; $12,000 to hire a consultant. No vote is needed at this time. c. ATTORNEY’S REPORT: Attorney Smith has put a resolution before the board to hire fiscal advisors, once the water and sewer district bond resolution is passed, board will need to get a short term loan. A firm will get the best loan and best rates. RESOLUTION #2017-40 HIRE FISCAL ADVISORS On a motion by Councilman Juli, seconded by Councilman Cuddeback the following Resolution was ADOPTED Ayes MacDuffee, Juli, Jayne, Cuddeback, Edmonds Nays Resolved to authorize Supervisor to hire fiscal advisors to assist with getting best rates for water and sewer district bond not to exceed $5000 to secure loan Councilman Juli suggests that a moratorium for solar laws should be put in place; Attorney Smith agrees. Planning board is investigating. d. TOWN CLERK’S REPORT: Newsletter has been printed and mailed and should arrive in homes by end of week. Cost to print and mail was $1046 saving about $500 over last year. Received shares totaling $70.10 and has been deposited. Town Clerk asks Supervisor to make a Motion to approve Abstract 3. Motion by Supervisor Jayne to pay Abstract 3 (March bills), seconded by Councilman Cuddeback, motion carried ---PAGE BREAK--- Regular Meeting, April 2017 e. HIGHWAY SUPERINTENDENT’S REPORT: Mr. Steger was not able to attend, but provided report. RESOLUTION #2017-41 APPROVAL OF DEPARTMENT REPORTS On a motion by Councilman Juli, seconded by Councilman Cuddeback the following Resolution was ADOPTED Ayes MacDuffee, Juli, Jayne, Cuddeback, Edmonds Nays Resolved to approve department reports H. SUPERVISOR’S REPORT RESOLUTION #2017-42 a. APPOINT NEW BOOKKEEPER SUZANNE SINCLAIR On a motion by Councilman Juli, seconded by Councilman Cuddeback the following Resolution was ADOPTED Ayes MacDuffee, Juli, Jayne, Cuddeback, Edmonds Nays Resolved to appoint Suzanne Sinclair as Bookkeeper RESOLUTION #2017-43 b. APPROVE WLB HIGHWAY SUPERINTENDENT’S SOFTWARE RENEWAL On a motion by Councilman Juli, seconded by Councilman Cuddeback the following Resolution was ADOPTED Ayes MacDuffee, Juli, Jayne, Cuddeback, Edmonds Nays Resolved to purchase WLB software renewal at a cost of $408 c. PROPOSED PURCHASE OF TOWN SIGN Councilman MacDuffee and Supervisor Jayne talked with Mark Glass to make a new 4x6 sign for town offices at a cost of $975. Mr. Steger and his employees can install. Attorney Smith noted that public works can go to $3,000 without getting bids. d. Supervisor Jayne commends Dar Winters for donating to the town remaining proceeds ($37) from Farmer’s Market Coffee Fund ---PAGE BREAK--- Regular Meeting, April 2017 RESOLUTION #2017-44 e. APPROVE FINANCIAL REPORT On a motion by Councilman Cuddeback, seconded Councilman MacDuffee the following Resolution was ADOPTED Ayes MacDuffee, Juli, Jayne, Cuddeback, Edmonds Nays Resolved to approve financial report RESOLUTION #21-017-45 f. EXECUTIVE SESSION On a motion by Supervisor Jayne, seconded Councilman Cuddeback the following Resolution was ADOPTED Ayes MacDuffee, Juli, Jayne, Cuddeback, Edmonds Nays Resolved to move in to executive session at 7:55 p.m. to discuss personnel matters RESOLUTION #21-017-46 RETURN TO REGULAR SESSION On a motion by Supervisor Jayne, seconded Councilman Cuddeback the following Resolution was ADOPTED Ayes MacDuffee, Juli, Jayne, Cuddeback, Edmonds Nays Resolved that the Town Board return to regular session at 8:17 p.m. I. OTHER BUSINESS: Assignments for 2017 Clean-Up Days April 15: Councilman Edmunds in West Niles May 20: Councilman MacDuffee in New Hope June 17: Supervisor Jayne in West Niles July 15: Councilman Juli in New Hope August 19: Councilman Cuddeback in West Niles J. Motion made by Supervisor Jayne to adjourn, seconded by Councilman Juli, motion unanimously carried to adjourn at 8:23 p.m.
