TOWN OF STERLING PLANNING BOARD MEETING March 2, 2015 A regular meeting of the Town of Sterling Planning Board was held on Monday March 2, 2015 at the Sterling Town Hall at 7:00 pm with the following members present: June Ouellette ~ Chairman Sue Allen ~ Member Grover Horn ~ Member Excused: Members Vernon Bishop and Susan Lemon. Also Present: Sam Simmons, Norbert and Betty Maute. Chairman Ouellette called the meeting to order at 7:03 pm. PUBLIC HEARING Sam Simmons – Special Use Permit (#16.00-1-59.11) Chairman Ouellette read the notice into the record and opened the Hearing at 7:04 pm. Notice is hereby given that the Planning Board of the Town of Sterling will hold a Public Hearing on Monday march 2, 2015 at 7:00 p.m. at the Sterling Town Hall, 1290 State Route 104A, Sterling, NY 13156. An Application for a Special Permit by Sam Simmons will be heard regarding the storage of construction equipment on property located at 15555 State Route 104, Martville, NY 13111; Tax Map # 16.00-1-59.11. All those wishing to be heard in favor of or in opposition of said application may appear in person or by other representation at said time and place. By order of the Planning Board Lisa Somers, Clerk Sam Simmons approached the Board members and explained that in response to a letter that he received from the CEO he had filed for a Special Use Permit to utilize his existing pole barn for storage of his business equipment and the storage of approximately three vehicles outside. Although he had been using the property this way for the last 5 years the addition of the business sign and the fact that office space exists within the pole barn necessitated the need for a permit. The applicant completed a SEQR short EAF form which the Board reviewed along with the computer generated EAF Mapper, which identifies flood plain areas, wetlands, and areas of possible archaeological significance to name a few – all were found to be without impact. Some discussion ensued regarding the future renewal and fee process because of changes within the new Land Use Regulations and amended fee schedule. The clerk stated that two neighbors that had received notices had called; Mr. Maute had inquired about the process and stated he was in favor of granting the Special Permit, and Pastor James Lagoe (Emmanuel Baptist Church) also in favor of granting the permit additionally stated that Mr. Simmons was appreciated as a neighbor and had assisted the church in several instances in the past couple of years. Without further comments from the audience or the Members, the Hearing was closed at 7:35 pm. The Members agreed that the project would not have any adverse environmental effects on the surrounding neighborhood and signed the SEQR forms. A motion to approve a Special Permit for Sam Simmons to utilize the structure and property for construction business equipment storage was moved by Member Horn and seconded by Member Allen. All were in favor and the motion carried. Resolution 2015-01 BE IT RESOLVED, by the Planning Board for the Town of Sterling, upon the facts presented and the determination made, that the application for a Special Permit to utilize existing structure for storage of construction business equipment, per submitted site plan, on property owned by ---PAGE BREAK--- Samuel Simmons and located at 15555 State Route 104, Martville, NY 13111; Tax map # 16.00-1-59.11 is hereby GRANTED upon the following express conditions: NONE. A roll call vote was taken: Chairman Ouellette Aye Member Allen Aye Member Horn Aye 3 Ayes, 0 Nays, and 0 Abstentions - APPROVED BUSINESS Christopher Ferlito – Special Permit (#20.00-1-68.1) Mr. Ferlito had previously submitted plans and reports in support of a gravel mine for the Board Members to review in preparation of his preliminary meeting for a Special Permit. Although he had planned on presenting tonight he postponed because of DEC changes and updates that were yet to be completed. Chairman Ouellette commented that Mr. Ferlito had met with the Highway supervisor, Brian Soper, a few times and was adjusting any areas of concern such as paving the egress and adjusting truck route to the south which utilizes less Town of Sterling roads. Mandatory Notification for PB applications The clerk commented on the cost of postage for certified letters in connection to public Hearing notices. The process calls for adjacent properties to receive a hearing notice by regular mail and a second hearing notice by certified mail with signed receipt. Many times the certified letter is returned about a month later after numerous failed attempts at delivery. The expense for certified with signed receipt is $6.49 (which will probably be increased in the near future) and applications average out at 8 notifications – 40 notifications for 5 processed applications equals $259.20. The Board could opt to send the second notification as certified which would provide a stamped receipt providing proof of mailing at a cost of $3.79 each – a savings of $2.70 a piece. Member Horn agreed that more times than not the certified with receipt letters are returned without delivery. A motion to no longer require certified mailing with signed return receipt for the notification process, and that certified mailing with stamped postal receipt would suffice for most applications was moved by Member Allen and seconded by Chairman Ouellette with a further stipulation that the Planning Board reserves the right to mail notices with a signed return receipt if deemed necessary. All were in favor and the motion carried. MINUTES Meeting minutes for February 9, 2015 were approved by a motion moved by Member Horn and seconded by Chairman Ouellette. All were in favor without further discussion and the motion passed. ADJOURN On a motion by Member Horn and seconded by Member Allen, the meeting was adjourned at 8:23 PM.
