VILLAGE BOARD MEETING MARCH 23, 2015 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton and Anthony Peppe were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Rick Nelson, and Sandie Doran of OWLA were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the minutes for the March 9, 2015 Village Board Meeting. · BILLS A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the following bills. · TRANSFER A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the following transfer. From: Contingent F1990.4 To: Water Admin. F8310.4 $3,000.00 · DEPARTMENT REPORTS A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Justice Report for the month of February. It was noted that there was no Code Enforcement Report for the month of February. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no update on the Glenside Water/Sewer District Agreements. · PLANNING BOARD AND ZONING BOARD MEMBERS Each of the Trustees received a copy of a Planning Board member application from Village resident, Fritz Hess. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to appoint Fritz Hess to the Village of Moravia Planning Board. · NEW METER REPLACEMENT Mayor Mulvaney stated that he had no update on new water meter replacements. ---PAGE BREAK--- · VILLAGE ORDINANCES The review of the Village Ordinances was tabled until the next regularly scheduled Village of Moravia Board of Trustees meeting. · NORTH MAIN STREET WATER MAIN PROJECT Mayor Mulvaney reiterated that the North Main Street Water Main Project was put on hold while researching a village wide leak detection program and mapping. · GARBAGE, RUBBISH AND RECYCLING REMOVAL BIDS Each of the Trustees received a copy of the one bid received on March 20, 2015 from WeCare Waste and Recycling that Village Attorney Charles Marangola reviewed and approved. After much discussion, a motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve WeCare Waste and Recycling, LLC’s bid for Garbage, Rubbish and Recycling Removal for the Village of Moravia for the period of only one year from June 1, 2015 through May 31, 2016 for a total of $47,250.00 (17% increase) to include New York State prevailing wage. It was noted that WeCare Waste and Recycling, LLC was the only bid received with the three year bid coming in at $147.750.00 (28% increase). · COURT CASE (SOVOCOOL – UNREIGSTERED MOTOR VEHICLE) Mayor Mulvaney reported that the Sovocool case had been adjourned to April 14, 2015 at 5:30 p.m. · OWASCO WATERSHED LAKE ASSOCIATION (OWLA) Rick Nelson and Sandie Doran addressed the Board explaining their request to have the Board pass a resolution in support of a $604,250 grant that the Owasco Watershed Lake Association (OWLA) is applying for. After some discussion a motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following resolution: WHEREAS, OWLA has requested an allocation within the 2015 NYS budget to support a range of critically important Lake restoration actions referred to as the “OWLA Enhanced Restoration Actions Program”; and WHEREAS, this OWLA program is designed to rapidly reduce the loading of phosphorus from the streams and tributaries of Owasco Lake; and ---PAGE BREAK--- WHEREAS, Owasco Lake has experienced a rapid degradation in water quality as evidenced by on- going water quality studies of the lake, increased aquatic vegetation growth, and multiple cyanobacteria blooms, some of which were highly toxic; and WHEREAS, the proposed Restoration Program will provide funding for capital expenses included in the design, planning, installation, and monitoring of various phosphorus reduction mechanisms and techniques in the buffer areas adjacent to streams and tributaries; and WHEREAS, OWLA’s mission is to restore and protect the water quality of Owasco Lake and in consideration of existing data showing the negative impacts of nutrient loading from non-point sources and various land uses adjacent to the streams and tributaries of the watershed, NOW, THEREFORE, BE IT RESOLVED, that the Village of Moravia is fully in support of the proposed OWLA Action Program as described generally in the attachment to this resolution and urges all NYS legislative representatives representing this area to do all that can be done to secure funding for this program. The foregoing resolution was duly put to a vote on roll call, which resulted as follows: Anthony Peppe voting yes Gary Fickeisen voting yes Nancy McGuerty voting yes Christopher Fulton voting yes The Board thanked them for coming and for answering their questions. · NYLD INFRASTRUCTURE LEAK DETECTION ESTIMATE Each of the Trustees received a copy of an estimate from NYLD Infrastructure - New York Leak Detection, Inc. for $7,500.00. Mayor Mulvaney explained that this would detect water leaks within the Village (approximately 9 miles) so that the Department of Public Works would be able to repair immediately. He also explained that it would include a “mapping” of all the water lines for the office to have on file and maintain. (It was noted that there was a 40% loss of water in the Village for 2014.) A motion was made by Trustee Fulton to authorize the Mayor to sign the estimate from NYLD Infrastructure. With no second motion made, the motion was denied. After some discussion, the Board requested that references be contacted and for Village Attorney Charles Marangola review the estimate. A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to approve and authorize Mayor Mulvaney to sign the estimate from NYLD Infrastructure for $7,500.00 pending references. · HOMELAND SECURITY & EMERGENCY SERVICES (IMAP) Each of the Trustees received a copy of a letter from Homeland Security and Emergency Services. The letter explained that the Intrastate Mutual Aid Program (IMAP) is a resource sharing mechanism for local governments to easily access during a declared disaster emergency. All local governments are automatically participants unless they choose to “opt out”, which Village Clerk Anne Riddell advised not to do. After some discussion, the Board agreed not to opt out, so nothing more needed to be done. ---PAGE BREAK--- · PERMISSION FOR WATER SCHOOL (PERKINS, SMITH) A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to authorize Mike Perkins and Bill Smith to attend W2Operator Training Group Spring Work Shop in Cortland on March 27, 2015. · EMPLOYEE APPLICATION (STAYTON) An application for employment from Matthew Stayton for Laborer was on the table for Board review. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to accept and place on file the employment application from Matthew Stayton. · APRIL FAIR HOUSING PUBLIC NOTICE A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to declare April as Fair Housing Month and to publish the notice. · SET PUBLIC HEARING FOR 2015-2016 BUDGET A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to set the public hearing for the Village of Moravia 2015-2016 budget for Monday, April 13, 2015 at 7:15 p.m. · WILLIAMSON LAW SOFTWARE SUPPORT (PAYROLL) A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the annual payroll software support contract with Williamson Law for a total of $665.50. (Treasurer Susan Wade noted that there was no increase from last year’s contract.) · FULLER PARK USE REQUEST (KINNEY DRUGS – 4/4/15) Each of the Trustees received a copy of a use request for the Fuller Park amphitheater. Kinney Drugs requested the use on April 4, 2015 for an Easter Egg Hunt. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve and waive the fee for the Fuller Park use request from Kinney Drugs on April 4, 2015 for an Easter Egg Hunt to benefit Upstate Golisano Children's Hospital pending their certificate of insurance. · INFORMATIONAL ITEMS The Village Board of Trustees each received a copy of the following: - Village of Moravia Spring Clean-Up flyer. - Village of Moravia 2014 Annual Water Quality Report. - Memo from Village Clerk Anne Riddell (re: April Cayuga County Association of Villages Dinner meeting that Moravia is hosting). ---PAGE BREAK--- - Letter from the Town of Moravia to the Village (re: Summer Recreation Program). After some discussion the Board requested a letter of reply be sent back to the Town of Moravia with suggestions pertaining to the program. - Cayuga County Planning Board Land Use Training announcement (4/29/15). - Three press releases from Cayuga County Soil and Water (re: upcoming events). - Cayuga County Association of Villages minutes (2/24/15). On the table for Board review was: - Pictures of streets needing repair throughout the Village. · BUDGET WORK SESSION The Board and Treasurer Susan Wade reviewed and discussed the 2015-2016 Tentative Budget.
