November 16, 2016 TOWN OF NILES BOARD OF APPEALS IN THE MATTER OF APPLICATION For Setback Variance at: 3771 Oak Hill Road In the Town of Niles Case Number: NV2016-3 Tax Map Number: 165.00-1-25.1 The Board of Appeals of the Town of Niles met for a public hearing on November 16, 2016 at 7:00 PM at the Niles Town Hall in New Hope, New York. PRESENT: Elaine Axton, Co-Chairman Donald Klein Ronald Rybak Chad Matijas Kathleen Gorr John Nolte, Alternate Sara Finizio, Secretary OTHERS: Bernard Blowers, Patricia Blowers The public hearing was opened by Co -Chairman Elaine Axton at 7:00 PM. Mrs. Axton asked everyone to stand for the Pledge of Allegiance. A motion was made by Mr. Nolte and seconded by Mr. Matijas to approve the amended minutes from the June 1, 2016 public hearing. Motion carried unanimously. A motion was made by Mr. Klein and seconded by Mr. Rybak to waive the reading of the newspaper article posted in the Citizen on October 26, 2016. Motion carried unanimously. Proof of notice was entered into the record. Neighbors were sent notification of the public hearing. A letter from Sandra Pigula, in favor of the variance, was received. No other correspondence was received. The property for which the variance was requested is located at 3771 Oak Hill Road in the Town of Niles. The relief sought is variance of section 164-8A of the building setback law of the Town of Niles to allow the placement of a building that will be closer than the 75 foot setback from the center of the road. ---PAGE BREAK--- EXHIBITS: Exhibit A – Hand drawing of property. ALLEGATIONS OF APPLICANT: Bernard and Patricia Blowers informed the Board that they would like to place a pre-built 10’ x 16’ storage building on their property at the end of the driveway turn around. They stated that this location would be 45 feet from the center of the road. They also stated that there are other possible locations, but none would allow easy access to store items such as a lawn mower or a snow blower. After questions from the Board members to the applicants, Mrs. Axton closed the public portion of the meeting at 7:14 PM. FINDINGS OF FACT BY THE BOARD OF APPEALS: There would be no undesirable change to the neighborhood. There would be no adverse impact on the environment. Other locations for the building would be possible, but inconvenient. No objections received from neighbors. Any undue hardship would be self created. DECISION: On the basis of the forgoing findings of fact, the setback variance was GRANTED by the following vote: Donald Klein No Elaine Axton Yes Ronald Rybak Yes Chad Matijas Yes Kathleen Gorr Yes A Notice of Action will be forwarded to the applicant. No further applications for this meeting, therefore a motion was made by Mr. Nolte and seconded by Mr. Rybak to close the meeting at 7:17 PM. Motion carried unanimously.
