Page 1 of 6 Village of Fair Haven Budget Hearing & Organizational Meeting April 11, 2016 Board members present Mayor James Basile, Deputy Mayor Walter Krehling, Trustee Judith Dunaway, Trustee Holley Webster-Goolden and Trustee Pete Hanford. Also present DPW Superintendent Roger Granatiero, Clerk-Treasurer Terri DiGregorio, Deputy Clerk Johanne Van Der Linden, Ambulance Supervisor/Zoning Officer Stan was excused, Village Historian Susan Parsons, Vivian Sciarabba, David Lou Speciale, Nanda Speciale, Heidi Smalling, Kevin Hadcock, Sarah Hadcock, Sharon Basile, Elizabeth Basile, Katherine Mack, Col. Walter Burke USAF, Jay Sawyer, Ray Grela, Anita Hadcock, Pat Hanford, Don Chamberlain and Gus Taft. Public Hearing on Budget The 2016-2017 budget is prepared and ready for adoption with a tax rate of $3.676264 per 1000 to raise $338,930.00 (last year’s tax rate was $3.670918). Village assessment is $92,194,129, up by $544,581.00 from last year. Total budget is $1,228,590.00, down $154,139.00 from last year due to the purchase of an ambulance. Kevin Clark of Clark CPA, PC is in receipt of tentative budget and stated it meets with his approval. Water rates will increase due to shortfall in budget. The inside village limits base rate will increase by $1.10 with a 15¢ increase per 1000 gallons. The outside village limits base rate will increase by $1.67 with a 20¢ increase per 1000 gallons. Organizational Meeting The meeting was called to order followed by the pledge of allegiance. Newly elected Mayor James J. Basile recited his oath of office administered by Judge Christopher Palermo. Judge Palermo then administered the oath of office to Trustee Walter J. Krehling and Trustee Judith A. Dunaway. COMMUNICATIONS: The 2015 Annual Quality Water Report has been prepared and is ready for distribution to water customers. Mayor Basile noted no lead violation. Village newsletter was reviewed by the Board for additions or deletions and found it to be complete. Cayuga County Association of Villages (CCAV) meeting will be held on Tuesday April 26, 7pm at the Sunset Restaurant in Auburn hosted by Village of Moravia. Topic: Heroin Epidemic in Cayuga County. Speaker CC Sheriff’s Dept. Detective Sgt. Cornelius. RSVP April 15th. Darrel Uetz attends and Mayor Basile will try to attend. The minutes from the Feb. 24th and March 22nd were reviewed. A speaker for the June CCAV steak bake hosted by Village of Fair Haven will be sought by Mayor Basile and DPW Superintendent Granatiero. It is planned for June 21st at Sabin Hall in the State Park and will be catered by the Corner Stone from Red Creek. In receipt of a letter of resignation from the Zoning Board of Appeals from Richard Fernquist. In receipt of notification of application for a liquor license from Dean and Marikay Fleming by Fair Haven Pizza LLC prospective owners of Guiseppe’s. In receipt of a notice of NYCOM webinar series of training in April. Mayor Basile will enroll in the training for the 12th & possibly the 19th. Deputy Mayor Krehling will enroll in the class on the 14th and Trustee Dunaway will enroll in the class on the 21st. In receipt of a news release and statement from NYCOM Executive Director Peter Baynes on a summary of key aspects of the adopted 2016-2017 State budget and how it effects cities & villages. PUBLIC FORUM: David asked for an update on the person who qualified for the CDBG and had to drop out of the program due to property ownership issues. Trustee Dunaway informed Mr. that it won’t be resolved in time. Mr. inquired about the clock maintenance agreement. The maintenance agreement has been paid with maintenance to be performed this Friday. The Commemorative Park Foundation has been billed for half the cost of the contract. Mayor Basile announced the Fair Haven Beach State Park is now charging 24/7 to get in. A kiosk is located at the gate to deposit funds and obtain a ticket. David mentioned he has a 2:00 appointment tomorrow with Terry Wilbur from Senator Barclay’s office regarding the damage done by the State Park to Lake St. Ext. while renovating the Taft camp rental. ---PAGE BREAK--- Page 2 of 6 MINUTES: The March 14th meeting minutes were approved on a motion by Trustee Webster-Goolden and seconded by Trustee Dunaway. Trustee Dunaway, aye; Deputy Mayor Krehling, aye; Mayor Basile abstained as he was not present at the March meeting; Trustee Webster-Goolden, aye; Trustee Hanford. Motion carried. The April 8th meeting minutes were approved on a motion by Trustee Webster-Goolden and seconded by Deputy Mayor Krehling. All aye, motion carried. ABSTACT #11 VOUCHERS: The following vouchers were approved for payment on a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden. All aye, motion carried. General Fund $30,421.50 Water Fund $37,205.48 Trust & Agency $3,584.26 2013 CDBG: 4,780.00 March Payroll $42,729.84 Budget Modifications General Fund: The following budget modifications were approved on a motion by Deputy Mayor Krehling and seconded by Trustee Webster-Goolden. Transfer $114.77 from contingent to elections contractual Transfer $2,135.07 from ambulance contractual to ambulance contractual/meds/supplies Transfer $120.75 from contingent to snow removal contractual Transfer $2,948.05 from state retirement to snow removal personal services Budget Modifications Water Fund: The following budget modifications were approved on a motion by Deputy Mayor Krehling and seconded by Trustee Dunaway. All aye, motion carried. Transfer $13,871.82 from A202 general fund reserve to source of supply capital improvements COMITTEE REPORTS: March DPW report submitted by Roger Granatiero. Daily check of the pump house; collected water samples and took to Auburn lab for testing; read & replaced water meters; finished street sweeping roads; put plows away then plowed roads one more time; turned on seasonal water: stored snow blower & street sweeper for the season; cleaned trucks inside and out; finished distributing “use only paper bags for leaves” door knob tags; picked up brush; repaired plow damage on various roads; performed 2 final water meter readings; looked into water leak at Guiseppe’s; started york raking various areas; started rolling out plow damage and rough areas in village; Empire Tree finished cutting and trimming trees on list; Town of Sterling helped take tree down at pump house #2 as it was precariously leaning over electrical wires. Another advertisement should be put in the local paper regarding enforcement of paper bags for leaves. It was suggested to place tags on the plastic bags to inform the residents of the change. County inmates are currently raking the parks. The inmates will be available for morning clean-up during the 4th of July celebration except for the morning of July 4th. Roger will make sure the garbage cans are dumped that morning. He is still trying to resolve the brown rot problem with the small trees planted by the NYSDOT on Main Street. It was suggested to call Tree Service. Trustee Webster-Goolden asked to have the parking curb stop pulled out of the water at the Cottage St. boat launch near Little Sodus Inn and requested more signage to control docking at the public dock in that area. Trustee Dunaway inquired about the status of the DPW employees. Roger responded Carrie Bolton was on vacation this week, Greg Webster was out of work on a Worker’s Compensation Claim at least until May 24th and Pete is currently working. The report was accepted on a motion by Trustee Webster- Goolden and seconded by Trustee Dunaway. All aye, motion carried. Roger Granatiero will be attending the NYRWA Annual Training and Workshop May 16-19 held in Lake Placid this year. Sterling Highway Superintendent Brian Soper attended the agenda meeting regarding roads to be paved this year. The Trustees signed the agreements to NOVA chip pave Wilcox St., South Fancher Ave. and Avery St. Parsonage St., South Fancher Ave., Victory St. and Wilcox St. will also be NOVA chip paved. Ingersoll Rd. and North Victory St. will be chip sealed. Funds to pay for these street improvements will come from CHIPS and Village funds. The Village will obtain a copy of the preservation law from the Town of Sterling in hopes to pass a similar law. This law would ensure damage to village streets be repaired by the offender. ---PAGE BREAK--- Page 3 of 6 Treasurer’s report submitted by Terri DiGregorio for period ending 3/31/2016. Account balances are as follows: General fund is $278,527.15 includes WBB CD $4,226.69, Water fund $83,844.07, 2001 CDBG $1,013.65, Trust & Agency $538.94, $3,888.07, 2013 CDBG $1.00. The report was accepted on a motion by Trustee Webster-Goolden and seconded by Trustee Hanford. All aye, motion carried. March Ambulance report submitted by Stan The ambulance service answered 33 calls: 1 BLS, 24 ALS, 4 no transport. A total of 103 calls to date. Of these 30 calls 4 were in the Village, 6 in the Town of Sterling, 1 in the Town of Martville, 18 mutual aid to Lakeshore Ambulance, 1 mutual aid to CIMVAC. Vehicles responding to calls: 12 for Ambulance 4 for Ambulance 14 for Medic Car, 3 for both the medic car and ambulance together. The response time was 3.04 minutes with a big thank you to the fire department who supply drivers. The report was accepted on a motion by Trustee Webster-Goolden and seconded by Trustee Dunaway. All aye, motion carried March Code Enforcement report submitted by Stan 1 building permit issued; 2 building permits were submitted and sent to the ZBA for variance request; 8 violation letters sent; 4 general village inspections performed. In the process of citing bay front residents who have failed to connect to the public sewer. The report was accepted on a motion by Trustee Webster-Goolden and seconded by Trustee Hanford. All aye, motion carried. The Board would like a report on the status of sewer connections in the Village. UNFINISHED BUSINESS: 2013 CDBG update: The Village received notification the grant deadline was extended to July 1st to complete construction on 4 approved projects which haven’t been started yet. A new water meter was installed for the state park in February so the Village can get a better idea how much water the entire park is using. The 20 year agreement signed in 1992 stating the park will pay a flat rate of $12,000.00 a year for water has expired. The Fair Haven Beach State Park is located partially in the Village of Fair Haven and Town of Sterling. Since there is no way to determine how much water is being used at the inside rate and outside rate, the Village will have to come up with a combined rate if and when billing commences according to usage. Sabin Hall and the camps on Lake St. Ext. are currently metered separately. The State Park Superintendent will be contacted regarding water connections and invited to the next meeting. NEW BUSINESS: DESIGNATING A “SECTION 3 COORDNATOR” FOR THE VILLAGE OF FAIR HAVEN WHEREAS, the United States Congress passed the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (“Section and WHEREAS, the purpose of “Section 3” is to ensure that employment and other economic opportunities generated by certain federal assistance, including assistance provided by the U.S. Department of Housing and Urban Development (HUD) or HUD-assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing, and WHEREAS, the Village of Fair Haven is currently and anticipates it will continue in the future to be a recipient of certain HUD assistance covered by Section 3, and WHEREAS, HUD and the administrative entity of HUD’s Small Cities Program in the State of New York, the Housing Trust Fund Corporation, have determined that Community Development Block Grant grantees must designate a municipal employee to serve as the Section 3 Coordinator to facilitate compliance with Section 3, and WHEREAS, it will be the job of the Section 3 Coordinator to prepare, implement and undertaken certain plans and procedures to facilitate compliance with Section 3 to the greatest extent feasible, NOW, THEREFORE, BE IT RESOLVED that the Village of Fair Haven Board of Trustees does hereby designate Terri DiGregorio, Village Clerk-Treasurer, and her successor at such time Terri DiGregorio no longer serves in the capacity of Village Clerk-Treasurer, as the Section 3 Coordinator. ---PAGE BREAK--- Page 4 of 6 On a motion by Trustee Dunaway and a second by Trustee Webster-Goolden the resolution was approved. DiGregorio, Clerk Treasurer RESOLUTION OF THE VILLAGE OF FAIR HAVEN AUTHORIZING THE ASSIGNMENT OF OBLIGATIONS FOR PROPERTY LOCATED AT 591 MAIN ST., FAIR HAVEN, NY UNDER GRANT AGREEMENT AND NEW YORK MAIN STREET PORGRAM PROPERTY MAINTENANCE DECLARATION FORM DATED JULY 8, 2015 WHEREAS, The Village of Fair Haven (the “Village”), acting as the Local Program Administrator (the “LPA”) of New York Grant No.: NYS SHARS 20120155, and Renee Griffin (the “Recipient”), owner of commercial premises located at 521 Main St., Fair Haven (the “Premises”), entered in to an agreement entitle New York Main Street Program Property Maintenance Declaration Form (the “Agreement”) in connection with an award of $26,075.00 dollars to Recipient as part of the New York Main Street Revitalization Program (the “Grant”), recorded on the November 3, 2015 in Liber 1603 of Misc. Deeds at page 226 in the Office of the Cayuga County Clerk; and WHEREAS, the Agreement prohibits Recipient from, among other things, selling the Premises without prior written consent of the Village for the five year which term expires on July 2020; and WHEREAS, under the terms of the Grant, the Village may consent to a transfer of title to the Premises provided the terms and conditions of the Agreement are assigned and accepted by the subsequent purchaser and such purchaser duly executes an Amended New York Main Street Program Property Maintenance Declaration Form (the “Amended Agreement”); now, therefore, be it RESOLVED, that the Village of Fair Haven hereby consents to the sale of the Premises conditioned upon the purchaser executing the Amended Agreement, a copy of which is attached hereto; and be it further RESOLVED, that said Amended Agreement be recorded in the Office of the Cayuga County Clerk upon transfer of the Premises by the Recipient. All aye, motion carried. Fair Haven Fire Department representatives will be invited to the June 9th agenda meeting. Board of Trustees meetings are held on the 2nd Monday of the month at 7:00 p.m. Board of Trustees agenda meetings are held on the Thursday before the 2nd Monday of the month at 6:30 p.m. Planning Board meetings are held quarterly at 7:00 p.m. and as needed Zoning Board of Appeals meets as needed Resolution for Advance Approval of Claims WHEREAS the board of trustees has determined to authorize payment in advance of audit of claims for public utility services, postage, freight and express charges; and WHEREAS all such claims must be presented at the next regular meeting for audit; and WHEREAS the claimant and the officer incurring or approving the claim are jointly and severally liable for any amount the board of trustees disallows. NOW THEREFORE BE IT RESOLVED that the Board of Trustees authorizes the Village Clerk- Treasurer to make payment in advance of audit of claims for public utility service, postage, freight and express charges on a motion by Trustee Webster-Goolden and a second by Deputy Mayor Krehling. Resolution for Mileage Allowance WHEREAS the board of trustees has determined to use the same rate for mileage as the IRS establishes, which is .54 cents per mile as of January 1, 2016 and will update accordingly for reimbursement to Village officers and employees who use their personal automobiles while performing their official Village duties; NOW THEREFORE BE IT RESOLVED that the Board of Trustees has determined to use the same rate for mileage as the IRS establishes effective immediately upon a motion by Trustee Hanford and a second by Deputy Mayor Krehling. All aye, motion carried. ---PAGE BREAK--- Page 6 of 6 Resolution for Attendance at Schools and Conferences WHEREAS there is to be held during the coming official year a) the New York State Conference of Mayors Annual Meeting and Training School; b) the New York State Conference of Mayors and Fall Training School for Fiscal Officers and Municipal Clerks; c) the New York State Conference of Mayors Public Works School; d) Municipal Clerks Institute at Cornell; e) County Association Meetings; etc: and WHEREAS attendance by certain municipal officials and employees at one or more of these meetings, conferences or schools benefits the municipality; NOW THEREFORE BE IT RESOLVED that the Board of Trustees authorizes designated employees to attend training effective immediately upon a motion by Deputy Mayor Krehling and a second by Trustee Dunaway. All aye, motion carried. There is one vacancy on the Planning Board with a term that expired 4/4/2016. Mark Cooper and Vivian Sciarabba have applied for that vacant position which has a 5 year term. Current member Paul Fallon whose term expires on 4/3/2017 would like to transfer to the Zoning Board of Appeals. There is one vacancy on the Zoning Board of Appeals with a term that expired on 4/4/2016. H. Vincent Reynolds has applied for the vacant position which has a 5 year term. Current members Christopher Drogi and Susan Stanistreet are up for reappointment as of 4/4/2016 and have expressed an interest in remaining on the board for 5 more years. The Board of Trustees decided to extend the current terms for Susan Stanistreet and Christopher Drogi to the next Board meeting on May 9th. They also wish to make any decisions on appointments at that same meeting on a motion by Trustee Dunaway and Trustee Webster- Goolden. All aye, motion carried. BUDGET ADOPTION: The budget hearing was closed on a motion by Trustee Webster-Goolden and seconded by Deputy Mayor Krehling. All aye, motion carried. The 2016-2017 Village of Fair Haven Budget was adopted on a motion by Deputy Mayor Krehling and seconded by Trustee Webster-Goolden.
