VILLAGE BOARD MEETING OCTOBER 24, 2016 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Tony Peppe, and Chris Fulton were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, and Officer in Charge Robert Brown were also in attendance. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the minutes for the October 11, 2016 Village Board Meeting. · BILLS A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bill #96 due to conflict of interest.) · DEPARTMENT REPORTS Each of the Trustees received a new Justice Building Inspection Report from Trustee Fickeisen and Trustee Fulton. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Justice Building Inspection Report. It was noted that there was no Dog Control Report for the month of September. · CABLE Mayor Mulvaney reminded the Board of the Public Hearing tentatively scheduled for December 12, 2016. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW WATER METER REPLACEMENT Mayor Mulvaney reported that no new water meters were installed so far this month. · VILLAGE ORDINANCES Mayor Mulvaney reminded the Board of the Public Hearing scheduled for the next regularly scheduled Board meeting on November 14, 2016 for Local Law #3 “Regulating Open Burning.” ---PAGE BREAK--- · ZONING AMENDMENTS (PLANNING BOARD) At the last Board meeting, each of the Trustees received a draft copy of the Site Plan Review received from the Village of Moravia Planning Board that would amend the Village’s Zoning Law. Village Clerk Anne Riddell reiterated that all the changes that the Board of Trustees had requested had been updated. The Board discussed their concern for the enforcement of the Site Plan Review. Village Clerk Anne Riddell also stated that Village Attorney Charles Marangola expressed his concern to her pertaining to the “generality” of the law. The Board directed the Village Clerk Anne Riddell to ask Attorney Marangola to be more specific and that they would address his concerns. This item was tabled until the next regularly scheduled Board meeting. · SOLAR POWER GRANT (WWTP) Mayor Mulvaney stated that there was no update or news on the Solar Power Grant for the Wastewater Treatment Plant. This item was tabled until the next regularly scheduled Board meeting. · OAK HILL GRAVEL PIT Mayor Mulvaney stated that the area where the decibel sign posts was marked and that the signs are supposed to be put in place this week on Oak Hill Road. This item was tabled until the next regularly scheduled Board meeting. · MEMORANDUM OF UNDERSTANDING (CC 911 CENTER) Mayor Mulvaney stated that he was unable to speak with the Village Insurance Agency (Kilborne Insurance Agency). Mayor Mulvaney did speak with Cayuga County Sheriff David Gould, and Sheriff Gould had stated he was unaware of the Memorandum of Understanding since it derived from the Cayuga County 911 Center. Officer in Charge Robert Brown stated that he’d invited Denise Spingler (Cayuga County 911 Center) to attend a Board meeting to explain and answer any questions that the Board may have. Mayor Mulvaney reminded the Board that the last time this Memorandum of Understanding was brought to the Board that the Board had cancelled their agreement because of not having insurance coverage for the Village police if called out of the Village of Moravia to assist the Cayuga County Sheriff’s Department. This item was tabled until the next regularly scheduled Board meeting. · VILLAGE EMPLOYEE HEALTH INSURANCE SYNOPSIS (2017) Each of the Trustees received a copy of a comparison of Excellus BlueCross BlueShield plans for the Village Employee Health Insurance for 2017. The Board reviewed and discussed the three options given by The Finger Lakes Group, LLC. (It was noted that the Village’s current health insurance plan would not be available in 2017.) A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Excellus Silver 14 Plan for 2017 for the Village employees for 2017 (Premiums: Individual $478, Employee/Spouse $956, Employee/Child $812, Family $1,362 per month.) · LAW FOR EROSION AND SEDIMENT CONTROL (CAYUGA COUNTY PLANNING) ---PAGE BREAK--- At the last Village Board meeting, each of the Trustees received an email and a sample Law for Erosion And Sediment Control from the Cayuga County Planning Department for the Board to consider. Village Clerk Anne Riddell stated that she had contacted Tim Buhl and he stated that the NYSDEC currently has a law for erosion and sediment control and was unsure as to why the Village of Moravia would need/want this as their local law. She reported that she also contacted John Zepko (Planner for the Cayuga County Planning Department) and he had stated that by enacting the local law, it would transfer the power and authority from the NYSDEC to the Village. After some discussion about the law and about the enforcement of the law, the Board agreed to keep the law the way it was (with the NYSDEC) as they have more expertise pertaining to erosion and sediment control than the Village of Moravia. The Board directed Village Clerk Anne Riddell to send a thank you letter to Mr. Zepko; however the Board would like to keep the power and authority with the NYSDEC. · 2016 DELINQUENT TAXES TO COUNTY Each of the Trustees received a copy of the 2016 delinquent Village of Moravia taxes to be turned over to Cayuga County for collection. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to send the delinquent Village taxes in the amount of $17,430.65 to Cayuga County for collection by inclusion on the 2017 Town/County tax bill. · BURKHART SEWER AGREEMENT Each of the Trustees received a copy of the sewer agreement for Daniel Burkhart at 4947 Skinner Hill Road. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to authorize the Mayor to sign and send the sewer agreement to Daniel Burkhart for his property located 4947 Skinner Hill Road, Moravia for two years. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - Cayuga County Association of Villages Minutes (09/27/16). - Owasco Lake Watershed (3rd Party Plan & Implementation Fund) – email. - Letter from Mayor and OIC Rob Brown (re: MPD Grant – Senator Seward). The Board received three estimates for the repair of the 2007 Crown Victoria Police Car. Mayor Mulvaney requested warranty information. Trustee Fickeisen and Trustee Peppe stated that they would report back to the Board at the next regularly scheduled Board meeting. Trustee Peppe responded to some of the Board’s questions that they had at the last Board meeting pertaining to the Summer Recreation Committee report. The Board thanked him for responding so quickly! (This will remain on the Quarterly Open Agenda Items.) Trustee Fickeisen stated that he is compiling a list of dangerous sidewalks within the Village that are in dire need of repair. (According to Local Law #1 of 1997 Sidewalk Repair and Maintenance, this is the property owner’s responsibility.) Trustee Fickeisen reported what he believed to be the most dangerous sidewalk in the Village and requested a letter be sent to the property owner. The Board directed Village Clerk Anne Riddell to send a letter to the property owner along with a copy of the law. ---PAGE BREAK--- A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to enter Executive Session at 8:01 p.m. to discuss personnel.
