TOWN OF STERLING PLANNING BOARD MEETING June 1, 2017 A regular meeting of the Town of Sterling Planning Board was held on Thursday June 1, 2017 at the Sterling Town Hall at 7:00 pm with the following members present: • June Ouellette ~ Chairman • Sue Allen ~ Member • Vernon Bishop ~ Member Absent: Members Scott Crawford and Paul Kelley Also Present: Irene Grandazzo, Judy Woodworth, Surveyor Erik Svereika and Russell Patchen. Chairman Ouellette called the meeting to order at 7:00 pm. PUBLIC HEARINGS Judy Woodworth Chairman Ouellette read the notice into the record and opened the Hearing at 7:01 pm. Notice is hereby given that the Planning Board of the Town of Sterling will hold a Public Hearing on Thursday June 1, 2017 at 7:00 PM at the Sterling Town Hall, 1290 State Route 104A, Sterling, NY 13156. An Application for the Review of Subdivision by Judy Woodworth will be heard regarding the Minor Subdivision of property located at 1778 Laxton Road, Sterling, NY 13156; Tax Map # 10.00-1-47.1. All those wishing to be heard in favor of or in opposition of said application may appear in person or by other representation at said time and place. By order of the Planning Board Lisa Somers, Clerk Judy Woodworth approached the Board and briefly explained for the audience present the proposed subdivision of a single parcel from her property on Laxton Road. The Board reviewed the application which had minor changes initialed by the applicant at the last meeting in May. The SEQR short form EAF Part I had also been reviewed in May with a few changes initialed by the applicant, the Board completed parts II and III. The Hearing was opened for public comments and left open for half an hour to ensure the possibility of public comments. Without any further comments from the Board or public, the Hearing was closed at 7:30 pm on a motion moved by Member Allen and seconded by Member Bishop. All were in favor and the motion carried. Chairman Ouellette declared that the proposed action of subdivision is classified as an Unlisted action as defined by SEQR and will not have any adverse environmental impacts. A motion to approve the Minor Subdivision of property owned by Judy Woodworth was moved by Member Bishop and seconded by Member Allen, all were in favor without further discussion and the motion passed. Resolution 2017-01 BE IT RESOLVED, by the Planning Board for the Town of Sterling, upon the facts presented and the determination made, that the application for a Minor Subdivision of property owned by Judy Woodworth and located at 1778 Laxton Road, Sterling, NY 13156; Tax Map # 10.00-1-47.1 is hereby GRANTED upon the following express conditions: NONE but to be filed with Cayuga County within 62 days. An Application for the Review of Subdivision by Dilicia Sealey and Rafeal Hylton will be heard regarding the Minor Subdivision of property located at1876 Andrews Road, Sterling, NY 13156; Tax Map # 7.00-2-31.1. All those wishing to be heard in favor of or in opposition of said application may appear in person or by other representation at said time and place. By order of the Planning Board Lisa Somers, Clerk Land Surveyor, Erik Svereika, is representing the property owners that live in California and Florida. He presented a subdivision application with containing notarized signatures of both property owners, which the Board accepted. The Board reviewed the maps and found that Mr. Svereika had added the dimension between the well and property line (55’) as had been requested. He also presented a completed SEQR short form EAF Part I which the Board proceeded to review. Question #8 was changed to no for availability of public transportation at project site – the applicant had written in Andrews Road and the Board interpretation of that question is public bus routes. Question # 13 was changed to yes because the DEC’s EAF Mapper program triggered a yes response due to the abundance of wetlands and regulated bodies of water in the area. The applicant initialed both changes. The Hearing was opened for public comments and left open for half an hour to ensure the possibility of public comments. Roll call vote was taken: Chairman Ouellette Aye Member Allen Aye Member Bishop Aye Member Kelley Absent Member Crawford Absent 3 AYES 0 NAYES 0 ABSTENTIONS – APPROVED BUSINESS ---PAGE BREAK--- Russell Patchen – Sketch plan Conference for Minor Subdivision Mr. Patchen approached the board with a survey map of his property on the corner of Sterling Station Road and Fintches Corners Road. He would like to subdivide 3.5 acres with 570’ of road frontage at the end of the property to create a parcel for his son whom already has a residence in this location. The Board reviewed the proposed parcel with the dimensional regulations of the LUR and found the parcel to be compliant. He was given an application to complete, inclusive of a SEQR EAF, and told to return with one paper copy of the survey completed with all of the required elements for a preliminary review. Noah Richardson The Planning Board had been approached in April by Noah Richardson for an approval of a proposed Mobile Processing Unit for slaughtering chickens. After reviewing the Usage Table in Article 8-2 of the LUR, the Board was unsure as to how they should classify the project and agreed to consult the Town Attorney before proceeding. An opinion was received from the Attorney in that the use described by the applicant would constitute a home occupation and therefore be subject to CEO special condition review under LUR Article 9-3(J). A motion was made by Chairman Ouellette to designate the use as a ‘Customary Home Occupation’ and therefore subject to CEO special condition review under LUR 9-3(J). The motion was seconded by Member Allen, and without further discussion, all were in favor and the motion carried. MINUTES A motion to approve meeting minutes for May 4, 2017 with minor corrections was moved by Member Bishop and seconded by Chairman Ouellette. All were in favor without further discussion and the motion passed. ADJOURN On a motion by Member Bishop and seconded by Chairman Ouellette, the meeting was adjourned at 9:03 pm.
