Page 1 of 2 Village of Fair Haven Zoning Board of Appeals Hearing April 4, 2017 The hearing began at 7:00 p.m. Zoning Board of Appeals (ZBA) members present Chairman Christopher Drogi, Susan Stanistreet, Jimmy Kawar, Paul Fallon and alternate Sharon Basile. Dave Guynn was excused. Also present Clerk-Treasurer Terri DiGregorio and 9 guests. The Board members introduced themselves and Chairman Chris Drogi explained hearing procedures reminding everyone that this hearing was a continuation of the hearing from March 8th as additional information was needed for the Board to make a decision. Clerk-Treasurer DiGregorio acknowledged the hearing was properly advertised and posted. Brandon Furber is requesting an area variance for relief from provisions of Zoning §150-8 to place a second residence “Tiny Home” on his property located at 14504 Fancher Ave. tax map #8.20-2-19. Chairman Chris Drogi explained Mr. Furber is requesting to split his current property into two separate 50’wide x 132’ deep lots to build a small house on the newly created lot to the south. The hearing was adjourned to this date so Mr. Furber could obtain documentation from the Village of Fair Haven regarding water service at that location. He was also required to obtain documentation from the Cayuga County Water & Sewer Authority regarding connection to the public sewer. Both entities responded they are willing to work with Mr. Furber. Concerns by the Zoning Board of Appeals and guests: • The lot to the north containing the present residence would no longer have parking as the parking area would be in front of the newly created property. Parking on Fancher Ave. is presently at the minimum. • If the property was split it could be sold as a separate lot. • Another alternative would be to construct an addition to the present house. • The neighbor to the south of the property in question noted his survey reflected the property line being several feet closer to the applicant, therefore clarification of the south property line is in question. • Creating non-conforming lots in the Village of Fair Haven is not believed to be the goal of the Zoning Board of Appeals. The hearing was closed to public comment. The ZBA members reviewed the five criteria to make a decision: 1. Whether an undesirable change will be produced in the character of the neighborhood 2. Whether the applicant can achieve his goal by other means 3. Whether the variance is substantial 4. Whether the variance will have an adverse impact on the neighborhood or environment 5. Whether there has been a self-created difficulty The variance request was denied on a motion by Paul Fallon and a second by Jimmy Kawar. All aye, motion carried. ---PAGE BREAK--- Page 2 of 2 OLD BUSINESS: • The ZBA requested the Board of Trustees update the zoning to match the NYS zoning. • The ZBA would like to see the application criteria be changed to submit plans “to scale”. NEW BUSINESS: • ZBA member Jimmy Kawar’s resignation was accepted. Two letters of interest have been received so far regarding this vacant position. • A new fence has been recently constructed at 760 Main St. It is now believed this property is in the Town on Sterling and not in violation of the Village of Fair Haven fence law. • May 2nd at 7:00 p.m. is the date scheduled for Terry Mayville’s request for a use variance and John Gadjo’s request for an area variance. • The Tanner Brant resolution on the decision to deny the use variance to operate an automotive repair business was signed and a copy will be mailed to Mr. Brandt. MINUTES: The March 8, 2017 minutes will be reviewed and considered for approval at the next meeting.
