VILLAGE BOARD MEETING MARCH 28, 2016 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:04 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Anthony Peppe, and Chris Fulton were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Ray Dyer, III (Southern Cayuga County Cablevision), and Attorney Thomas Blair were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · PUBLIC HEARING – LOCAL LAW #1 OF 2016 REGULATING NOISE WITHIN THE VILLAGE OF MORAVIA Mayor Mulvaney opened the Public Hearing at 7:04 p.m. for proposed Local Law #1 of 2016 entitled “Regulating Noise Within The Village Of Moravia” with a motion from Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the minutes for the March 14, 2016 Village Board Meeting. · BILLS A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bills #364 and #372 due to conflict of interest.) · TRANSFERS From: A1990.4 Contingent To: A9040.8 Workers Comp. $ 3,015.69 From: G1990.4 Contingent To: G8110.4 Sewer Admin. $ 1,000.00 · DEPARTMENT REPORTS A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Dog Control Report for the month of February. A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Code Enforcement Report for the month of February. · CABLE A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to enter Executive Session at 7:11 p.m. with Attorney Thomas Blair present, to discuss contract negotiations. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to exit Executive Session at 7:53 p.m. ---PAGE BREAK--- Mayor Mulvaney addressed Ray Dyer, stating the Village’s concern for having an expired contract with Southern Cayuga County Cablevision. Mr. Dyer suggested extending the expired contract and then the Village could negotiate with Zito Media. Attorney Thomas Blair stated that he thought it would be in the best interest of the Board to get an updated contract from either Mr. Dyer or Zito Media and present it to the Board. After some discussion, Mayor Mulvaney asked Mr. Dyer if it would be acceptable by him for the Village to contact and work with Zito Media pertaining to a contract. Mr. Dyer agreed. Attorney Thomas Blair stated that he would contact Zito Media tomorrow and discuss the contract with them directly. · DRAFT LOCAL LAW #2 OF 2016 (REIMBURSEMENT FOR PRO CONSULT FEES) Each of the Trustees received a copy of the proposed Local Law #2 of 2016 entitled “Reimbursement Of Professional Consultation Fees”. After some discussion, a motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to publish and hold a public hearing on Monday, April 11, 2016 at 7:00 p.m. for Local Law 2 of 2016 entitled “Reimbursement Of Professional Consultation Fees”. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW WATER METER REPLACEMENT Mayor Mulvaney reported that new meters were going to start being put in three days a week starting next week by Dick Phoenix (Wastewater Treatment Plant) and Bill Smith (Department of Public Works). · VILLAGE ORDINANCES Mayor Mulvaney noted that the Board had opened the Public Hearing for Local Law #1 of 2016 pertaining to “Noise”. · WATER LEAK DETECTION UPDATE Mayor Mulvaney reported that there was no news on the Water Leak Detection from NYLD. · CABLE AGREEMENT See “Cable” agenda item above. · ZONING AMENDMENTS (PLANNING BOARD) Mayor Mulvaney reported that there was no news from the Village Planning Board pertaining to the Zoning Amendments. ---PAGE BREAK--- · SOLAR POWER GRANT (WWTP) Each of the Trustees had received notification from the Central New York Regional Planning & Development Board pertaining to “Solarize CNY” at the last Board meeting. After some discussion, Mayor Mulvaney stated that this would have to be reviewed and explained further and would contact Sean Cochran of the Wastewater Treatment Plant. · OAK HILL GRAVEL PIT Each of the Trustees received a letter from the NYSDEC in response to the Village Board’s comments on the Oak Hill Gravel Pit. The revised SEQR and a copy of a letter dated November 18, 2105 from Guttman Reiter (Attorneys at Law) pertaining to enlargement of the use of the property were on the table for their review. · WILLIAMSON LAW SOFTWARE SUPPORT (PAYROLL) A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the annual payroll software support contract with Williamson Law for a total of $730.00. · APRIL FAIR HOUSING PUBLIC NOTICE A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to declare April as Fair Housing Month and to publish the notice. · SET PUBLIC HEARING FOR 2016-2017 BUDGET A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to set the public hearing for the Village of Moravia 2016-2017 budget for Monday, April 11, 2016 at 7:15 p.m. · LETTER OF RESIGNATION (BECK – MPD) Each of the Trustees received a copy of a letter of resignation from the Village’s Part-Time Police Officer Michael Beck. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to accept the letter of resignation from Part-Time Police Officer Michael Beck, effective March 27, 2016. (It was noted that an appreciation letter would be sent to Officer Beck for his service to the community. The Board also directed that Officer In Charge Rob Brown be contacted to ensure that the Village’s belongings were returned.) · EMPLOYEE APPLICATION (DEARDEN) ---PAGE BREAK--- An application for employment from David Dearden for Laborer was on the table for Board review. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to accept and place on file the employment application from David Dearden. · INFORMATIONAL ITEMS The Village Board of Trustees each received a copy of the Cayuga County Association of Villages Minutes (02/24/16). · CLOSE PUBLIC HEARING A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to close the Public Hearing on Local Law #1 of 2016 at 9:01 p.m. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to adopt the following resolution on Local Law #1 of 2016 entitled “Regulating Noise Within The Village Of Moravia”. WHEREAS, a public hearing was duly held on March 28, 2016, by the Village of Moravia, New York, with regard to Local Law No.1 of the Year 2016, a Local Law pertaining to “Regulating Noise Within The Village Of Moravia”, NOW, THEREFORE, BE IT RESOLVED BY THE Village Board of the Village of Moravia, New York as follows: The Village Board of the Village of Moravia, New York, hereby adopts Local Law No. 1 of the Year 2016, a Local Law pertaining to “Regulating Noise Within The Village Of Moravia”. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Anthony Peppe voting yes Gary Fickeisen voting yes Nancy McGuerty voting yes Christopher Fulton voting yes · BUDGET WORK SESSION The Board and Treasurer Susan Wade reviewed and discussed the 2016-2017 Tentative Budget.
