VILLAGE BOARD MEETING OCTOBER 11, 2016 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton, and Anthony Peppe were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Code Enforcement Officer Fred Delaney, and Officer In Charge Rob Brown were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the minutes for the September 26, 2016 Village Board Meeting. · BILLS A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bills #183, 84, and 126 due to conflict of interest.) · DEPARTMENT REPORTS A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Treasurers Report for the month of September. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Public Works Report for the month of September. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Water Meter Replacement Report for the month of September. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Fuller Park Inspection Report for the month of September. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of September. A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of September. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Police Report for the month of September. Officer in Charge Rob Brown distributed a copy of a Memorandum of Understanding “Cayuga County 911 Center Dispatch Procedures For Requests For Police Services Nearest Available Unit Concept.” Mayor Mulvaney stated that this had been addressed before in the past and after signing the MOU the Village of Moravia had cancelled the agreement due to insurance reasons. Officer in Charge Rob Brown stated that he spoke with the Village’s insurance company and that the Village would be covered except for the Workers’ Compensation. After some discussion, this item was tabled until the next regularly scheduled Board meeting. ---PAGE BREAK--- A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the written and verbal Code Enforcement Report for the month of September. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Report for the month of September. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of September. It was noted that there was no Dog Control Report for the month of September. · CABLE Each of the Trustees received an updated and final copy of the Franchise Agreement with Zito New York, LLC from Attorney Thomas Blair. Attorney Blair also sent an email that if the Board approved of the Franchise Agreement, the Village could hold a public hearing on December 12, 2016. After some discussion, Mayor Mulvaney requested the Board review the Franchise Agreement prior to the next meeting. This item was tabled until the next regularly scheduled Village Board meeting. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above). · VILLAGE ORDINANCES Each of the Trustees received an email John Zepko, Cayuga County Department of Planning and Economic Development Planner, stating that the review for the proposed Open Burning Law that was submitted for 239 Review was not required in order for the Village to adopt. Mayor Mulvaney reminded the Board that the Public Hearing for Local Law #3 of 2016, entitled “Regulating Open Burning” would be held on Monday, November 14, 2016. · ZONING AMENDMENTS (PB) Each of the Trustees received a draft copy of the Site Plan Review and Approval received from the Village of Moravia Planning Board that would amend the Village’s Zoning Law. Village Clerk Anne Riddell stated that all the changes that the Board of Trustees had requested had been updated. (A copy of the Planning Board Minutes from October 19, 2015 was also distributed.) After some discussion, Mayor Mulvaney requested the Board to review prior to the next meeting. This item was tabled until the next regularly scheduled Village Board meeting. · SOLAR (STP) The Board received a copy of an email from Chris Carrick updating the Village on the SolarizeCNY solar procurement process for the Sewer Treatment Plant. It stated that the Request for Proposals would be published ---PAGE BREAK--- the end of September and the beginning of October. This item was tabled until the next regularly scheduled Board meeting. · OAK HILL GRAVEL PIT Mayor Mulvaney stated that the signs are to be marked out and put in place within the next week, or so. This item was tabled until the next regularly scheduled Board meeting. · SUMMER RECREATION COMMITTEE REPORT (PEPPE) Each of the Trustees received a copy of letter from the Town of Moravia pertaining to the Summer Recreation Program and notes that were taken by Trustee Peppe at the last meeting. Trustee Peppe gave a review from the Summer Recreation Committee meeting he attended recently. After some discussion and questions from the Board, Trustee Peppe stated he would report back to the Board. Mayor Mulvaney placed this agenda item on the Quarterly Open Agenda Items. · QUARTERLY FAIR HOUSING PUBLIC NOTICE A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the advertising of the Quarterly Fair Housing Public Notice. · LAW FOR EROSION AND SEDIMENT CONTROL (CC PLANNING) Each of the Trustees received an email and a sample Law for Erosion And Sediment Control from the Cayuga County Planning Department for the Board to consider. After some discussion, the Board directed Village Clerk Anne Riddell to contact Tim Buhl requesting his input and advice. This item was tabled until the next regularly scheduled Board meeting. · INFORMATIONAL ITEMS Trustee Peppe and Trustee Fickeisen gave a report on receiving more estimates on the repair of the 2007 Crown Victoria Police Car. They stated that they had only been able to receive one estimate so far from Webster’s Garage to replace the transmission. Trustee Peppe and Trustee Fickeisen stated that they would report to the Board at the next regularly scheduled Board meeting with more estimates. On the table for Board review was: - Vehicle Log Sheets for the month of September. - FAX from a Village resident. Each of the Trustees received a copy of the following: - Village of Moravia Employee work Policy. - Cayuga County Association of Villages Agenda (10/25/16). - Town of Moravia Minutes (08/17, 08/31 & 09/14/16). A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to enter Executive Session at 8:38 p.m. to discuss personnel.
