TOWN OF MENTZ REGULAR MEETING JUNE 19, 2018 Supervisor Nielens called the meeting to order at 7:03 PM and led the Pledge of Allegiance to the Flag and asked for a moment of silence. Members Present: Supervisor Nielens, Councilman Mark Emerson, Councilwoman Barbara Clancy, Councilman Jeff Mills, Councilman Matt Poyneer was absent. Others Present: Attorney Kevin Cox, Town Clerk Charleen Wood, Deputy Town Clerk/Cemetery Superintendent Lucy Ware, Highway Superintendent David Nielens, Planning Board Jeff Emerson, Code Enforcement Officer Jay Moose and Matt Schooley of B & L. Minutes Approval: Minutes of the May 15, 2018 Meeting: Motion made by Jeff Mills and seconded by Mark Emerson to accept/approve the minutes as presented. Motion carried 4-0 with Matt Poyneer absent. Budget Transfer: Motion made by Richard Nielens and seconded by Jeff Mills to make with following transfer: FROM: B1990.4-$30.00 TO: B7520.4-$30.00 Motion carried 3-0-1 with Mark Emerson abstaining and Matt Poyneer absent. Audit of Bills: Motion made by Jeff Mills and seconded by Barbara Clancy to approve the following audit of bills with Mark Emerson abstaining from B-11. Motion carried 4-0 with Matt Poyneer absent. General A $21,780.86 VO 138-167 Highway DB $ 3,036.49 VO 39-45 General B $ 773.72 VO 11-12 TA $ 1,645.82 VO 11-12 DA $17,594.31 VO 17 Old Business: Highway Department Cell – this number will be kept and forwarded to the Highway Superintendents personal cell phone. Then he will only have to carry one phone. ---PAGE BREAK--- Swim Lessons – the Village agreed that swim lessons should be in February, therefore, we will put it in the 2019 budget Maiden Lane Cemetery Wall – expense for this wall will be put in the 2019 budget New Business: Assessor Report – Jeff Lowe – stated that new software would be put in place the fall of 2019 which will cause confusion. We probably should have a re-val in about 2 years. Mr. Lowe stated that our low-income level is $16,700 and the county is $25,100. He recommends that the Town match the County standard. Motion made by Barbara Clancy and seconded by Jeff Mills to approve an expenditure of up to $300 for paint for the front of the building with the inmates doing the painting. Motion carried 4-0 with Matt Poyneer absent. Award the NY Central Bridge Contract – Matt Schooley – after the review of 6 bids B & L recommended New Century Construction of Watervliet, NY with a bid of $1,274,400.00. Construction will start after the 4th of July and will be completed around November 1. Motion made by Jeff Mills and seconded by Mark Emerson the following award: WHEEAS, by letter dated June 10, 2018, after receiving and evaluating the bids received by six contractors, Barton & Loguidice has recommended to the Town Board that it award the contract in the amount of $1,274,400 for the New York Central Road over Owasco Bridge Replacement Project (BIN 2206870) to the lowest responsible bidder, that being New Century Construction, LLC, 11 Arch Street, Watervliet, NY 12189; and WHEREAS, the Town Board of the Town of Mentz has reviewed the recommendation and low bid analysis provided by Barton & Loguidice; NOW, THEREFORE, BE IT RESOLVED, at a regular meeting of the Town Board on June 19, 2018, that the Town Board of the Town of Mentz, hereby accepts the bid recommendation of Barton & Loguidice, and approves the award of the contract in the amount of $1,274,400.00 for the New York Central Road over the Owasco Bridge Replacement Project (BIN 2206870) to New Century Construction, LLC; and IT IS FURTHER RESPOLVED, that the Town does hereby authorize the Town Supervisor to sign the award recommendation provided by Barton & Loguidice and by so doing, request that the NYSDOT provide its concurrence of the award of the subject contract to New Century Construction LLC Roll Call Vote: Ayes: 4 Nos: 0 ---PAGE BREAK--- Supervisor Nielens: AYE Councilman Emerson: AYE Councilwoman Clancy: AYE Councilman Mills: AYE Councilman Poyneer: ABSENT Re-Watering the Canal – Supervisor Nielens stated that the cost for each municipality to participate in the project was approximately $47,000 for the design. The Village of Port Byron is pulling out as well as the Town of Mentz as it is cost prohibitive. The board created a task force to explore options for cleaning the canal. Motion made by Jeff Mills and seconded by Barbara Clancy appointing Jeff Emerson and Mark Emerson to this task force. Motion carried 4-0 with Matt Poyneer absent. Reports: Highway Department – David Nielens – Written Report Roads & Bridges – Matt Poyneer – No report Code Enforcement Officer – Jay Moose – Written Report – Mr. Moose also discussed the changes in the codes; discussion on the burned-out house on Baptist Hill Road and the next steps to be taken. We need to send a stern letter to the owner requesting documentation that they are having issues with insurance company. Mr. Moose will handle. Mr. Moose also stated that a permit is needed for swimming pools. Buildings & Grounds – Mark Emerson – stated Air Conditioning on and the building painting will be scheduled. Dog Control – Lucy Ware – Written Report Youth, Parks & Rec. – Jeff Mills – Little League finishing up this week; stated that east and west portion of fence is $3.75per foot and 4 ends at $50.00 each would bring the total to $3,106.25. Motion made by Jeff Mills and seconded by Barbara Clancy to do this portion of fence and purchase whatever else is needed to complete the job. Motion carried 4-0 with Matt Poyneer absent. Mr. Mills also stated that estimate cost to fence the tennis court area of about 550 feet is $2437.50. If there is additional fencing remaining the cemetery will have an area replaced. Landfill & Recycling – Mark Emerson – all running smooth; he plans a visit to the Madison County transfer station to see how it operates. Cemetery – Lucy Ware – stated that the vault roof is being installed today; Jeff Emerson has repaired 25 head stones. Jeff needed to return borrowed equipment to Fort Hill, but they (Fort Hill) will try to fashion the necessary tools for us. Town Clerk – Charleen Wood – stated that the Town of Mentz had prepared new Town Clerk directories and distributed them to all the Cayuga County Clerks. Planning Board – Dwight Wethey – Jeff Emerson, Planning Board member, stated that there is a sub-division in the works ZBA Board - Lucy Ware – stated that there will be a meeting on June 20, 2018 to discuss a variance for setbacks and heights ---PAGE BREAK--- Historian – Mike Riley – No Report Village Liaison – Richard Nielens – everything is running smooth Veteran’s Memorial – Joe Felice/Lucy Ware – bricks have been moved, next meeting scheduled for 6/21; flower baskets stolen within 24 hours of placement Motion made by Barbara Clancy and seconded by Mark Emerson to go into Executive Session at 9:12 PM for Personnel and Contract issues. Motion carried 4-0 with Matt Poyneer absent. Motion made by Barbara Clancy and seconded by Mark Emerson to come out of Executive Session at 9:32 PM with no action taken.
