TOWN OF STERLING PLANNING BOARD MEETING September 26, 2017 A Special meeting of the Town of Sterling Planning Board was held on Tuesday September 26, 2017 at the Sterling Town Hall at 7:00 pm with the following members present:  June Ouellette ~ Chairman  Sue Allen ~ Member  Vernon Bishop ~ Member  Scott Crawford ~ Member  Paul Kelley ~ Member Also Present: Mark Greer, Joan Kelley, Attorney Richard Reilly, Steve McEwen, Ed & Amy Dodge and Jim & Pat Carr . Chairman Ouellette opened the meeting at 7:00 pm. PUBLIC HEARING William Greer Jr. Chairman Ouellette read aloud the legal notice and opened the Hearing at 7:01 pm. Notice is hereby given that the Planning Board of the Town of Sterling will hold a Public Hearing on Tuesday September 26, 2017 at 7:00 PM at the Sterling Town Hall, 1290 State Route 104A, Sterling, NY 13156. An Application for the Review of Subdivision by Mark Greer for property owned by William Greer Jr. will be heard regarding the Minor Subdivision of property located at 14591 Martville Road, Sterling, NY 13156; Tax Map # 10.00-1-67.11. All those wishing to be heard in favor of or in opposition of said application may appear in person or by other representation at said time and place. By order of the Planning Board, Lisa Somers, Clerk Chairman Ouellette asked Mark Greer to explain his subdivision request for the audience. Mr. Greer stated that he was handling the subdivision for his brother who has been residing out of state during this process. He also supplied the Planning Board with a notarized letter for the Town project file from his brother allowing the subdivision. The property is going to be split into three parcels – the current residence will be on a 35.9 acre parcel to be retained by owner William Greer, a second parcel will be 7.4 acres for a sister to build a future residence and a third parcel will be 32.5 acres for Mark Greer which he plans to merge with his existing property at 14541 Martville Road. The Planning Board had reviewed the survey map at the August 7th meeting and found items that needed to be corrected; the Board reviewed the minutes containing the list and found that the map was now complete. At this time the Hearing was opened for public comments as follows: 1. Several members of the audience reviewed the map to determine if their property would be affected. Mark Greer had stated that he planned to clear cut existing trees on a portion of his property to create farmland and the neighbors were concerned with the run-off that it could create. 2. A neighboring property owner was concerned that a housing development was being contemplated by the owners. The Board members explained that every split or subdivision of property must undergo an application process through the Town that includes notification to all the adjacent property owners. The term subdivision is often mistaken as meaning a housing development with new home construction, an access road and ---PAGE BREAK--- infrastructure. The application before the Board is to split a 75.8 acre family parcel into three new lots for family use and does not include development of the new lots. Any construction or use of land that disrupts more than an acre would require a building permit by the CEO and permitting through the DEC. Without further comments, a motion was moved by Member Kelley and seconded by Member Allen to close the Hearing at 7:34 pm, all were in favor and the motion carried. The Planning Board had reviewed Part I of the EAF for SEQR that had been submitted with the application and now proceeded to complete Part II and declare a Negative Declaration that the proposed action of Subdivision would not have any adverse environmental impacts. A motion to accept the minor 3 lot subdivision for William Greer Jr. was moved by Member Crawford and seconded by Member Kelley, all were in favor and the motion carried. Resolution 2017-04 BE IT RESOLVED, by the Planning Board for the Town of Sterling, upon the facts presented and the determination made, that the application for a 3 Lot - Minor Subdivision of property owned by William Greer Jr. and located at 14591 Martville Road, Sterling, NY 13156; Tax Map # 10.00-1-67.11 is hereby GRANTED upon the following express conditions: NONE but to be filed with Cayuga County within 62 days. Roll call vote was taken: Chairman Ouellette Aye Member Allen Aye Member Bishop Aye Member Kelley Aye Member Crawford Aye 5 AYES 0 NAYES 0 ABSTENTIONS – APPROVED PUBLIC HEARING Slobe Farms Real Estate, LLC Chairman Ouellette read aloud the legal notice and opened the Hearing at 7:01 pm. Notice is hereby given that the Planning Board of the Town of Sterling will hold a Public Hearing on Tuesday September 26, 2017 at 7:00 PM at the Sterling Town Hall, 1290 State Route 104A, Sterling, NY 13156. An Application for the Review of Subdivision by Slobe Farms Real Estate, LLC will be heard regarding the Minor Subdivision of property located at 1389 Curtis Co-Op Road, Sterling, NY 13156; Tax Map # 13.00-1-10.11. All those wishing to be heard in favor of or in opposition of said application may appear in person or by other representation at said time and place. By order of the Planning Board, Lisa Somers, Clerk Attorney Rick Reilly, representing the applicant, presented final maps and explained that a single 2 acre parcel inclusive of the house and barn on the north side of Curtis Co-Op Road was being subdivided from the farm to sell. Slobe Farms had purchased the property a few years ago and as they have done with other farms purchased in the County, they subdivide the existing structures with the minimum acreage allowed in order to sell them and retain the farmland. The existing 300’ radio tower is 10’ from the new rear property line, but does not impact the approval because the tower existed previous to Town zoning and is therefore not required to be in compliance with current standards. The surveyed map had been reviewed by the Board at the September 7th meeting and found to be complete with all of the required elements listed in the LUR. ---PAGE BREAK--- The Hearing was opened for public comments and would remain open for a half an hour. With no comments regarding this subdivision, a motion was moved by Member Kelley and seconded by Member Allen to close the Hearing at 7:34 pm, all were in favor and the motion carried. The Planning Board had reviewed Part I of the EAF for SEQR that had been submitted with the application and a few corrections had been initialed by the applicant. The Board proceeded to complete Part II and they declared a Negative Declaration in that the proposed action of Subdivision would not have any adverse environmental impacts to the surrounding area. A motion to accept the minor subdivision for Slobe Farms Real Estate, LLC was moved by Member Allen and seconded by Member Crawford, all were in favor and the motion carried. Resolution 2017-05 BE IT RESOLVED, by the Planning Board for the Town of Sterling, upon the facts presented and the determination made, that the application for a Minor Subdivision of property owned by Slobe Farms Real Estate, LLC and located at1389 Curtis Co-Op Road, Sterling, NY 13156; Tax Map # 13.00-1-10.11 is hereby GRANTED upon the following express conditions: NONE but to be filed with Cayuga County within 62 days.
