TOWN OF MENTZ REGULAR MEETING AUGUST 21, 2018 Supervisor Nielens called the meeting to order at 6:05 PM, led the Pledge of Allegiance to the Flag and asked for a moment of silence. Members Present: Supervisor Nielens, Councilman Mark Emerson, Councilwoman Barbara Clancy, Councilman Jeff Mills and Councilman Matt Poyneer. Others Present: Attorney Kevin Cox, Town Clerk Charleen Wood, Deputy Town Clerk/Cemetery Superintendent Lucy Ware, Highway Superintendent David Nielens, Code Enforcement Officer Jay Moose, Historian Mike Riley, Public: Tammy Smith, Richard & Bonnie Warrick, Kenneth Cook, Pamela McDowell, Terry & Kim Voudren, Danny White, Trudy Wright, Jessica Marks and Tracy Councilman Poyneer asked for verification of when board members were notified of Manure Lagoon: Supervisor Nielens - Tuesday morning of meeting; Councilman Emerson – Tuesday of meeting; Councilwoman Clancy – Thursday prior to meeting; Councilman Mills - day of meeting and Councilman Poyneer – day of meeting. Councilwoman Clancy asked the Supervisor again when he found out about the Lagoon and he stated again the Tuesday morning of the meeting. Councilman Poyneer stated that all officials should be made aware of things that impact the Town so they are prepared to discuss the issue. Minutes Approval: Minutes of the July 17, 2018 meeting: Motion made by Jeff Mills and seconded by Matt Poyneer to approve/accept the minutes as presented. Motion carried 5-0. Minutes of Public Hearing August 6, 2018: Motion made by Matt Poyneer and seconded by Jeff Mills to approve/accept the minutes as presented. Motion carried 5-0. Audit of Bills: General A $ 8,598.27 VO 201-230 General B $ 120.17 VO 16-17 Highway DB $14,488.69 VO 52-60 DA $10,062.01 VO 19-20 TA $ 1,790.78 VO 15-16 HF $ 250.00 VO 7 ---PAGE BREAK--- Discussion on voucher A220 for Mr. Loveless and the lighting for the Town of Mentz sign. Apparently, Mr. Loveless purchased lights from AAI for cash and they were not what were needed. He returned the lights to AAI and they credited the Town of Mentz account. He then purchased the lights at Edward Joy Lighting and installed them. The board questioned who authorized this purchase and pulled the voucher. Voucher A205 was also pulled because a discrepancy of billing for Porta-Potties. Discussion on Voucher A210 – Camardo Law Firm regarding the Dawson easement – this is part of water project – however, there was no charge. Motion made by Jeff Mills and seconded by Matt Poyneer to pay the audit of bills with the following exceptions: A220 and A205. Motion carried 5-0. Old Business: Cooper Issue – unable to locate Mr. Cooper to advise him of a tentative buyer of property. Insurance – discussion on insurance offered by Tompkins Health Insurance Consortium – this plan is comparable to the plan now in effect but offers a lower premium. Ken Cook of Montezuma Highway Department stated that they have this plan and it is very good and is a better value for the same coverage. Motion made by Mark Emerson and seconded by Barbara Clancy to rescind the motion made July 17, 2018 to continue with Falcone Insurance Gold +6 with $75.00 per month put in an HSA account. Motion carried 5-0. Motion made by Matt Poyneer and seonded by Barbara Clancy to go with the Tompkins County Consortium pending no contractual obligations with Falcone Insurance and interfering with employee insurance coverage. The percentage of contribution will remain 15% and 85%. Motion carried 5-0. Motion made by Barbara Clancy and seconded by Mark Emerson to continue with Falcone Insurance through December 31, 2018. Motion carried 5-0. New Business: Approval of Justice Court System Assistance Program – grant for security equipment Motion made by Jeff Mills and seconded by Mark Emerson to approve the request of the Justice Department to apply for the grant. Motion carried 5-0. Public to be Heard: Jessica Marks stated that she is working diligently with DEC, CH4 and Soil & Water to secure information regarding the Manure Lagoon. She has not received response to her FOIL request from DEC and has received limited information from Soil & Water. Notification received that work will resume at the Lagoon. DEC advised her that they would like to meet ---PAGE BREAK--- with her, but she declined stating that she wanted the Town Board to participate. She has a contact of Reggie Parker for DEC Supervisor Nielens stated that the moderator/facilitator would cost $500.00. Can we come up with another option? Motion made by Richard Nielens and seconded by Matt Poyneer to not pay a facilitator. Motion carried 5-0. Mr. Moose came out of a meeting and discussed the Town sign. He stated that years ago it was intended that lighting be on the sign, therefore, it is a Town owned and has nothing to do with the Veteran’s Memorial. The materials to build the sign were donated and the lighting was never completed. Motion made by Matt Poyneer and seconded by Mark Emerson to pay voucher A220 to Mr. Loveless. Motion carried 5-0. In the future the board should be advised prior to purchases of this magnitude. Reports: Highway Department – David Nielens – Written Report – Jeff Mills asked why the end of Mills Road and Route 31 was in disrepair. Highway Superintendent stated that state was notified but had done nothing. His department will try to repair. Roads & Bridges – Matt Poyneer – stated that NY Central Road was quiet. Barbara Clancy stated that at the Bridge update meeting this morning all was progressing well, and they were on target. Code Enforcement – Jay Moose – Written Report trying to get CO’s Buildings & Grounds – Mark Emerson – stated that there was an air condition leak in records room and has since been resolved; the building is being painted; and the floor is wet, we need to resolve the problem. Dog Control – Lucy Ware – Written Report Youth, Parks & Rec – Jeff Mills – stated that the school is using our fields; school storage unit on Green Street side; contractors working week- ends to finish the school fields; fence will be installed in September. Landfill & Recycling – Mark Emerson – stated that the dumpsters had not been dumped, he has a call into We Care and has deducted $50.00 from their invoice. Cemetery – Lucy Ware – stated that there were 2 burials and a cremation Planning Board – Dwight Wethey/Mike Riley/Jeff Emerson – Mike stated that the ZBA and Panning Board met jointly regarding a sub- division on Halsey Rd. and King St. for a non-conforming driveway for Mr. Blake. Mr. Blake will bring additional information for the joint meeting on September 11. The Zoning Re-Write committee is meeting ZBA Board – Lucy Ware – stated that they will have a ZBA meeting on 8/22 to address the Manure Lagoon. ---PAGE BREAK--- Town Clerk – Charleen Wood – stated that she will be attending a meeting in Canandaigua addressing tax collections and Town Clerk “Hot Topics” Historian – Mike Riley - No Report Village Liaison - Dick Nielens – still working with Village regarding the $60,000 from the water project – Montezuma agrees with us to split it equally, but the Village wants to go with percentages. No resolution has been reached. Veteran’s Memorial – Joe Felice/Lucy Ware – work detail scheduled for 8/25; concrete sidewalks to be discussed Attorney for Town: Kevin Cox – nothing to report Communications/Reminders: Supervisor Nielens read a Thank You letter from the fire department for use of fields for car show. The Supervisor stated he had received requests for funding in the 2019 budget from the Legion and Historical Society. Lucy Ware, Senior Citizens Rep, stated that the Senior Citizens would be putting in a letter to request funds for their trips.
