ARTICLE VIII. - SOLICITORS AND CANVASSERS DIVISION 1. - GENERALLY Sec. 10-201. - Definition. In this article "canvasser" or "solicitor" means an individual who travels by foot, wagon, automobile, motor truck, or any other type of conveyance, from place to place, from house to house, or from street to street, taking or attempting to take orders for sale of goods, wares and merchandise, personal property of any nature whatsoever for future delivery, or services to be furnished or performed in the future. Such definition shall include any person who, for himself, or for another, hires, leases, uses, or occupies any building, structure, tent, railroad boxcar, boat, hotel room, lodging house, apartment, shop, or any other place within the city for the sole purpose of exhibiting samples and taking orders for future delivery; provided, further, that no license fee shall be collected from a traveling salesman, merchant or dealer or employees thereof. It shall be the duty of any police officer of the city to: Require any person seen soliciting or canvassing, and who is not known by such officer to be duly licensed, to produce his solicitor's or canvasser's license. Enforce the provisions of this article against any person found to be in violation thereof. (Code 1976, § 7-3066) Secs. 10-203—10-215. - Reserved. DIVISION 2. - LICENSE Sec. 10-216. - Required. It shall be unlawful for any solicitor or canvasser to engage in business as such within the corporate limits of the city without first obtaining a license therefor. (Code 1976, § 7-3061) Sec. 10-217. - Application. Applicants for a license under this division must file with the director of planning and development a sworn application in writing, in duplicate, on a form to be furnished by the director of planning and development. The application shall give the following information: Name and description of the applicant. Permanent home address and full local address of the applicant. A brief description of the nature of the business and the goods or services to be sold. ---PAGE BREAK--- If the applicant is employed by another, the name and address of the employer, together with credentials establishing the exact relationship. The length of time for which the right to do business is desired. The place where any goods or property proposed to be sold or for which orders are to be taken are manufactured or produced; where such goods or products are located at the time the application is filed; and the proposed method of delivery. No. 51-08, § 1, 12-4-08) Sec. 10-218. - Registration fee. The fee assessed pursuant to this section is as referenced on the fee schedule in the City of Cartersville Code, section 17-89. (Code 1976, § 7-3064; Ord. No. 43-94, 10-27-94; Ord. No. 45-05, § 3, 7-7-05) Sec. 10-219. - Display. Solicitors and canvassers shall exhibit their licenses at the request of any citizen. (Code 1976, § 7-3065) Sec. 10-220. - Application; investigation; disqualification. Application for a license required by this division shall be made to the director of planning and development and shall state thereon the name of the applicant, the place of business and the number of employees intended to be engaged. The chief of police or any other officer of the city designated by the city council shall investigate each applicant for such a license and shall report to the director of planning and development whether or not such applicant is a person of good character. No license shall be issued to a person who has been convicted of the offenses of receiving stolen goods, burglary, robbery, stalking, rape, firearm offense and/or any felony conviction, unless that person's civil rights have been restored by property authorities.
