STREET/ALLEY CLOSURE Pre-Application Information 1. Prior to submitting a request to close a street or alley, please be advised that you, as the applicant, will need to provide the following information to our office or the closure will not be filed in the Clerk and Recorder’s Office and the transfer of ownership will not take place: a. A list of the last four digits of the social security numbers for all listed adjacent property owners and if business owners are involved, a list of their taxpayers’ identification numbers is required. b. If there are two-party ownerships involved, you will need to provide us with whether you want the deed filed under joint tenants or tenants in common. Joint Tenant means the right of survivorship is contained in the grant and that the surviving joint tenant takes the property upon the death of such joint tenant. Tenants in Common do not contain the right of survivorship as described above and the interest of each tenant in common goes to the heirs of that individual tenant in common. Reference Montana Code Annotated, Title 70, Chapter 20, Part 101, et seq. If any of the adjacent property owners do not want to supply this information, the closure will not be finalized and the transfer of ownership will not take place. Therefore, you will want to inform all adjoining property owners of the closure request prior to actually paying the fee and applying to close a street or alley. 2. All adjoining property owner taxes must be paid in full for the entire tax year, prior to the closure request continuing.
