PRESIDING JUDGE ORDER 22-01 SCHEDULE OF FINES AMENDED 4/18/22 The Broomfield Municipal Court is authorized to establish a procedure for the payment to the Court Clerk according to a schedule of fines, in some cases, in lieu of proceedings. Summons and Complaints with more than one general ordinance charge shall require an appearance before the Court. All persons w ho close their case by accepƟng the plea offer on their summons and complaint or through plea bargain procedures with the City AƩorney’s office, either by mail, epay or in person, shall pay the fine scheduled for the original violaƟon(s) charged. Any person who enters a plea of guilty or nolo contendere as part of a plea bargained disposiƟon and who does not wish to pay the fine scheduled must appear as scheduled on the summons and complaint. Stays of execuƟon for the fines may be gra nted by the office of the Municipal Court through a process agreed to by the Presiding Municipal Court Judge and the Municipal Court. The payment of the scheduled fine shall consƟtute a final judgment or convicƟon of the offense charged. All persons charged with offenses other than those listed on this fine schedule shall be required to appear in the Municipal Court. At the Ɵme of sentencing and based on a Judge’s discreƟon, fines may be increased or decreased depending on miƟgaƟng or aggravaƟng factors. The following fine schedule is hereby established and is subject to change. 1. Ordinance ViolaƟons ( Misdemeanor Offenses and Traffic Offenses ) Mandatory Court Appearance Those violaƟons of the Charter and Ordinances of the City and County of Broomfield that are ordinance violaƟons (generally referred to as misdemeanor offenses and traffic offenses ) require a mandatory court appearance and are not eligible for the fine in lieu of proceedings. 2. Traffic InfracƟons Those violaƟons of the Charter and Ordinances of the City and County of Broomfield that are designated as traffic infracƟons as further defined in the 2010 Model Traffic Code as adopted by the City of Broomfield are eligible for the fine in lieu of proceedings (penalty assessment). Summons and Complaints with more than one traffic charge may receive a plea bargain offer prior to appearing in Court provided the combined total of original points is no greater than six points. If the single or combined total of original points on the summons is greater than six points, the summons shall require an appearance before the Court. PAGE 1 ---PAGE BREAK--- 3. Schedule of Fines for Traffic InfracƟons This Court finds that the following traffic infracƟons are eligible for the fine in lieu of proceedings (penalty assessment) process. The following shall be followed: COURT COSTS OF $20.00 and a 10% MUNICIPAL COURT SURCHARGE SHALL BE ADDED TO ALL PENALTY ASSESSMENTS. THE PENALTY ASSESSMENT TO THE FINE SHALL BE INCREASED BY $30.00 IF THE CITED DRIVER CONTRIBUTED TO THE CAUSE OF AN ACCIDENT. Specifically, if a violaƟon is aggravated and/or habitual, the fine in lieu of proceedings (penalty assessment) should not be uƟlized. The fine amounts should be assessed as to original charges. Law enforcement officers should be familiar with the possible penalƟes for violaƟons of the Charter and Ordinances of the City and County of Broomfield and be prepared to give explanaƟon to a defendant. For all proceedings that come before the Court, the Court is not bound by this schedule of fines and will sentence defendants according to the penalƟes, fees, costs, and surcharges as outlined by the Charter and Ordinances of the City and County of Broomfield.
