1 RESOLUTION NO. 02 – 17895 A RESOLUTION TO CONSIDER ANNEXING TERRITORY UNDER THE PROVISIONS OF TITLE 7, CHAPTER 2, PART 43 OF THE MONTANA CODE ANNOTATED, AND FIXING A DATE FOR A PUBLIC HEARING ON THE QUESTION OF ANNEXATION. WHEREAS, the City Council of the City of Billings has determined that it is in the best interest of the City of Billings and the inhabitants of the below described contiguous territory that the boundaries of the City of Billings be extended to include said territory within the corporate limits of the City of Billings; and WHEREAS, the Billings City Council intends to consider annexing said territory pursuant to Title 7, Chapter 2, Part 43 of the Montana Code Annotated; and WHEREAS, the boundaries of the territory that the Billings City Council intends to consider annexing is particularly described as follows: Yellowstone Club Estates 4th Filing, Including all Amendments there of, Including all Adjacent Right of Way of 62nd Street West; Yellowstone Club Estates 5th Filing, Lots 1 & 2 of Block 13, Including all Adjacent Right of Way of 62nd Street West; Yellowstone Club Estates 6th Filing, Including all Adjacent Right of Way of 54th Street West; Certificate of Survey 836, Tract 10A, of Amended Tract 10; A Portion of Certificate of Survey 836, Tract 10 starting from the SW Corner of Lot 8, Block 11, of Yellowstone Club Estates 4th Filing, to a point S 33° 54’ 27” E a distance of 1025.93 feet, to the NW Corner of Lot 1, Block 3, of Yellowstone Club Estates 2nd Filing; thence N 46° E a distance of 144.59 feet; Thence N 7° E a distance of 960.0 feet, which is the west Line of Block 4, of Yellowstone Club Estates 2nd Filing; thence S 83° E a distance of 20.0 feet; thence N 7° E a distance of 135.0 feet, which is the west Line of Block 4, of Yellowstone Club Estates 2nd Filing; thence N 83° W a distance of 225.40 feet, which is the South Right-of- Way of Walter Hagen Drive; thence S 07° W a distance of 19.15 feet; thence along a non-tangent curve to the right with a radius of 310.0 feet a distance of 210.65 feet (chord bearing S ---PAGE BREAK--- RES 02-17895 2 26° 28’ 00” W a distance of 206.62 feet which is the SE Right-of-Way line of Tommy Armour Circle; thence S 45° 56’ W a distance of 45.01 feet; thence along a non-tangent curve to the right with a radius of 310.0 feet a distance of 411.20 feet (chord bearing S 83° 56’ 00” W a distance of 381.71 feet which is the SE Right-of-Way line of Sam Snead Trail; thence N 58° 04’ W a distance of 39.42 feet; thence S 31° 56’ W a distance of 125.0 feet, which is the point of beginning, and the SW Corner of Lot 8, Block 11, of Yellowstone Club Estates 4th Filing,; Certificate of Survey 1197, Tract 2B1, of Amended Tract 2B, Yellowstone County, Montana. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA: 1. The Billings City Council intends to consider annexation of the above- described contiguous territory. 2. All registered voters in the territory to be embraced are to be immediately notified, in writing. 3. Notice of the City Council’s intent to annex said territory shall be published as provided in Section 7-1-4127, MCA, with notice that for a period of twenty (20) days after first publication of the notice, the Billings City Clerk shall accept written comments approving or disapproving the proposed extensions of the boundaries of the City of Billings from registered voters residing in the area proposed to be annexed. 4. The City Clerk shall forward all written communication received by the Clerk to the City Council for consideration. 5.
