RESOLUTION 03-17980 A RESOLUTION SPECIFYING COST-OF-SERVICE WASTEWATER RATE SCHEDULE ADJUSTMENTS ENACTED PURSUANT TO TITLE 69, CHAPTER 7, MONTANA CODE ANNOTATED. WHEREAS, the City Council of the City of Billings, Montana, retained Integrated Utilities Group, Inc. to prepare wastewater rate cost-of-service schedules for the municipal wastewater utility that would generate adequate funds to operate the utility over the next five years as well as require each customer class of the utility to pay its fair share of the cost of operating the wastewater system; and WHEREAS, the WASTEWATER COST-OF-SERVICE ANALYSES, CITY OF BILLINGS, MONTANA, dated February 4, 2003, prepared by Integrated Utilities Group, Inc. and accepted and approved by the City Council of the City of Billings, Montana, projects a need for extension, expansion, repair, improvement, and continued operation and maintenance of existing and proposed wastewater system facilities for the providing of wastewater service to the inhabitants of the City of Billings, Montana, during the period beginning June 1, 2003, and ending June 30, 2008; and WHEREAS, under Title 69, Chapter 7 of the Montana Code Annotated, and under the terms of City Resolution Number 13585, the City of Billings is authorized to regulate the City’s municipal wastewater utility and to change wastewater rates, fees, and charges as may be deemed by the City Council to be reasonable and just; and WHEREAS, it is essential to the public health, welfare, and safety of the inhabitants of the City of Billings and its environs to provide an adequate public wastewater system and to provide adequate funding to meet the cost of constructing, maintaining, and operating the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BILLINGS, MONTANA: 1. That the following schedule of rates, fees, and charges are found to be just, reasonable, and necessary for the continued sound operation of the wastewater utility and that the proposed rates, fees, and charges are approved and adopted and published as the rates, fees, and charges of the City of Billings, Montana wastewater utility, effective June 1, 2003, July 1, 2004, July 1, 2005, July 1, 2006, and July 1, 2007. The average charge so computed shall be used as the basis for the bill computation, and in each succeeding month to and including the following April. That the City Council has directed that Year 1 of the rate schedules be adopted as indicated in the above referenced tables and that all rate schedules be reviewed in one year, prior to any further implementation. 3 ---PAGE BREAK--- 3. That this Resolution is to be immediately filed in the City Clerk’s Office, and that the decision adopting the adjusted rates shall be final ten days after such are so filed. 4. That the Public Utilities Department is directed to file a copy of the revised wastewater rate schedules with the Public Service Commission within ten days after filing of this Resolution by the City Clerk.
